上海巿房屋租賃協議上海市房屋土地資源管理局上海市工商行政管理局 制訂二04月印制WhilealltermsandconditionsshallbebasedontheChineseversionofTenancyAgreement,thisEnglishversionshallbeforreferenceonly.上海房屋租賃協議SHANGHAIMUNICIPALITY(協議編號: )(ContractNo._________)本協議雙方當事人:PartiestoContract(出租)出租人(甲方) :Lessor(PartyA) :承租方(乙方) :Lessee(PartyB) :依據《中國協議法》、《上海市房屋租賃條例》(以下簡稱:《條例》)要求,甲、乙雙方在平等、自愿、公平和老實信用基礎上,經協商一致,就乙方承租甲方可依出租(出租)商品房(房屋/商品房)事宜,簽訂本協議。InaccordancewiththeLawsofContractofthePeople’sRepublicofChinaandtheTenancyRegulationsoftheShanghaiMunicipality(hereinafterreferredtoas“theProvisions”),PartyAandPartyB,havingreachedanagreementbasedontheprinciplesofequality,willingnessandmutualbenefit,herebyenterintothisContractonmattersinrelationtotheLeaseofthePropertybyPartyAtoPartyB.一、出租房屋情況ConditionoftheLeaseorPre-LeaseProperty1-1甲方出租(出租)給乙方房屋座落在本市 (區/縣)路號(弄/新村)(號/幢)室(部位)(以下簡稱該房屋)。該房屋實測(【出租】實測)建筑面積為平方米,房屋用途住宅,房屋結構為鋼混 。甲方已向乙方出示:PartyAshallleasePartyBthePropertysituatedat,,(hereinafterreferredtoas“theProperty”).ThetotalgrossareaoftheLeasePropertyshallbe_________squaremeters,thepurposeoftheLandshallbeforConsolidatedPurpose,thetypeofPropertyshallbeResidentialBuilding,thestructureshallbe.ThefloorplanofthePropertyseeAppendix1ofthisContract.PartyAhasalreadypresentedtoPartyB:

1)【出租】房地產權證/房屋全部權證/滬房地產權證市字;(證書編號:號。[Lease]ShanghaiCertificateofOwnershipoftheProperty(CertificateNo. ).1-2甲方作為該房屋房地產權利人 (房地產權利人/代管人/法律要求其她權利人)與乙方建立租賃關系。簽署本協議前,甲方已通知乙方該房屋(已/未)設定抵押。PartyAbeingtheOwnerofthePropertyandPartyBhavedevelopedalessor/lesseerelationship.BeforethesigningofthisContract,PartyAhasalreadyinformedPartyBthatthePropertysubjecttoamortgage.1-3該房屋公用或適用部位使用范圍、條件和要求;現有裝修、隸屬設施、設備情況和甲方同意乙方自行裝修和增設隸屬設施內容、標準及需約定相關事宜,由甲、乙雙方分別在本協議附件(二)、(三)中加以列明。甲、乙雙方同意該附件作為甲方向乙方交付該房屋和本協議終止時乙方向甲方返還該房屋驗收依據。TheareaandtheuseofthepublicorcommonpartoftheProperty;theexistingfixtures,facilities,conditionofequipmentandthecontents,standardandotherrelevantmatterstobeascertainedinrelationtothefixturesandthefacilitiesaddedbyPartyBwiththeconsentofPartyAshallbespecifiedinAppendix2,3ofthisContract.PartyAandPartyBhaveagreedthesaidAppendixshallrepresenttheconditionofthePropertyatthetimeofhandoverofthePropertybyPartyAtoPartyBandwhenPartyBdeliverupthePropertytoPartyAattheexpiryofthisContract.二、租賃用途PurposeoftheProperty2-1乙方向甲方承諾,租賃該房屋作為住宅使用,并遵守國家和本市相關房屋使用和物業管理要求。PartyBwarrantstoPartyAthatthePropertyshallbeusedforResidentialpurposeandfollowstheregulationsoftheStateandthisMunicipalityinrelationtotheuseandmanagementofProperty.2-2乙方確保,在租賃期內未取得甲方書面同意以及按要求須經相關部門審批核準前,不私自改變上款約定使用用途。PartyBguaranteethatduringtheleaseterm,itshallnotalterthepurposeofthePropertywithoutPartyA‘spriorwrittenconsentaswellastheapprovalfromtherelevantgovernmentaldepartment.三、交付日期和租賃期限DeliveryDateandLeaseTerm3-1甲乙雙方約定,甲方于年月日向乙方交付該房屋。【出租】房屋租賃期自年月日起至年月日止。

