律師委托合同英文【篇一：律師聘用協(xié)議(中英文對(duì)照)】律師聘用協(xié)議（中英文對(duì)照）律師聘用協(xié)議--風(fēng)險(xiǎn)收費(fèi)inconsiderationofthelegalservicestoberenderedbyzhang,wanglee(hereinafterreferredtoas“l(fā)awfirm”)foranyclaimthatbmiinc.ofu.s.a.(hereinafterreferredtoas“client”)mayhaveagainstthepartiesfordefaultpaymentofadebtowed,theclientdoesemploysaidlawfirmtocommenceandprosecutesuchclaim.考慮到張王李律師事務(wù)所（下文稱為“律師事務(wù)所”）愿為美國bmi公司（下文稱為“委托人”）提供訴訟法律服務(wù)以解決相關(guān)債務(wù)糾紛，委托人特此聘用該律師事務(wù)全權(quán)處理有關(guān)法律事務(wù)。clientagreestopay,andherebyassignstolawfirm,alienof33%ofallamountsrecoveredonbehalfofclientbysettlementbeforethefilingofalawsuitorotherlegalproceedings;33%ofallamountsrecoveredafterthefilingofalawsuitorotherlegalproceedingsbutpriortotrial;and33%ofallamountsrecoveredorawardedupontrial.不管在提起訴訟之前雙方達(dá)成庭外和解，還是訴訟提起之后但在審判前雙方達(dá)成和解，仰或是通過庭審判決得到賠償，委托人同意向律師事務(wù)所支付獲償額的33%作為律師費(fèi)。allnecessarycostsandexpensesintheprosecutionofthecaseshallbetheresponsibilityoftheclient.iflawfirmadvancesfundsonbehalfoftheclientforanycostsorexpenses,clientagreestoreimburselawfirmforsuchadvancements.在案件訴訟過程中的所有必要費(fèi)用都應(yīng)由委托人支付。如果律師事務(wù)所為委托人預(yù)先墊付任何費(fèi)用，委托人同意償還相關(guān)墊付費(fèi)用。allexpensesandchargesofanynaturemadeinconjunctionwiththecasearenotlitigationcostsandwillbepaidbyclient.intheeventofarecovery,clientagreesthatlawfirmmaypayanyoftheseunpaidbillsfromclient’sshareoftherecovery.ifclientrecoversnothing,itisunderstoodthatlawfirmisnotboundtopayanyoftheseexpenses.委托人同意因辦理本案所產(chǎn)生的非訴訟費(fèi)用也應(yīng)由委托人支付。在得到獲償賠付的情況下，律師事務(wù)所可以從委托人應(yīng)得的賠付金額中扣除未付的非訴訟費(fèi)用。如果委托人得不到獲償，委托人也須支付這些費(fèi)用。lawfirm,initsabsolutediscretion,maywithdrawatanytimefromthecaseuponnoticetoclientifinvestigationdisclosesnobasisforfurtheractiononbehalfofclient,orifclientfailstocooperateinlawfirm’sprosecutionofthecase.associatecounselmaybeemployedatthediscretionandexpensesoflawfirm.如果調(diào)查表明案件無進(jìn)一步訴訟的理由，或委托人在訴訟中不予配合，一經(jīng)通知委托人，律師事務(wù)所有權(quán)自主決定于任何時(shí)候退出案件代理。clientagreesnottocompromisetheclaimwithoutlawfirm’sconsentandlawfirmisnotauthorizedtodosowithouttheconsentoftheclient.委托人承諾未經(jīng)事務(wù)所的同意不得對(duì)本案作任何妥協(xié)和讓步，且未經(jīng)委托人同意律師事務(wù)所也不得作任何妥協(xié)和讓步。thefeeforservicesrenderedbylawfirmdoesnotincludetheperfectingofanappealonbehalfoftheclientortherepresentationoftheclientifanappealhasbeenperfectedbytheadverseparty.feesforappealshallbesubjecttorenegotiationbetweenlawfirmandclient.本合同約定付給律師事務(wù)的法律服務(wù)費(fèi)不包括代理委托人提起上訴或因?qū)Ψ疆?dāng)事人上訴而應(yīng)訴所產(chǎn)生的費(fèi)用。上訴費(fèi)用應(yīng)由律師事務(wù)所與委托人重新商定。