甲方:PartyA:地址:Address:法人代表:LegalRepresentative:乙方:;性別:;身份證號(hào)碼:PartyB:;Gender:;IDCardNo.:戶籍所在地址:郵編:Theseatoftheregisteredresidence:Code:上海市通訊地址:郵編:MailAddressofShanghai:Code:基于乙方完全理解其所應(yīng)聘甲方的崗位/職位的工作性質(zhì)、特點(diǎn)和要求,以及工作環(huán)境和條件,根據(jù)《中華人民共和國(guó)勞動(dòng)法》(以下簡(jiǎn)稱“《勞動(dòng)法》”)、《中華人民共和國(guó)勞動(dòng)合同法》(以下簡(jiǎn)稱“《勞動(dòng)合同法》”)及其它相關(guān)中國(guó)現(xiàn)行法律法規(guī)的有關(guān)規(guī)定,雙方在合法、公平、平等自愿、協(xié)商一致、誠(chéng)實(shí)信用的基礎(chǔ)上,簽訂本合同。雙方在此同意,公司雇傭員工為其全日制職工,且雙方之間的勞動(dòng)關(guān)系受勞動(dòng)法律以及公司不時(shí)修訂的在公司人力資源部門保存的公司員工手冊(cè)和其他各項(xiàng)內(nèi)部規(guī)章制度的約束(下稱“公司內(nèi)部規(guī)章”)。BasedonPartyBfullyunderstandingtheoccupation’sdescription,characterandrequirementprovidedbyPartyA,undertheLaborLawofthePeople’sRepublicofChinaandotherrelevantlawsandregulations(togetherreferredtoas“LaborLaws”),PartyAandPartyBhavereachedthisContractoftheirfreewillonthebasisofequalconsultation,andagreedtocomplywithallprovisionsasstipulatedinthisContract.Bothpartiesconfirmthat,PartyBisafull-timeemployeeofPartyAandobeysLaborLaws;EmployeeHandbookssignedbyPartyBandkeptbyHRdepartment,anyandallPartyA’sotherregulations(“together,referredtoas“CompanyinternalRegulation”).1.定義和解釋1.DefinitionandExplanation1.1 甲方的關(guān)聯(lián)企業(yè):在本合同中指控制甲方或被甲方所控制的、或與甲方共同受控制于同一實(shí)體的任何企業(yè)。控制是指直接或間接擁有該企業(yè)百分之五十(50%)以上的股權(quán)、投票權(quán)或管理權(quán)。為明確起見(jiàn),雙方特此確認(rèn)甲方關(guān)聯(lián)企業(yè)包括但不限于[]。1.1PartyA’sAffiliate(s):meansanylegalentitythatdirectlyorindirectlycontrolsanotherentityviabeneficialownershipofmorethanfiftypercent(50%)ofvotingpowerorequityinanotherentity("Control"),orisControlledbyanotherentityorisundercommonControlwithanotherentity,solongassuchControlexists.Moreclear,bothpartiesconfirmthatPartyA‘sAffiliate(s)isincludingbutnotlimited______________..1.2 商業(yè)秘密:在本合同中指:(a)甲方或甲方的關(guān)聯(lián)企業(yè)擁有的或者與甲方或甲方的關(guān)聯(lián)企業(yè)實(shí)際或者預(yù)期的商業(yè)活動(dòng)、研究和發(fā)展有關(guān)的未向社會(huì)公開(kāi)的非公開(kāi)信息、技術(shù)資料(包括但不限于設(shè)計(jì)、程序、產(chǎn)品配方、制作工藝或者公式、技術(shù)、設(shè)計(jì)、技術(shù)圖示和圖紙、工程方案、硬件配置信息)、經(jīng)營(yíng)資料(包括但不限于經(jīng)營(yíng)決策、客戶名單、管理訣竅、供貨渠道、銷售渠道)、公司的客戶(包括但不限于那些在乙方受聘期間乙方曾經(jīng)交往和熟悉的客戶)、財(cái)務(wù)資料(包括但不限于銷售額、營(yíng)業(yè)數(shù)額)、人事資料(包括但不限于公司組織結(jié)構(gòu)、員工工資)、商業(yè)交易秘密或者KNOW-HOW(包括但不限于研發(fā)計(jì)劃、產(chǎn)品計(jì)劃、任何與公司的產(chǎn)品、服務(wù)和市場(chǎng)相關(guān)的其他信息)和/或其他任何可能對(duì)甲方或甲方的關(guān)聯(lián)企業(yè)的經(jīng)濟(jì)利益或競(jìng)爭(zhēng)優(yōu)勢(shì)造成影響的資料;(b)甲方或甲方的關(guān)聯(lián)企業(yè)必須對(duì)第三方承擔(dān)保密責(zé)任的任何資料。