PartyAandPartyBhaveagreedthatPartyAshallhandoverthePropertytoPartyBbefore.[Lease] TheleasetermofthePropertyshallbefromuntil .3-2租賃期滿,甲方有權收回該房屋,乙方應準期返還。乙方需繼續承租房屋,則應于租賃期屆滿前 2個月,向甲方提出續租書面要求,經甲方同意后重新簽署租賃協議。Uponexpiryoftheleaseterm,PartyAshallhavetherighttorepossessthePropertyinitsentiretyandPartyBshalldeliveritupaccordingly.IfPartyBwishestorenewthelease,itshallsubmitsuchintentinwritingtoPartyAtwomonthspriortotheexpiryoftheleaseandsignanewleasecontractwiththeconsentofPartyA.四、租金、支付方法和期限Rent,MethodofPaymentandTerm4-1甲、乙雙方約定,【出租】月租金人民幣()(大寫:)。該房屋租金(年)內不變。自第(年)起,雙方可協商對租金進行調整。相關調整事宜由甲、乙雙方在補充條款中約定。PartyAandPartyBhaveagreedthat.[Lease]ThetotalmonthlyrentshallbeRMBYuan.Therentshallremainunchangedforyear.Therentmaybeadjustedbybothpartiesthroughconsultationcommencingfromyear.MattersrelatedtotheadjustmentshallbeagreedbyPartyAandPartyBinsupplementaryclauses.4-2乙方應于每個月 日前向甲方支付租金。逾期支付,每逾期一日,則乙方需按日租金 %支付違約金。PartyBshallpaytherentbytheofeachmonth.LatepaymentbyPartyBshallbesubjecttoapenaltyof%ofthemonthlyrentperday.4-3乙方支付租金方法以下:TherentshallbepaidbyPartyBasfollows:----------------------------------------------------------------------------------------------------------------五、確保金和其她費用DepositandOtherFeesandCharges5-1甲、乙雙方約定,甲方交付該房屋時,乙方應向甲方支付房屋租賃確保金,確保金為貳個月租金,即(人民幣貳萬貳仟元整)。甲方收取確保金后應向乙方開具收款憑證。租賃關系終止時,甲方收取房屋租賃確保金除用以抵充協議約定由乙方負擔費用外,剩下部分一周內無息歸還乙方。PartyAandPartyBhaveagreedthatatthetimeofthehandoverofthePropertybyPartyA,PartyBshallpaytoPartyAarentaldepositoftheProperty,thedepositshallbeTwomonthsofrent,thatis(RMBCurrencyTwenty-twothousandyuan. PartyAshallissueareceipttoPartyBafterreceivingpaymentofdeposit.Attheterminationofthelessor/lesseerelationship,theremainingdepositoftheleaseofthePropertyobtainedbyPartyAshallberefundedtoPartyBaftersettingoffthefeesandexpensesbornebyPartyBundertheContractwithoutinterestwithinoneweek.5-2租賃期間,使用該房屋所發生水、電、煤氣、通訊費用及ADSL安裝費由 乙方(甲方/乙方)負擔。其她物業管理費、衛星電視收視費和現場家庭會所卡兩人,均由 甲方(甲方/乙方)負擔。Duringtheleaseterm,thewater,electricity,gas,communicationoftheProperty,ADSLusagefeeandotherfeesresultedfromtheuseofthePropertyshallbebornebyPartyB.Allothermanagementfee,satelliteTVinstallation,onsiteclubmembershipcardshallbeborneby PartyA .5-3 乙方(甲方/乙方)負擔上述費用,計算或分攤措施、支付方法和時間: 依據上述企事業單位列出帳單憑證支付,如不按期付款,滯納金由乙方負擔。PartyBshallberesponsibletopaytheabovefeesandcharges,thecomputationoramortization,methodandtimeofpayment:Accordingtothedemandnotes,ifdelayingpayment,PartyBshouldberesponsibleforthepenalty.