12,cityplanningapproachtomakePeople'sRepublicofChinaMinistryofConstructionNo.1462005-12-31剛柔并濟——對北京街區層面控規的認識與思考摘要文章通過對傳統的控制性詳細規劃進行分析,指出規劃成果難以轉化為規劃管理的公共政策、面對市場變化缺乏應變能力、無法直接與宏觀規劃銜接等問題。繼而通過對北京市近年來提出的街區層面的控規的案例解讀、介紹和分析,研究編制街區層面(2-3平方公里的單元)的控規在應對傳統控規經常會遇到的問題時所具備的優勢和靈活性,特別突出它能夠為規劃管理部門提供一個新的管理和協調的工具、并能較為靈活的應對復雜多元的市場變化、保障政府公共服務職能的特點。最后提出將來還需要對街區層面的控規的法律地位、規劃管理應用手段、傳統空間要素的控制和引導等方面進行深入的研究與探討。關鍵詞街區控規控制性詳細規劃規劃的剛性與彈性1.傳統控規編制中面臨的現實問題傳統的控制性詳細規劃,自上世紀90年代出現至今,一直處在各方面利益的博弈和平衡的困擾之中。問題的焦點,主要集中在如何協調規劃管理所需要的剛性控制和應對市場的彈性應變能力上:1.1傳統的控規無法充分體現政府職能轉變傳統的控規一般只能直接反映地塊的性質和開發建設強度,以及體現城市空間環境的協調和統一,關注的核心是空間和視覺上的美學效果,規劃師通過一系列的指標來確定對用地的空間形態的控制。這種形式適合在全能型政府的指導下,實現“全市一盤棋”式的開發和建設。而隨著改革的深入進行,政府職能由計劃經濟體制下的全能型向服務型轉化,政府的職能著重于政府管制和提供公共服務兩方面:一是要應對社會活動中產生的各種問題,維護社會功能的穩定和秩序;二是要提供社會發展所必需的公共產品,特別是市場無力或者不愿意提供的公共產品。在城市建設方面,越來越多的房地產企業和工業企業成為城市開發建設的主體,越來越具有話語權,這時的政府需要放出一定的權限以便市場機制發揮作用,同時又要能夠實現保持社會功能穩定、保障公共產品供給,需要體現出政府所代表的公共利益的最大化,這已經不是原有的以空間為主的控規內容所能反映的。1.2傳統的控規成果向公共政策轉化還有相當的差距城市規劃作為一項公共政策,在總體規劃確定了城鄉空間布局、對城市的公共資源進行了有效配置、對人居環境做出了相應的要求以后,需要進一步對各項城市建設進行全面的協調、引導和約束,并提供給城市規劃的管理部門一個管理工具。而傳統的控規雖然編制了整套的控制指標及措施,但是由于它的成果以就事論事式的地塊控制圖則的形式提供,始終缺少總體平衡的環節以及應對市場變化的靈活性。常見的現象是:對于近期馬上要投入建設的用地,在復雜多變的市場形勢面前,經常要提出變更用地性質、提高容積率和高度、調整布局等要求,這時的規劃管理部門,一般只能選擇在傳統的控規成果之外,通過對于地塊的有關條件的論證,增加一個規劃條件變更的論證與審核的環節,從審核的結果來看,由于在規劃中缺乏足夠的限制性條件的約束,許多提高容積率、高度的規劃控制條件調整申請只能“順利”通過。很多規劃管理部門都遇到過類似的尷尬:開發商提出來要將控規確定的某一地塊容積率從1.5調整到1.8,無論是從規劃技術上還是從管理政策上,找不到可以否定這個申請的理由,而如果將這些單獨地塊的神情全部通過的話,控規從整體上就相當于白做了,正所謂“沒有空歸管理不好,有了控規不好管理”。1.3在多變的市場需求面前顯得過于僵化根據總規進行全覆蓋編制的控規,面對遠期沒有確定開發主體和開發模式的城市新區,只能依靠經驗和有限的規范要求進行設定一個終極藍圖,經常需要假定該區會吸引什么性質的產業、采用何種交通和居住模式等等要素。往往等到了需要實施的時候,城市建設機制已經發生了非常多的轉變,投資的主體、開發模式、區域的建設和運營機制等都與原來的規劃設想不一致,產業、交通、居住的模式都已經超出來原來的設想,這時候早已完成的控規就會變得非常的不合時宜。1.4面對上位規劃的宏觀要求難以對接總體規劃為了滿足城鄉經濟社會全面、協調和可持續發展的要求,往往會提出一些宏觀措施,如開發模式等內容。這些帶有公共政策屬性的措施,在以地塊為目的的傳統控規中難以充分反映和對接。以北京市大興新城為例:按照《北京城市總體規劃(2004年-2020年)》,大興新城是北京未來面向區域發展的重要節點,在北京發展中具有極其重要的戰略地位,將引導發展生物醫藥等現代制造業,以及商業物流、文化教育等功能,是將來承載北京中心城疏解的人口和職能的11個新城之一。2020年大興新城規劃用地規模65平方公里,人口規模60萬人。此前,大興是作為北京的縣城、衛星城來進行建設,現狀條件與新城的規劃目標之間有較大差距,缺乏足夠的吸引力,不能有效緩解市區壓力。比如:公共設施缺乏、已有設施標準過低、與中心城交通聯系不暢等問題。如何完成由現狀向新城藍圖的轉變?在《大興新城規劃(2005年-2020年)》中,從新城的建設實施過程入手,確定了通過軌道交通建設、城市道路建設、公共服務設施建設、行政功能轉移、文教功能引入、主導產業引入等六項要素為主,對新城建設進行引導:這些要素共同發揮作用,并依據它們的空間影響范圍和特征進行合理的時序上的安排,推動新城的建設發展,使新城的規劃藍圖能夠在現狀的基礎上逐步得以實現。面對上位規劃提出的類似的宏觀規劃要求,顯然不是一個個具體地塊的圖則能夠充分反映出來的,更談不上去應對在長達15年的規劃實施過程中各種要素的變化了。2.街區層面的控規的編制內容形式近年來,北京市提出編制街區層面的控規,從一定程度上應對了傳統地塊控規中普遍存在的問題。以大興新城的街區控規為例:首先劃分街區。在《大興新城規劃(2005年-2020年)》所劃分的七片區、三組團的基礎上,綜合考慮區位特征、公共服務設施布局、市政交通設施服務能力及空間環境容量等各種影響因素,以街坊(介于街區和地塊單元之間,以河流、自然障礙物、主次干道、街道辦事處界限、特殊功能區邊界等為街坊劃分的界線)為劃分單元,劃分為38個街區,每個街區2~3平方公里。接著,在新城范圍內整體確定街區的主導功能、建設總量和分類建設規模、建設基準高度、建設強度范圍等要素。依據新城規劃,分解落實每個街區的主導功能,即街區的