1.2ConfidentialInformation:(a)meansanyinformation,technicaldata,orknow-howconsideredconfidentialbyPartyAorPartyA’sAffiliate(s),includingbutnotlimitedto,research,products,software,services,development,inventions,processes,specifications,designs,drawings,diagrams,engineering,marketing,techniques,maskworks,designtapes,documentation,customerandsupplierinformation,pricinginformation,procedures,data,concepts,andfinancial,marketing,sales,manufacturing,operational,strategicplanning,budgetingandotherinformationdisclosedbyPartyAorPartyA’sAffiliate(s),whichisclearlymarkedoridentifiedas“Confidential”incaseofdisclosureinanytangibleformandwhichisclearlydesignatedasconfidentialatthetimeofdisclosureandthereafterreducedtoawrittensummarywithinthirty(30)daysincaseofdisclosureinanyintangibleform.(b)anyandallinformationordocumentsthatPartyAorPartyA’sAffiliate(s)shouldkeepconfidentialtothethirdparty.2.聘用期限、勞動(dòng)報(bào)酬2.TermofLaborContract,RemunerationofLabor2.1 甲方聘用乙方的合同種類、期限、試用期、工資計(jì)算方式、具體數(shù)額、工作地點(diǎn)、職位、工作內(nèi)容及職責(zé)范圍詳見(jiàn)本合同附件—:《員工聘用期限/薪資/工作說(shuō)明表》。2.1LaborContracttype,period,probationperiod,salarycalculation,theamount,workingplace,title,jobdescriptionandresponsibilitywillrefertotheAttachmentone(“EmployeeJobperiod/Salary/JobDescriptionForm)ofthisLaborcontract.2.2乙方同意根據(jù)附件一的相關(guān)規(guī)定從事相應(yīng)的崗位工作并領(lǐng)取工資,附件一中的工資數(shù)額為稅前工資數(shù)額,甲方需依法為乙方代扣代繳由此產(chǎn)生的個(gè)人所得稅。2.2PartyBagreestoworkandgetthesalaryfromAttachmentone,theamountshowedintheattachment1isbefore-taxsalaryandthatPartyAwilldeducttheincometaxforPartyBaccordingtothelaws.2.3 甲方應(yīng)每月日前以貨幣(人民幣)形式足額支付乙方工資。在法定工作時(shí)間內(nèi),乙方完成甲方規(guī)定的合理工作任務(wù)的,月工資不得低于本市規(guī)定的職工月最低工資標(biāo)準(zhǔn)。甲方安排乙方加班或延長(zhǎng)工作時(shí)間,應(yīng)根據(jù)國(guó)家及本市有關(guān)規(guī)定,按公司加班政策支付報(bào)酬。2.3PartyAshouldpaythesalarytoPartyBwiththeRMBcurrencyform.Inthelegalworkinghour,PartyB6.WorkDevice6.1 甲方應(yīng)當(dāng)向乙方提供履行職責(zé)所必須的工作設(shè)備。甲方提供乙方的工作設(shè)備只能用于與甲方業(yè)務(wù)有關(guān)的用途,不得用于與甲方業(yè)務(wù)無(wú)關(guān)并且影響到甲方業(yè)務(wù)、利益以及規(guī)章制度的執(zhí)行的任何用途。6.1PartyAshouldprovidetheworkdevicetoPartyBfortheworkpurpose.ExceptforPartyA’sbusiness,thisworkdeviceisprohibitedtouseanyotherpurposethatisnotrelativewithPartyAandmaydoharmtoPartyA’sbusiness,interestandregulationfulfillandanything6.2 甲方有權(quán)隨時(shí)對(duì)工作設(shè)備的使用情況進(jìn)行檢查,如發(fā)現(xiàn)乙方違反上述規(guī)定使用工作設(shè)備,甲方有權(quán)終止該設(shè)備的使用,直至收回工作設(shè)備。乙方不得以工作設(shè)備中包含私人物品、個(gè)人隱私資料、軟件或其他個(gè)人財(cái)產(chǎn)為理由阻止甲方對(duì)工作設(shè)備行使合法的權(quán)利。