六、房屋使用要求和維修責任StandardRequiredforUseofPropertyandResponsibilityofPropertyMaintenanceandRepair6-1租賃期間,乙方發覺該房屋及其隸屬設施有損壞或故障時,應立刻通知甲方修復;甲方應在接到乙方通知后日內進行維修。逾期不維修,乙方可代為維修,費用由甲方負擔。Duringtheleaseterm,ifPartyBdiscoversanydamagesordefectsofthePropertyandfacilitiesattached,itshallnotifyPartyAimmediatelyforrepair.PartyAshallcarryouttherepairwithindaysafterreceivingnotificationfromPartyB.AnydelayinrepairmayberepairedbyPartyBonPartyA’sbehalfandtheexpensesincurredshallbebornebyPartyA.6-2租賃期間,乙方應合理使用并珍惜該房屋其隸屬設施。因乙方使用不妥或不合理使用,致使該房屋及其隸屬設施損壞或發生故障,乙方應負責維修。乙方拒不維修,甲方可代為維修,費用由乙方負擔。Duringtheleaseterm,PartyBshallreasonablyuseandtakegoodcareofthePropertyandthefacilitiesattached.PartyBshallberesponsibletorepairimmediatelythedamagescausedtothePropertyand/orfacilitiesduetoimproperandunreasonableusebyPartyB.IfPartyBrefusestorepair,PartyAmayrepaironitsbehalfandtheexpensesincurredshallbebornebyPartyB.6-3租賃期間,甲方確保該房屋及其隸屬設施處于正常可使用和安全狀態。甲方對該房屋進行檢驗、養護,應提前日通知乙方。檢驗養護時,乙方應給予配合。甲方應降低對乙方使用該房屋影響。Duringtheleaseterm,PartyAshallguaranteethenormalusableandsafeconditionofthePropertyandfacilitiesattached.PartyAshallnotifyPartyBdaysinadvancebeforecarryingoutexaminationandmaintenanceworks.PartyBshallrendercooperationduringtheexaminationandmaintenance.PartyAshallreducetheeffectcausedtoPartyBinusingtheProperty.6-4乙方需裝修或者增設隸屬設施和設備,應事先取得甲方書面同意,按要求須向相關部門審批,則還應由甲方(甲方/甲方委托乙方)報請相關部門同意后,方可進行。乙方增設隸屬設施設備歸屬及其維修責任由甲、乙雙方另行書面約定。ExceptforAppendix3ofthisContract,beforecarryingoutanyextrarenovationoradditionoffacilitiesattachedandequipment,PartyBshallobtainthewrittenconsentofPartyAandsubmitthesametotherelevantauthorityforexaminationandapprovalinaccordancewiththeregulations.TheworkscouldonlybecarriedoutuponcompletionoftheprocedureofapprovalwiththerelevantauthoritybyPartyA.TheresponsibilityofthemaintenanceoftheaddedfacilitiesbyPartyBshallbeagreedbyPartyAandPartyBinseparatewrittenagreement.七、房屋返還時狀態ConditionofPropertyatDeliveryBack7-1除甲方同意乙方續租外,乙方應在本協議租期屆滿后日內返還該房屋,未經甲方同意逾期返還房屋,每逾期一日,乙方應按 向甲方支付該房屋占用期間使用費。ExceptfortherenewalofleaseagreedbyPartyA,PartyBshalldeliverupthePropertywithinaftertheexpirationofleasetermofthisContract.LatedeliveryofthePropertywithouttheconsentofPartyAshallbesubjecttoachargeforadversepossessionofthePropertyattimeofrentperday.7-2乙方返還該房屋應該符合正常使用后狀態。返還時,應經甲方驗收認可,并相互結清各自應該負擔費用。ThePropertyatthetimeofdeliveryupbyPartyBshallbeofaconditionafternormaluse.ThedeliveryupshallbeexaminedandauthorizedbyPartyAandthefeeandchargesresponsiblebythepartiesshallbeclearedatthetimeofdeliveryup.八、轉租、轉讓和交換Sublease,AssignmentandExchange8-1除甲方已在本協議補充條款中同意乙方轉租外,乙方在租賃期內,需事先取得甲方書面同意,方同將該房屋部分或全部轉租給她人。但同一間居住房屋,不得分割轉租。