聘〔雇〕用契約書

_________〔以下簡稱甲方〕為應業務需要,聘〔雇〕用_________先生〔女士〕〔以下簡稱乙方〕為約聘〔雇〕人員,雙方訂立契約條款如下:

一、聘〔雇〕用期間:自_________年_________月_________日起至_________年_________月_________日止。

二、聘〔雇〕用報酬:甲方按月支給乙方報酬_________薪點〔_________元〕。

三、工作內容〔詳細敘明〕:_________。

四、受聘〔雇〕責任:

乙方受聘〔雇〕后須確保甲方公務機密,有保密期限者從其規定,無保密期限者自離任日起_________年為限〔解聘〔雇〕者亦同〕。乙方不得有不法行為或違犯約定義務,如有違犯者,除涉及民、刑事責任,由甲方依法追究外,并得隨時解聘〔雇〕。

在聘〔雇〕用期間,乙方愿承受與甲方約定之工作上的指派調遣,并遵守此工作上之相關規定。假設乙方違犯上述相關規定確屬情節重大,甲方得隨時終止契約;甲、乙雙方如因特別事故須提早終止契約時,應于一個月前提出預告,經甲、乙雙方協議后乙方始得離任。乙方離任時,應先按照規定辦妥離任手續。如有損害公物,或侵權情事〔或違背甲方智能財產權規定〕,應負責賠償。

五、乙方在受聘〔雇〕用期間,除應遵守甲方一切行政法規之規定外,其假期、離任儲金給與、勞工保險及全民健保等,依左列約定:

假期核給:依_________辦理。

離任儲金之扣繳及給與依_________規定辦理,按月扣繳儲存生息,并于離任時依規定發給。

按乙方每月支報酬之百分之_________提存儲金,其中百分之_________由乙方于每月報酬中扣繳作為自提儲金,另百分之_________由甲方提撥作為公提儲金,并由甲方在金融機構開立專戶儲存孳息,列帳管理。

乙方因契約期滿離任、或經甲方同意于契約期限屆滿前離任、或在職因公、因病或意外死亡者,發給公、自提儲金本息。

乙方因違背契約所定義務而經甲方予以解聘,或未經甲方同意而于契約期限屆滿前離任者,僅發給自提儲金之本息。

其余未盡事宜請參考_________有關規定。

乙方受聘〔雇〕用期間,甲方應善盡投保勞工保險及全民安康保險之義務。

六、乙方于受聘〔雇〕期間之著作或工作成果,如系于甲方企劃下,或法定工作期間完成者,其所有權歸屬甲方。因前開著作或工作成果所生之智能財產權,應依本院之相關規定辦理。

七、本契約期間屆滿當然失效,如因業務需要須續聘時,另行簽訂新契約。

八、本契約未訂定事項,悉依?聘用人員聘用條例?及_________相關規定辦理。

九、本契約以中文本為準。如中、英文二本互相歧異或抵觸時,以中文本為準。

十、本契約法律糾紛以_________法院為第一審管轄法院。

Whereas,AiswillingtoofferBemployment,andBiswillingtoacceptsuchemploymentsubjecttothefollowingtermsandconditions:

1.TermofEmployment

Thepartiesagreethatthetermofthisagreementshallbemencingfromthis_________dayof_________,_________tothe_________dayof_________,_________.

2.Remuneration

B'sdutiesshallinclude_________.

4.B'sObligationsandTermination

4.1BshallhandleinaconfidentialmannerallmattersrelatingtoA'sbusiness.Thisconfidentialityobligationshallremaineffectiveduringtheperiodspecifiedintheregulationsorworkingrulesconcerned.Incasethatnotimeperiodisspecified,itremainseffectiveforsuccessive_________years'termsafterB'sterminationofthisemployment.IntheeventthatBviolatesanylaworregulation,orbreachesthisAgreementorworkingrulesconcerned,AmayinitsdiscretionreprimandBorterminatethisAgreement.AalsoreservestherighttoinstitutesuitagainstBforcivilpensationortoimposecriminalliability.