6.2PartyAhastherighttosupervisetheworkdevice,ifanybreachofusingrule,Partycanterminatetheuseofsuchdeviceatanytimetillreturnit.PartyBcan’tdisturbPartyA‘slegalrightstothisdevicewithanypersonalreasons,suchasitcoverspersonalthings,personalconfidentialinformation,softwareandotherpersonalproperty.7.勞動(dòng)保護(hù)、勞動(dòng)條件及職業(yè)病危害防護(hù)7.Laborprotect/Laborcondition/ProtectonWork-relatedInjury7.1 甲方保證依照法律法規(guī)規(guī)定給予乙方必要的勞動(dòng)保護(hù)和職業(yè)危害保護(hù),包括但不限于安排乙方的工作時(shí)間及休息日符合國(guó)家規(guī)定;提供安全、衛(wèi)生的工作環(huán)境,并根據(jù)工作需要,按國(guó)家規(guī)定向乙方提供勞動(dòng)保護(hù)工具和保健用品;女職工孕期、產(chǎn)期、哺乳期內(nèi)對(duì)其提供相應(yīng)的勞動(dòng)保護(hù)。7.1PartyAwilldefendPartyBfromthedamagefromwork-relatedinjuryandprovidenecessarylaborprotectaccordingtothegovernmentlawsandregulation,includingbutnotlimitedtoarrangePartyB’sworktimeandresttimebasedontheruleofgovernment;providethesafeandcleanworkenvironment,providethetooloflaborprotectandbodyhealth;providethelaborprotectforthewomenemployeeduringthepregnancy,maternityleaveandfeedingperiods.7.2乙方從事接觸職業(yè)病危害作業(yè)乙方,并進(jìn)行職業(yè)危害防范專項(xiàng)培訓(xùn),采取針對(duì)性的勞動(dòng)防護(hù)措施,提供上崗前、在崗和離崗前職業(yè)健康檢查。7.2PartyAwillpriornoticePartyBifanyworkmayrefertotheharmofwork-relatedinjury,providethepreventtrainingandmeasures,andprovidethebodycheckbeforethework,inandafterthework.7.3乙方須遵守甲方制定的作業(yè)指導(dǎo)書(shū)、操作規(guī)程、勞動(dòng)安全衛(wèi)生制度,自覺(jué)預(yù)防事故和職業(yè)病的發(fā)生。7.3PartyBshouldobeytheguideline,actioninstructionandlaborsafeandhealthregulation,andpreventtheincidentandwork-relatedinjury.8.勞動(dòng)紀(jì)律8.Labordiscipline8.1 乙方應(yīng)遵守國(guó)家的各項(xiàng)法律規(guī)定和甲方依法制定的各項(xiàng)規(guī)章制度。乙方違反勞動(dòng)紀(jì)律,甲方可依據(jù)本單位的規(guī)章制度,給予必要的紀(jì)律處分以及經(jīng)濟(jì)處罰,包括但不限于解除本合同。8.1PartyBshouldobeyallgovernmentlawsandregulationsmadebyPartyA.Ifanybreach,PartyAcanpunishPartyBbasedontheaccordingpolicy,includingbutnotlimitedtoterminatethislaborcontract.8.2 甲方應(yīng)當(dāng)向乙方提供履行職責(zé)所必須的工作設(shè)備。甲方提供乙方的工作設(shè)備只能用于與甲方業(yè)務(wù)有關(guān)的用途,不得用于與甲方業(yè)務(wù)無(wú)關(guān)并且影響到甲方業(yè)務(wù)、利益以及規(guī)章制度的執(zhí)行的任何用途。(與6.1重復(fù))8.2PartyAshouldprovidetheworkdevicetoPartyBfortheworkpurpose.ExceptforPartyA’sbusiness,thisworkdeviceisprohibitedtouseanyotherpurposethatisnotrelativewithPartyAandmaydoharmtoPartyA’sbusiness,interestandregulationfulfillandanything8.3 甲方有權(quán)隨時(shí)對(duì)工作設(shè)備的使用情況進(jìn)行檢查,如發(fā)現(xiàn)乙方違反上述規(guī)定使用工作設(shè)備,甲方有權(quán)終止該設(shè)備的使用,直至收回工作設(shè)備。乙方不得以工作設(shè)備中包含私人物品、個(gè)人隱私資料、軟件或其他個(gè)人財(cái)產(chǎn)為理由阻止甲方對(duì)工作設(shè)備行使合法的權(quán)利。(與6.2重復(fù))8.3PartyAhastherighttosupervisetheworkdevice,ifanybreachofusingrule,Partycanterminatetheuseofsuchdeviceatanytimetillreturnit.PartyBcan’tdisturbPartyA‘slegalrightstothisdevicewithanypersonalreasons,suchasitcoverspersonalthings,personalconfidentialinformation,softwareandotherpersonalproperty.9.