PartyAshallintroducetoPartyBthelaws,decreesandrelevantregulationsenactedbytheChinesegovernment,thePartyA'worksystemandregulationsconcerningadministrationofforeignexperts./r/n/r/n甲方有義務向乙方介紹甲方所在當地的相關法律、法規以及甲方工作機制、規程、規定以及與外國專家管理相關的規章制度。/r/n2.

PartyAshallconductdirection,supervisionandevaluationofPartyB'swork./r/n/r/n甲方對乙方的工作負責指導、監督以及評價。/r/n3.

PartyAshallprovidePartyBwithnecessaryworkingandlivingconditions./r/n甲方必須向乙方提供乙方工作和生活必需的條件和設施。/r/n4.

PartyB'sobligations/r/n乙方義務：/r/n1.

PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterferein/r/nChina/r/n'sinternalaffairs./r/n乙方必須遵守中國的法律、法規和將關規定，不干涉中國內政。/r/n2.

PartyBshallobservePartyA'sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA'sarrangement,direction,supervisionandevaluationinregardtohis/herwork.WithoutPartyA'sconsent,PartyBshallnotrenderserviceelsewhereorholdconcurrentlyanypostunrelatedtotheworkagreedonwithPartyA./r/n乙方必需遵守甲方的工作制度及與外國專家管理相關的規定，并接受甲方在工作方面的安排、指導、監督和評價。未經甲方批準，乙方不得從事任何兼職工作。/r/n3.

PartyBshallcompletethetasksagreedonscheduleandguaranteethequalityofwork./r/n/r/n乙方必須按照計劃保質保量完成甲方委派的工作。/r/n4.

PartyBshallrespect/r/nChina/r/n'sreligiouspolicy,andshallnotconductreligiousactivitiesincompatiblewiththestatusofanexpert./r/n/r/n乙方必須遵守中國的宗教政策，不允許從事與外籍專家身份不符的宗教活動。/r/n5.

PartyBshallrespecttheChinesepeople'smoralstandardsandcustoms./r/n乙方必須尊重中國人民的道德規范和風俗習慣。/r/n6.

IfPartyBhasanycontagiousorseriousdiseases,orifPartyBisfemaleinpregnancy,childbirthorbabynursingperiod,PartyBhasthedutytoinformPartyAbeforethecontractissignedsothatPartyAcanprovidespecialcaretoPartyB.Otherwise,PartyAwillnotbearanyrelatedresponsibilities./r/n/r/n乙方如有嚴重疾病或傳染性疾病、或者女性有懷孕、待產、哺乳等情況，必須在簽訂合同之前，向甲方如實聲明，否則造成后果由乙方承擔全部責任。/r/nVII.

Revision,CancellationandTerminationoftheContract/r/n合同的修改、取消和終止：/r/n1.

Bothpartiesshouldabidebythecontractandshouldrefrainfromrevising,canceling,orterminatingthecontractwithoutmutualconsent(exceptthatmentionedinVI,6)./r/n/r/n雙方必須嚴格遵守合同中所規定的內容。不經雙方同意，不得擅自單方修改、取消或者終止合同。但本合同第VI條第六款所規定的情況除外。/r/n2.

Thecontractcanberevised,canceled,orterminatedwithmutualconsent.Beforebothpartieshavereachedanagreement,thecontractshouldbestrictlyobserved./r/n/r/n在雙方同意的情況下，可以對合同進行修改、取消或者終止。但在此之前，必須嚴格遵守合同。/r/n3.

PartyAhastherighttocancelthecontractwithawrittennoticetoPartyBunderthefollowingconditions;/r/n/r/n在以下情況下，甲方有權以書面形式通知乙方終止合同：/r/n(1)

PartyBdoesnotfulfillthecontractordoesnotfulfillthecontractobligationsaccordingtothetermsstipulated,andhasfailedtoamendafterPartyAhaspointeditout./r/n/r/n乙方沒有完成合同中所規定的內容，或者經甲方提醒仍沒有履行合同中所規定的義務。/r/n(2)

Accordingtothedoctor'sdiagnosis,PartyBcannotresumenormalworkafteracontinued30daysickleave./r/n/r/n經醫生診斷，乙方在連續30日病假后仍不能恢復正常工作。/r/n4.

PartyBhastherighttocancelthecontractwithawrittennoticetopartyAunderthefollowingconditions:/r/n/r/n在以下情況下，乙方有權以書面形式通知甲方終止合同：/r/n(1)

PartyAhasnotprovidedPartyBwithnecessaryworkingandlivingconditionsasstipulatedinthecontract./r/n/r/n甲方沒有按照規定為乙方提供工作和生活所需條件和設備。/r/n(2)

PartyAhasnotpaidPartyBasscheduled./r/n/r/n甲方沒有按期向乙方發放勞務報酬。/r/nVIII.

