第一章：總則

本法規定勞動安全衛生；關于勞動者的工傷事故、職業病的政策、制

度；國家管理部門與組織、個人對勞動安全衛生的權限與責任。

第二條：適用對象

3、不按勞動合同工作的勞動者。

4、按照勞動合同赴國外工作的越南籍勞動者；在越南工作的外籍勞

動者。

6、勞動安全衛生的技術事故隱患，是指機械、設備、物資受損超過

安全技術準許值，在勞動過程中造成缺失或者可能會危及勞動者的生命安

全、財產與環境受影響的要素。

術事故，事故涉及面廣，超出生產基層、機關、組織、地方或者有關多家

生產經營企業與地方的可控能力范圍。

任何部位受損傷或者死亡的事故。

9、職業病是指勞動者在有害的條件下工作，所引發的疾病。

10、勞動環境監測是指在工作地，對勞動環境各項要素進行測量、分

析、評估及收集活動，以降低影響身體健康的各項要素，所采取預防職業

病的措施。

第四條：國家對勞動安全衛生的政策。

1、在勞動過程中，為用人單位、勞動者、機關、組織、個人制造確

保執行各項勞動安全衛生的條件；在勞動過程中，鼓勵使用勞動者、勞動

者適用各項技術標準、先進與現代的管理系統，與符合環保的高科技工藝

技術。

第五條：勞動安全衛生的保障原則

第六條：勞動者勞動安全衛生的權利及義務

1、依照勞動合同工作的勞動者，有下列權利：

a)獲得勞動安全衛生工作平等條件的保障；要求使用勞動者在工作地

的勞動過程中，需有責任確保勞動安全衛生工作條件。

c)獲得執行勞動保護、身體保養、體檢與發現職業病的有關制度規

定；得到雇主繳納勞動工傷保險、職業病保險；關于工傷、職業病的受害

者，可充分享有制度；由于工傷、職業病造成的疾病、傷殘者，可享診

斷、鑒定費。獲得主動對勞動能力下降程度進行體檢、鑒定，并經鑒定結

果符合調整勞動工傷事故、職業病補貼的條件時，可享退換體檢與鑒定

費。

d)工傷、職業病經醫治穩固后，要求使用勞動者安排適合的工作。

d)明顯看出馬上發生嚴重威脅人身安全或者自己身體健康的勞動事故

隱患，而拒絕工作或者離開工作崗位，但仍足額發放工資而不視為已經違

反勞動紀律的。但需立即向直接管理人報告，以便采取處理措施；只能在

直接管理人員與負責勞動安全衛生工作的人員，已采取各項克服措施的情

況下，才能繼續工作。

e)依照法律規定進行投訴、控訴、申訴。

2.Ngirdilaodonglamviectheohopdonglaodongconghiavusauday:

2、依勞動合同工作的勞動者，有下列義務：

a)嚴格執行在工作地的規章制度、流程與采取各項勞動安全衛生工

作；遵守集體勞動協議、勞動合同中的勞動安全衛生條約；

b)Sudungvabaoquancacphuangtienbaovecanhandaduactrangcap;

b)使用與保管好發放給個人的勞保公用；工作地的保障勞動安全衛生

設備；

c)當發現勞動安全衛生技術事故、工傷事故或者職業病的隱患，應及

時向負責人報告；依照事故處理、應急方案或者使用勞動者或者職能機關

部門的指令，主動參與勞動事故、克服事故的搶救工作。

yeucaunghiemngatveantoan,vesinhlaodong;

b)獲取勞動安全衛生工作的宣傳、交易與同意信息權；在特種行業崗

位工作的，得到勞動安全衛生的培訓工作；

c)Thamgiavahuangbaohiemtainanlaodongtheohinhthiictunguyen

doChfnhphuquydinh.

