幼兒園章程(模板)幼兒園章程第一章總則根據《教育法》、《民辦教育促進法》、《民辦教育促進法實施條例》、《民辦非企業單位登記暫行條例》和相關法律法規，制定本章程。第二條幼兒園名稱：第三條幼兒園地址：第四條幼兒園性質：本園為自愿舉辦、非盈利性社會服務機構，是基礎教育的有機組成部分，是學校教育制度的基礎階段，為學前幼兒提供保育和教育。第五條辦學宗旨：本園遵守法律法規，貫徹國家的教育方針，遵守社會道德風尚。第六條監督管理：本園自愿接受上杭縣教育局、上杭縣民政局的業務指導和監督管理。第七條條款規定：本章程中的各項條款如與法律、法規、規章不符，以法律、法規、規章的規定為準。第二章舉辦者、開辦資金和辦學結構第八條舉辦者：本單位的舉辦者是（刪除有問題的內容）。舉辦者享有以下權利：（一）了解本單位經營狀況和財務狀況；（二）推薦董事或理事；（三）有權查閱理事會或董事會會議記錄和本單位財務會計報告。第九條開辦資金：本單位開辦資金為萬元，出資者為（刪除有問題的內容），金額為萬。第十條辦學結構：（一）辦學規模：1.本園占地面積平方米；2.建筑面積平方米；3.幼兒園戶外活動面積平方米；4.審批部門核準在園生人數為個班，人。（二）辦學層次：幼兒園學制為三年。（三）辦學形式：本園招生對象為3-6歲的幼兒，提供小、中、大班全日制學前教育。第三章組織管理制度第十一條董事會：本園依法設立董事會，每屆任期三年，是幼兒園的決策機構。第十二條董事會人員：董事會人員應不少于五人，主要由舉辦者或其代表、校長、教職工代表組成。其中，三分之一以上的董事應具有五年以上教育教學經驗。第十三條董事會成員：董事會成員必須熱心教育事業，品行良好，具有政治權利和完全民事行為能力。第十四條董事會人員更換：首屆董事、董事長由舉辦者推選產生。董事長更換由董事會投票選舉，全體董事過半數通過。董事更換由董事長提名，經三分之二以上董事會組成人員同意通過。第十五條董事任期：董事每屆任期為三年，可以連選連任。第十六條職權：董事會行使以下職權：（一）聘任和解聘園長；（二）修改幼兒園章程和制定幼兒園的規章制度；（三）制定發展規劃，批準年度工作計劃；（四）籌集辦學經費，審核預算、決算；（五）決定教職工的編制定額和工資標準；（六）決定幼兒園的分立、合并、終止。Article17:TheBoardofDirectorsshallholdatleasttwomeetingseveryyear,andaninterimmeetingmaybecalledinthefollowingsituations:(1)WhentheChairmandeemsitnecessary;(2)Whenproposedbymorethanone-thirdofthemembersoftheBoardofDirectors.Article18:TheBoardofDirectorsshallhaveoneChairmanandoneViceChairman.Article19:TheViceChairmanshallassisttheChairmaninhis/herwork.WhentheChairmanisunabletoexercisehis/herpowers,theViceChairmandesignatedbytheChairmanshallexercisehis/herpowersonhis/herbehalf.Article20:TheChairmanshallexercisethefollowingpowers:(1)ConveningandpresidingovermeetingsoftheBoardofDirectors;(2)ImplementingtheimplementationofresolutionsoftheBoardofDirectors;(3)Signingrelevantdocumentsonbehalfofthekindergarten;(4)Fulfillingobligationsandresponsibilitiesstipulatedbylaws,regulations,andrelevanteducationalregulations.Article21:TheBoardofDirectorsshallimplementaone-person-one-votesystemandtheminorityshallbesubjecttothemajoritybasedonthenumberofdirectorspresentatthemeeting.Whenthenumberofvotesinfavorandagainstareequal,theChairmanshallmakethefinaldecision.However,forthefollowingmajorissues,approvalbymorethantwo-thirdsofthemembersisrequired:(1)Appointmentanddismissaloftheprincipal;(2)Amendmentofthekindergarten'sarticlesofassociation;(3)Formulationofdevelopmentplans;(4)Reviewofbudgetsandfinalaccounts;(5)Decisionsonotherimportantchangessuchastheseparation,merger,andterminationofthekindergarten.Article22:TheChairmanorhis/herdesignatedpersonnelshallnotifyalldirectorsofthetime,place,andcontentofthemeetingtendaysbeforetheBoardofDirectorsmeeting.Ifadirectorisunabletoattendthemeetingduetounforeseencircumstances,he/shemayappointanotherdirectortoattendthemeetingonhis/herbehalf.Theauthorizationlettermustspecifythescopeofauthorization.Article23:ThenumberofdirectorspresentattheBoardofDirectorsmeetingmustbemorethanhalfofthetotalnumberofdirectors.Ifitislessthanhalf,theresolutionpassedisinvalid.Ifthenumberofdirectorswhoapprovetheresolutionafterthemeetingexceedstwo-thirdsoftheabsentdirectors,theresolutionisvalid.Article24:TheBoardofDirectorsshallkeeparecordofthemeetingandtheattendingdirectorsshallsignonthemeetingrecord.ThedirectorsshallberesponsiblefortheresolutionsoftheBoardofDirectorsmeeting.TherecordsoftheBoardofDirectorsmeetingshallbekeptandmanagedbypersonneldesignatedbytheChairman.Article25:Thekindergartenshallhaveoneprincipal,whoshallbeappointedordismissedbytheBoardofDirectors.Article26:TheprincipalshallberesponsibletotheBoardofDirectorsandexercisethefollowingpowers:(1)Implementingthedecisionsofthekindergarten'sBoardofDirectors;(2)Implementingdevelopmentplans,draftingannualworkplans,financialbudgets,andkindergartenrulesandregulations;(3)Appointinganddismissingkindergartenstaff,andimplementingrewardsandpunishments;(4)Organizingeducationalandteachingactivities,scientificresearchactivities,andensuringthequalityofeducationandteaching;(5)Beingresponsibleforthedailymanagementofthekindergarten;(6)Beingresponsibleforthesafety,health,andhealthmanagementofthekindergarten.Article27:TheprincipalshallnotchangetheresolutionsoftheBoardofDirectorsorexceedthescopeofauthorizationwhenexercisinghis/herpowers.ChapterIVLegalRepresentativeoftheKindergartenArticle28:TheChairmanshallbethelegalrepresentativeofthekindergarten.Article29:Thefollowingsituationsshalldisqualifyapersonfromservingasthelegalrepresentativeofthekindergarten:第四十二條規定了幼兒園提取發展基金的用途，包括建設、維護和更新教學設備等。第四十三條規定了出資人取得合理回報的比例，必須經過三分之二以上董事會成員同意才能通過。在確定比例后15天內，必須將決定和與辦學水平、教育質量有關的材料、財務狀況報審批機關備案。第七章規定了章程的修改程序，必須經過董事會表決通過后15天內，報業務主管