技術(shù)培訓(xùn)9.SkillTraining9.1甲方將根據(jù)需要為乙方提供基本的職業(yè)技術(shù)培訓(xùn),乙方應(yīng)當(dāng)接受甲方安排的培訓(xùn)活動(dòng)。9.1PartyAmayprovidethebasicprofessionskilltrainingforPartyB,andPartyshouldacceptsucharrangement.9.2 甲方為乙方提供專項(xiàng)培訓(xùn)費(fèi)用,對(duì)其進(jìn)行專業(yè)技術(shù)培訓(xùn)(包括但不限于出國(guó)培訓(xùn),專業(yè)技術(shù)的外訓(xùn)或內(nèi)訓(xùn)等)的,有權(quán)與乙方簽訂培訓(xùn)協(xié)議,約定服務(wù)年限。具體事宜由雙方按照法律規(guī)定在培訓(xùn)協(xié)議中約定。9.2PartyAhastherighttosignthetrainingagreementandappointtheserviceperiodwithPartyBifPartyApaysthetrainingfeesandprovidestheprofessionskilltraining,includingbutnotlimitedtheabroadtraining,professiontrainingorinternaltraining.Thedetailspleaserefertothetrainingagreementsignedbybothpartiesaccordingtothelaws.10.合同變更10.ContractChange10.1 雙方經(jīng)協(xié)商同意,可隨時(shí)變更本合同的任何內(nèi)容。包括但不限于以下情形:10.1Afterbothpartiesnegotiateandagreeingoodfaith,anycontentofthisLaborContractcanbechangedatanytimebasedontheconditionasbelow,whichisincludingbutnotlimited:10.1.1 訂立本合同所依據(jù)的法律、法規(guī)已經(jīng)修改;10.1.1TheapplicablelawsorprovisionsofthisLaborContracthavebeenrevised;10.1.2 甲方的經(jīng)營(yíng)條件、主要業(yè)務(wù)或產(chǎn)權(quán)結(jié)構(gòu)發(fā)生重大變化,無(wú)法繼續(xù)履行本合同的;10.1.2AmajorchangeinPartyA’sbusinesscircumstances,mainbusinessorthepropertyframereliedresultstheLaborContracthardtoperform;10.1.3 由于任何一方當(dāng)事人難以克服的客觀原因致使本合同無(wú)法正常履行的;10.1.3TheobjectiveandinsurmountablereasonofanypartyresultstheLaborContracthardtoperformnormally.10.1.4 法律規(guī)定的其他情況。10.1.4Othercircumstancesstipulatedinlawsoradministrativestatutes.10.2 乙方同意,如果發(fā)生下列任何一種情況,甲方有權(quán)單方面對(duì)乙方的任職部門、職位、級(jí)別、工資及工作內(nèi)容進(jìn)行調(diào)整;10.2PartyBagrees,PartyAcanunilaterallyadjustPartyB’sdepartment,title,scale,salaryandjobcontent,if:10.2.1 乙方違反了公司規(guī)則(包括但不限于員工手冊(cè)、人事管理制度、標(biāo)準(zhǔn)作業(yè)規(guī)范等)并被記大過(guò);10.2.1PartyBisrecordedofseriousdemeritbecauseofbreachingCompanypolicy,includingbutnotlimitedEmployeeHandbook,HRmanagementPolicy,standardpolicyandsoon;or10.2.2 乙方有失職行為或被證明不能勝任本職工作;10.2.2PartyBcommitsseriousderelictionofdutyorisincompetentandisprovedtobeincompetent;or10.2.3 乙方不服從直接上級(jí)職權(quán)范圍內(nèi)合理的指示;10.2.3PartyBdoesn’tobeythereasonableorderfromhisdirectleader;or10.2.4 乙方行為不當(dāng),與正當(dāng)及忠誠(chéng)履行職責(zé)的原則不相符;10.2.4PartyB’sbehaviorisnotapplicableandnotaccordancewiththeprinciplesofjusticeandhonesty;or10.2.5 乙方所任職的部門或所擔(dān)當(dāng)?shù)膷徫灰蚩陀^原因而被撤銷;10.2.5Theoccupationisrevokedfortheobjectivereason;or10.2.6 乙方因疾病、受傷或意外而無(wú)法履行其職務(wù)的時(shí)間連續(xù)超過(guò)二十個(gè)工作日或在十二個(gè)月內(nèi)累計(jì)超過(guò)三十個(gè)工作日。