c)享有由政府規定的自愿參與工傷事故保險形式。

依照社會經濟進展條件、不一致時期的國家財政的能力，政府將具體

規定，以自愿繳納勞動工傷保險形式的繳納扶持金；

d)依照法律規定進行投訴、控訴、申訴。

4、不依照勞動合同工作的勞動者，有下列義務：

a)依照法律規定，對自己執行的工作承擔其勞動安全衛生責任；

b)在勞動過程中，確保對有關人員的勞動安全衛生工作；

c)對造成勞動安全衛生隱患的行為，應通知地方政府，與時采取制止

措施。

7、在越南工作的外籍勞動者，如同本第二條第1、2款關于勞動者的

規定，同樣有勞動安全衛生的權利與義務；另參加工傷保險、職業病保

險，則依照政府規定執行。

第七條：使用勞動者的勞動安全衛生權利與義務

1.Ngirdisirdunglaodongcdquyensauday:

1、使用勞動者有下列權利：

a)Yeucaungucxilaodongphaichaphanhcacnoiquy,quytrinh,bienphap

baodamantoan,vesinhlaodongtainailamviec;

a)要求勞動者遵守工作地的勞動安全衛生規章制度、流程與各項保障

勞動安全衛生措施；

b)Khenthu6ngnguailaodongchaphanhtotvakyluatnguailaodongvi

phamtrongviecthuchienantoan,vesinhlaodong;

b)對遵守勞動安全衛生紀律的勞動者給予獎勵，違反勞動安全衛生紀

律者給予紀律處分；

c)Khieunai,tocaohoackhaikientheoquydinhcuaphapluat;

c)依照法律規定進行起訴、申訴與控訴；

d)Huydongnguailaodongthamgialingciiukhancap,khacphucsuco,

tainanlaodong.

d)動員勞動者響應并參與搶救、事故克服、勞動事故的工作；

2、使用勞動者有下列義務：

a)在確保工作地的勞動安全衛生工作中，制定、組織實施與主動配合

機關、各組織，執行屬于自己對勞動者與有關人員的責任；為勞動者繳納

工傷事故保險與職業病保險；

phapbaodamantoan,vesinhlaodong;trangbidayduphucrngtien,congcu

laodongbaodamantoan,vesinhlaodong;thuchienviecchamsocsuekhde,

b)組織進行確保勞動安全衛生、規章制度、流程的指引與培訓工作；

配備齊全勞動安全衛生保障工作的公用具。執行保健、職業病的檢查工

作；全面為勞動者執行勞動工傷事故保險、職業病保險；

c)不能強迫勞動者繼續或者返回有勞動安全隱患危機，直接威脅人身

安全與身體健康的崗位工作。

d)依照法律規定，派人到工作地進行勞動安全衛生保障工作的規章、

制度、各項措施落實情況進行監督、檢查工作。

執行專業勞動安全衛生稽查部門的決定；

第九條：工會組織在勞動安全衛生工作中的權責

1、參與國家機關進行勞動安全衛生的政策法規制定工作。向權利機

關提出有關勞動者的勞動安全衛生工作，政策法規的補充修訂事宜。

2、參加并配合國家機關就勞動者有關勞動安全衛生權利的政策法規

執行情況，進行監督檢查與稽查工作；參與勞動安全衛生保障工作的規章

制度、計劃的監督執行與指導工作，與改善勞動者工作地的工作條件。依

照法律規定，參與勞動事故的調查工作。

第十條：基層工會在勞動安全衛生工作中的權責

8、依照本法第三十五條第一款規定，參與基層勞動事故的調查工

作；配合并參與使用勞動者的急救、克服技術事故隱患、勞動事故的工

作；若使用勞動者未依照本法第三十四條規定，履行申報義務，則基層工

會有責任立即向國家管理機關通知，以便依照本法第三十五條規定進行調

查工作。

第十二條：嚴禁違反行為

照勞動安全衛生的要求，采取各項安全措施，造成損壞或者危及人身、財

產、環保的安全的；當馬上發生安全事故，嚴重威脅人身安全、身體健

康，在安全隱患未解除前，強迫勞動者繼續工作或者不能離開工作崗位

的。

違反使用與開發工傷事故、職業病保險儲備數據資料。