clientagreestokeepthelawfirmadvisedofhiswhereaboutsatalltimesandtocooperateinthepreparationandtrialofthecase,toappearonnoticefordepositionsandcourtappearances,andtocomplywithallreasonablerequestsmadeofhiminconnectionwiththepreparationandpresentationofthiscase.委托人同意隨時(shí)告知律師事務(wù)所其行蹤，在案件準(zhǔn)備和庭審期間參與合作，接到庭外當(dāng)面質(zhì)證和庭審?fù)ㄖ獣r(shí)按時(shí)到場(chǎng)，并履行在案件的準(zhǔn)備和庭審過程中對(duì)其的所有合理要求。clientherebyauthorizeslawfirmtoprovideallinformation,includingdoctors’reports,宿等必要費(fèi)用由甲方承擔(dān)。duetothelegalworkofthiscontract,thetextprintedfees,thetranslationfees,thegovernmentfeesandcharges,transportationexpenses,accommodation,cateringandothernecessaryexpensesthatmayoccuroutsidethewuhancentercityshouldbebornebypartya.6.通知和送達(dá)/noticeandservice6.1.甲乙雙方因履行本協(xié)議而相互發(fā)出或者提供的所有通知、文件、資料，均以本協(xié)議所列明的地址、傳真或電子郵件送達(dá)，一方如果遷址或者變更電話、傳真、電子郵件的，應(yīng)當(dāng)以書面形式通知對(duì)方。allnotifications,filesanddatamutuallyissuedbybothpartiesarisingfromtheperformanceofthisagreementshouldbeservedaccordingtotheaddress,faxore-mailspecifiedinthisagreement;anypartyshallnotifytheotherpartyinwritingintheoccasionofrelocationorchangingthephone,fax,ore-mail.6.2.使用傳真方式的，在發(fā)出傳真時(shí)視為送達(dá)；以郵寄方式的，掛號(hào)寄出或投郵日視為送達(dá)；使用電子郵件方式的，郵件發(fā)送成功視為送達(dá)。byfax,thefaxisdeemedservedupontheissue;bymail,themailisdeemedservedonthedateofpostingorregistering;bye-mail,themessageisdeemedservedwhensentsuccessfully.7.協(xié)議的終止/terminationofagreement7.1.本協(xié)議的雙方經(jīng)協(xié)商一致后可終止本協(xié)議。upontheagreementofbothpartiesthecontractcanbeterminated.7.2.本代理協(xié)議涉及的糾紛各方達(dá)成和解，或一審（二審）判決、調(diào)解、案外和解及撤回起訴，則屬于乙方律師完成代理工作，本協(xié)議終止。ifthepartiesofthedisputeinvolvedinthisagreementreachedasettlementagreement,mediation,reconciliationorgotthefirsttrial(secondtrial)judgment,orwithdrewtheprosecution,theagencyworkofpartybiscompletedandthisagreementisterminated.7.3.本協(xié)議終止后，雙方應(yīng)進(jìn)行相應(yīng)的清理和工作交接。upontheterminationofthisagreement,thepartiesshallmaketheappropriatecleanupandtransferofwork.8.爭(zhēng)議解決/disputeresolution8.1.雙方在履行本協(xié)議過程中發(fā)生爭(zhēng)議的，由雙方協(xié)商解決。inthecourseofperformanceofthisagreement,disputesshouldberesolvedthroughfriendlyconsultations.8.2.協(xié)商不能解決的，可向武漢仲裁委員會(huì)申請(qǐng)仲裁。ifconsensuscan’tbeagreedupon,anypartymayapplytothewuhanarbitrationcommissionforarbitration.9.其他/others9.1.本協(xié)議一式兩份，雙方各執(zhí)一份，具有同等法律效力。thiscontracthastwooriginals;partyaandbeachhasone.eachonehastheequallegaleffect.9.2.本協(xié)議未盡事宜由甲、乙雙方另行協(xié)商解決。partiesheretomayreviseorsupplementthemattersnotm