10.2.6PartyBserialleavetimereachesmorethantwenty(20)workingdaysorthirty(30)workingdayswithintwelvemonths.11.合同解除與終止、經(jīng)濟(jì)補(bǔ)償金11.TerminationofLaborContract/Economiccompensation11.1 乙方提前解除本合同,試用期內(nèi)應(yīng)當(dāng)提前三日通知甲方,試用期后應(yīng)當(dāng)提前三十日以書(shū)面形式通知甲方。11.1PartycanterminatetheLaborContractwithpriorthree(3)daysnoticetoPartyAintheprobationperiodandwithpriorthirty(30)dayswrittennoticetoPartyA.11.2其他關(guān)于勞動(dòng)合同的解除和終止及支付經(jīng)濟(jì)補(bǔ)償金的情形照國(guó)家和地方的有關(guān)規(guī)定執(zhí)行。11.2OthercircumstancesofterminatingtheLaborContractsandpaymentofeconomiccompensationwillrefertotherelativegovernmentlawsorregulations.11.3乙方無(wú)論何種原因從甲方處離職的,均應(yīng)依照《員工手冊(cè)》的相關(guān)規(guī)定的流程及要求履行離職通知及工作交接義務(wù)。11.3Whateverresignationreasons,PartyBshouldobeytheresignationprocedureandrequestofEmployeeHandbooktofulfilltheliabilityoftakingoverthework.12.賠償責(zé)任12.CompensationLiability12.1 甲方違反勞動(dòng)安全和勞動(dòng)保護(hù)的規(guī)定,以致發(fā)生事故,損害乙方利益的,應(yīng)賠償乙方實(shí)際受到的損失。12.1PartyAshallcompensatePartyBthedirectlossthatcausedbyaccidenceofPartyAbreachingtheregulationoflaborsecurityandprotection.12.2 如乙方違反其于本合同項(xiàng)下的知識(shí)產(chǎn)權(quán)、保密、其他任何義務(wù)而給甲方造成經(jīng)濟(jì)損失,乙方應(yīng)當(dāng)賠償甲方因此遭受的直接經(jīng)濟(jì)損失,雙方另有約定或國(guó)家另有規(guī)定的從其約定。12.2PartyBshouldcompensatePartyAthedirectlossforPartyBbreachingoftheliabilityoftheintellectualpropertyrights,confidentialinformationandothers.13.爭(zhēng)議解決13.LaborDisputeResolution13.1 本合同執(zhí)行中如發(fā)生糾紛,甲乙雙方應(yīng)協(xié)商解決,協(xié)商不成時(shí),可提請(qǐng)甲方所在地勞動(dòng)爭(zhēng)議仲裁委員會(huì)仲裁解決。對(duì)仲裁裁決不服的,可向有管轄權(quán)的人民法院提起訴訟。13.1WherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplytothelabordisputemediationcommitteeoftheirunitformediation.ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatpartymayapplytothelabordisputearbitrationcommitteeforarbitration14.其他規(guī)定14Others14.1 在雙方結(jié)束勞動(dòng)關(guān)系后,乙方同意甲方向乙方的新雇主發(fā)出關(guān)于乙方根據(jù)本合同應(yīng)有的相關(guān)權(quán)利和義務(wù)的通知。14.1AfterterminationoftheContract,PartyBagreesthatPartyAcansendthenewemployerthenoticeaboutPartyB’srelativerightsandliabilityunderthisContract.14.2 乙方同意竭盡全力遵守附件二《先前發(fā)明和原創(chuàng)作品透露表》、《知識(shí)產(chǎn)權(quán)聲明》及附件三《利益沖突指南》的規(guī)定。14.2PartyBagreestotryhis/herbesttoobeytheattachmenttwo(“thedisclosureofformerinventionandoriginalworks”,“IntellectualPropertyRightDisclaim”andattachmentthree(“ConflictofInterestGuideline”).14.3如果本合同中任何條款因違反法律或其他原因,可視為完全或部分無(wú)效,但不影響本合同的其余條款的法律約束力。