方負(fù)責(zé)操作與維護(hù)。本合同約定的操作維護(hù)方應(yīng)當(dāng)按照機(jī)械運(yùn)營(yíng)、操作規(guī)定配備符合國(guó)家或地方法律法規(guī)規(guī)定上崗條件的操作、指揮、維護(hù)等人員，也可委托具備相應(yīng)資質(zhì)的專業(yè)公司承擔(dān)機(jī)械的操作與維護(hù)，受托方行為視為該委托方行為。1.Thepartiesagreethatthepartyshall,inaccordancewiththeregulationsofthemachinery’soperationandoperation,beresponsiblefortheoperationandmaintenanceofthemachinery.Thepartyforoperatingandmaintenance,asspecifiedinthiscontract,shallbestaffedwiththepersonnelofoperation,commandandmaintenancewhichconformingtothestateorlocallawsandregulations,ormayentrusttheoperationandmaintenanceofthemachinerytotheprofessionalcompanieswithcorrespondingqualifications,andtheactoftheentrustedpartyshallbedeemedastheactofsuchentrustingparty.2.因故障造成機(jī)械無(wú)法正常作業(yè)的，乙方應(yīng)當(dāng)自接到通知時(shí)起

小時(shí)內(nèi)到達(dá)現(xiàn)場(chǎng)維修。乙方自接到維修通知起小時(shí)/日內(nèi)未能修復(fù)的，自第日起免收租金直至機(jī)械恢復(fù)正常作業(yè)日止。但機(jī)械故障系因甲方違章指揮、違章作業(yè)造成的，甲方仍應(yīng)支付停工期間的租金。2.Wherefailureofthemachine’snormaloperationduetoitsfault,PartyBshall,uponreceiptofnotice,beatthesiteforrepairwithinhours.Wherethemachineisnotrepairedwithinhours/days,therentalfeewill,fromthedateofreceiptoftherepairnotice,untilthemachineresumesnormaloperation.However,ifthemachinerybreakdowniscausedbyPartyA'sviolationofrulesandregulations,PartyAshallstilleffectpaymentoftherentfortheperiodofsuspension.3.雙方約定每月