BreachPenalty/r/n違約金/r/nWheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthecontractobligationsaccordingtothetermsstipulated,thatis,breaksthecontract,itmustpayabreachpenaltyof/r/n￥50000RMB/r/n./r/n/r/n任何一方不能按照合同中所規定內容執行，都將視為違約。違約方應承擔/r/n￥50000元/r/n人民幣/r/n的違約金。/r/nIfPartyBaskstocancelthecontractduetoeventsbeyondcontrol,itshouldproducecertificationsbythedepartmentconcerned,obtainPartyA'sconsent,andpayitsownreturnexpenses;IfPartyBcancelsthecontractwithoutvalidreason,itshouldpayitsownreturnexpensesandpaybreachpenaltytoPartyA.IfPartyAaskstocancelthecontractduetoeventsbeyondcontrol,withtheconsentofPartyB,itshouldpayPartyB'sreturnexpenses;ifPartyAcancelsthecontractwithoutvalidreason,itshouldpayPartyB'sreturnexpensesandpayabreachpenaltytoPartyB./r/n/r/n如果因不可抗原因乙方請求終止合同，須出示有關部門開具的證明材料，經甲方批準，自費返程路費。如果沒有正當理由乙方擅自終止合同，乙方應自費返程路費，并承擔違約責任。如果甲方因不可抗原因結束合同，經乙方同意后，應由甲方負責提供乙方返程路費。如甲方沒有正當理由擅自終止合同，應負責向乙方提供返程路費，并承擔違約責任。/r/nIX.

Theappendixofthiscontractisaninseparablepartofth/r/necontractandhasequaleffect/r/n本合同附件與合同正文具有同等法律效力。/r/nX.

Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty/r/n2weeks/r/npriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.PartyBshallbearallexpensesincurredwhenstayingonafterthecontractexpires./r/n/r/n本合同自簽訂之日起生效，到合同期滿自然終止。如其中任何一方有意延期，必須在合同期滿/r/n2周/r/n前向對方提出，在雙方同意下簽訂續約。合同期滿后，乙方負責之后的所有滯留費用。/r/nArbitration/r/n仲裁/r/nThetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtothelocalcourt./r/n/r/n有關合同內容的含義，須雙方及時互相溝通，及時處理其中可能存在的爭議。如果經雙方協商不能達成一致，可申請可向甲方所在地法院起訴。/r/n

1.Theworktimeoftheemployedpartyshallbe/r/n40hours/r/nevery/r/nweek(two-dayweekend)/r/nIftheworktimecannotreachtheabove-mentionedamount,PartyAcanarrangeforPartyBsomeotherconcernedworkoractivities,/r/n/r/notherwise,theemployedpartyshouldbepaidashavingreachedit./r/n受雇方每/r/n周/r/n工作量為/r/n40小/r/n時/r/n（/r/n周末雙休/r/n）。如果受雇方不能達到以上工作量，雇用方可根據需要安排受雇方其他工作作為補充。如果因雇用方原因致使受雇方不能達到要求所需工作量，則視為乙方已經滿足工作量。/r/n2.Iftheemployingpartyarrangesovertimeworkforthepartyemployed,itwillpaytheemployedpartyasalaryhigherthanthatnormalworktimeaccordingtolegalstandard.Theexactpaymentshouldbenegotiatedbetweenthetwoparties./r/n如果雇用方安排受雇方從事工作量以外的工作，應付給雇用方額外工資。額外數額由雙方協商。/r/n

NewYear'sDay,SpringFestival,MayDay,NationalDayandotherholidaysstip/r/nulatedbylawsandregulations./r/n/r/n受雇方在中國享有以下假期和假日：/r/n元旦，春節，“五·一”勞動節，國慶節以及法律、法規中所規定的其他節日。/r/nⅣ/r/nSickleaveandprivateaffairsleave/r/n病假和個人事假/r/n

1.Certificatefromdoctorsforforeignersappointedbythehostinstitutionshouldbepresentedwhentheemployedpartyasksforsickleave./r/n受雇方請病假應持有雇用方指定的醫療機構開具的醫療證明。/r/n2.Privateaffairsleaveoftheemployedpartyshallbeapprovedbytheemployingparty.Theemployingpartywilldeductthesalarybyday.Inthecontractterm,theprivateaffairsleavesshouldnotexceed10days.Thecontinuousprivateaffairsleaveshallbenomorethan3days,andtwodays'salarywillbedeductedforeachdaythereafter./r/n/r/n雇用方應準許受雇方請個人事假。期間工資按照天數扣除。在合同期內不超過10天。單次事假原則上不能超過3天，超過3天后每天扣除2天的工資。/r/n