如本合同所依據(jù)的法律或地方法規(guī)變更,雙方同意本合同中相關(guān)條款從其變更,同時(shí),如本合同的某些條款必須作出修改方可保持效力,則雙方須同意對(duì)該條款進(jìn)行最接近該條款愿意的修改。14.3IfanyoneormoreoftheprovisionscontainedinthisContractshallbeinvalid,illegal,orunenforceableinanyrespect,thesubjectprovision(s)shallbeenforcedtothemaximumextentpermissiblesoastoeffecttheintentoftheParties.Thevalidity,legalityandenforceabilityoftheremainingprovisionscontainedhereinshallnotinanywaybeaffectedorimpairedthereby.NoprovisionofthisContractshallbeamended,modified,waived,dischargedorterminatedotherthanbyexpresswrittenconsentofbothParties.NofailureordelaybyanyofthePartiesheretoinexercisinganyright,powerorprivilegeunderthisContractshalloperateasawaiverthereof.14.4 本合同的任何一方?jīng)]有行使或未能及時(shí)行使本合同項(xiàng)下的任何權(quán)利均不應(yīng)視為其放棄該權(quán)利,也不影響該方在將來(lái)行使該權(quán)利。14.4Partydoesnotexerciseordelayintheexerciseofitsright,powerorprivilegeunderthisagreementdoesnotconstituteawaiverofsuchright,powerorprivilege,andsingleorpartialexerciseofsuchright,powerorprivilegedidnotexcludeanyotherright,powerorprivilegeoftheexercise.14.5雙方簽署本合同前任何書(shū)面協(xié)議中的約定與本合同不一致的,視為雙方已經(jīng)做出新的約定,均以本合同為準(zhǔn)。14.5IntheeventofaconflictorinconsistencybetweenthetermsofthisLaborContractandthoseofanywrittenagreementfromonepartytotheother,thetermsofthisLaborContractshallbecontrolling.14.6本合同是乙方和甲方之間達(dá)成的關(guān)于本合同下所有內(nèi)容的全部的同意和諒解。本合同取代任何以前的,包括但不限于,在面試和關(guān)于重新安置工作地點(diǎn)時(shí)的所有書(shū)面和口頭的討論、聲明。除非經(jīng)甲方蓋章和乙方的書(shū)面簽字,本合同不得更改,本合同項(xiàng)下的權(quán)利也不會(huì)被放棄。任何今后關(guān)于乙方的職責(zé)、薪資和其他收益的變化均不會(huì)影響到本合同的有效性和他的范圍。14.6ThisLaborContractsetsouttheentireagreementandunderstandingbetweenthePartiesregardingallcontentscontainedhereinandsupersedesallpreviousdiscussion,arrangementsandunderstandings,writtenororal,betweenthePartiesregardingthisLaborContract.UnlessgettingPartyA’sstampandPartyB’swrittensignature,thisLaborContractcan’tberevisedandallrightsunderthisContractwillbenotwaived.AnychangewithPartyB’sresponsibility,salaryandotherallowancewillnotinfluencethevalidityandextentofthisLaborContract.14.7 本合同未盡事宜由雙方另行協(xié)商作出補(bǔ)充規(guī)定。補(bǔ)充規(guī)定與本合同具有同等法律效力。14.7BothPartiescannegotiatethesupplementingoodfaithabouttheothercontents;suchsupplementwillhavesameeffectivelywiththisLaborContract.14.8本合同期限屆滿前15天,若乙方未收到甲方任何關(guān)于續(xù)簽或終止勞動(dòng)合同的通知時(shí),則乙方有義務(wù)提醒甲方以上事宜,也可至甲方人力資源部及時(shí)詢問(wèn)。14.8IfPartyBdoesn’treceivethenoticeofextendingorterminatingthisLaborContractbefore15daysofthisLaborContractexpiration,PartyBhastheliabilitytoremindersuchcontenttoPartyBandcanconsulttherelativecontenttoHRdepartmentofPartyAintime.14.9