4.2DuringthetermofthisAgreement,Bshallplywiththedirectionsandinstructionsofhis/hersupervisors,performhis/herdutiesinaccordancewithallregulationsandrelevantworkingrules.WhereBviolatesanyobligationspecifiedinthisparagraphandthecaseisconsideredtobeseriousinnature,AmayinitsdiscretionterminatethisAgreement.IfatanytimethepartiesintendtoterminatethisAgreementduetocausesbeyondthereasonablecontrolofsuchparty,eithershallgivethirty

(30)days'noticeofcancellationtotheotherpartypriortotheintendedterminationdate.Bshallvacatehis/herofficeunderandpursuanttothestipulationsagreeduponbybothparties.Bshallsubmittotheproceedingsinprescribedmannerastobevacatedofhis/heroffice.IncaseofanyoneofthefollowingconditionswhichisduetoB'sfault,Bshallberesponsibleforpensation:

(1)WhereBinflictsdamagetoorexcessivelyabusesmachinery,equipment,tools,rawmaterials,productsorotherarticlebelongingtoAcademiaSinica;

(2)WhereBmitstorts;

(3)WhereBviolatesA'sownershipofintellectualpropertyrights.

5.1"Absenceonleave"shallbeoperatedpursuantto"RegulationofAbsenceonleaveforPersonnelservedinallExecutiveYuanorganizationsunderCivilContractualRelationship".

5.2Thedeductionandgrantof"pay-as-you-go"contributionbenefitshallbeoperatedpursuantto"Regulationof'pay-as-you-go'contributionbenefitforPersonnelservedinallorganizationsandschoolsunderCivilContractualRelationship".Certainamountofsalaryshallbedeductedpermonthandaccrueonthefinancialinstituteoverthetermofthisemployment.

5.2.1Anamountequaltosevenpercent(7﹪)ofthemonthlysalaryshallbecontributed.Fiftypercent(50﹪)ofthecontributionshallbedrawnfromB'smonthlysalary.(hereinaftercalled"personalcontributionbenefit")Ashallprovidetheotherfiftypercent(50﹪)ofthecontribution(hereinaftercalled"publiccontributionbenefit"),andshallopenaspecialaccountonfinancialinstituteastoaccumulateandmanagethiscontribution(personalpluspublic).

5.2.2Thetotalamountofthecontributionbenefits(personalpluspublic)shallbegrantedtoB,ifatanytime(a)BleavestheofficeontheexpiryofthisAgreement,(b)BvacatestheofficepriortotheexpirationdatewiththeconsentofA,and(c)Bdeceasesduetoundertakingofduty,illnessoraccident.

5.2.3TheamountofpersonalcontributionbenefitsaccumulatedshallbegrantedtoB,ifatanytime(a)AterminatesthisAgreementinasmuchasBbreachesanyobligation,and(b)BresignsfromtheofficepriortotheexpirationdatewithouttheconsentofA.

5.2.4AnymatteroreventnotprovidedinthecontextofthisArticleshallbeoperatedpursuantto"Regulationof'pay-as-you-go'contributionbenefitforPersonnelservedinallorganizationsandschoolsunderCivilContractualRelationship"andrelevantregulations.

5.3DuringthetermofthisAgreement,AshallinsureBsubjecttothetermsandconditionspursuanttolaborinsuranceregulationsandnationalhealthinsuranceregulations.

6.BothpartiesagreethatAshallownproprietaryrightpertainingtotheliteraryworksorachievementspletedbyBundertheprojectsinitiatedorcoordinatedbyAduringthetermofthisAgreement.Theownershipofintellectualpropertyrights(includingbutnotlimitedtocertainpatents,trademarks,copyrights,technicalinformationandknow-how)accruedfromtheliteraryworksorachievementshereincontainedissubjecttotherelevantregulationsandrulesprovidedbyA.

7.Expiration

Attheexpirationofthetermofthisagreement,theemploymentrelationshipshallautomaticallyterminatewithoutanycondition.Anewemploymentagreementshallbesignedfortherenewalandcontinuanceofsuchrelationship,ifagreedtoanybybothparties.

8.AnymatteroreventnotprovidedinthecontextofthisAgreementshallbegovernedbyandinterpretedinaccordancewith"EmploymentRegulationforPersonnelunderCivilContractualRelationship"(stipulatedbyAcademiaSinica)"EmploymentRegulationforPersonnelservedinallExecutiveYuanorganizationsunderCivilContractualRelationship".

9.GoverningLanguage

TheChinesetextofthisAgreementshallbedeemedtheoriginal.IntheeventofanydisputeormisunderstandingastotheinterpretationofthelanguageortermsofthisAgreement,theChineselanguage