UnlessotherwiseagreedinthesupplementaryclausesofthisContract,PartyBshallobtainthewrittenapprovalfromPartyAbeforeitcouldsubleasepartorallofthePropertytoathirdpartyduringtheleaseterm.PartyBshallnotsubleasepartofthePropertyorsubleasetotwolesseesormorethantwolesseesatthesametime.8-2乙方轉租該房屋,應按要求與接收轉租方簽訂書面轉租協議。并按要求向該房屋所在區、縣房地產交易中心或農場系統受理處辦理登記立案。WhenPartyBsubleasestheProperty,itshallenterintoasubleasecontractwiththelesseeinwritinginaccordancewiththeregulations.ThesubleasecontractshallberegisteredandfiledwiththeRealEstateTradeManagementDepartmentortheMinistryofAgriculturalSystemswherethePropertyislocated.8-3在租賃期內,乙方將該房屋轉讓給她人承租或與她人承租房屋進行交換,必需事先取得甲方書面同意。轉讓或交換后,該房屋承租權受讓人或交換人應與甲方簽署租賃主體變更協議并繼續推行本協議。Duringtheleaseterm,PartyBshallobtainthewrittenconsentfromPartyAbeforeassigningthePropertytoathirdpartyforsubleaseorexchangethePropertysubleasedbyathirdparty.Aftertheassignmentorexchange,theassigneeofthePropertyorthepartytotheexchangeshallsigntheContractfortheamendmentoftheleaseandcontinuetoenforcethisContract.8-4在租賃期內,甲方如需出售該房屋,應提前三個月通知乙方。乙方在相同條件下有優先購置權。若乙方無意購置該物業,本租賃協議繼續生效。Duringtheleaseterm,ifPartyAshallselltheProperty,itshallnotifyPartyB3monthsinadvance.PartyBshallhavetheprioritytopurchaseunderthesameconditions.九、解除本協議條件ConditionsforTerminatingthisContract9-1甲、乙雙方同意在租賃期內,有下列情形之一,本協議終止,雙方互不負擔責任:PartyAandPartyBhaveagreedthatduringtheleaseterm,thisContractshallbeterminatedunderanyofthefollowingcircumstancesandbothpartiesshallnotbeheldresponsibleasaresultthereof:該房屋占用范圍內土地使用權依法提前收回;TherighttouseoflandwithinthescopeofthePropertywasearlyresumedinaccordancewiththelaws;該房屋因社會公共利益被依法征用;ThePropertywasresumedforpublicinterests;該房屋因城市建設需要被依法列入房屋拆遷許可范圍;ThePropertyhasbeenclassifiedaspremisestobedemolishedaccordingtothelawfortheneedoftownplanning;該房屋毀損、滅失或者被判定為危險房屋;Damages,firehazardsoccurredtothePropertyorotherwisebeenclassifieddangerouspremises;甲方已通知乙方該房屋出租前已設定抵押,現被處分。PenaltyasaresultofthemortgagecreatedoverthePropertyasnotifiedtoPartyBbyPartyAbeforethelease;9-2甲、乙雙方同意,有下列情形之一,一方可書面通知另一方解除本協議。違反協議一方,應向另一方按月租金2倍支付違約金;給對方造成損失,支付違約金不足抵付一方損失,還應賠償造成損失與違約金差額部分:PartyAandPartyBhaveagreedthatonepartymayterminatethisContractbywrittennoticetotheotherpartyunderanyofthefollowingcircumstances.Thepartyinbreachshallpaytotheotherpartyapenaltyof2timesoftherentpermonth;ifdamagesiscausedtotheotherpartyandthepenaltyisnotsufficienttooffsetthedamagesoftheotherparty,thepartyinbreachshallalsocompensateforthedifferencebetweenthepenaltyandthedamagescaused:(一)甲方未按時交付該房屋,經乙方催告后7日內仍未交付;PartyAfailstodeliverupthePropertyaccordinglyandremainfailtodeliverwithin7daysafterdemandgivenbyPartyB;(二)甲方交付該房屋不符合本協議約定,致使不能實現租賃目;或甲方交付房屋存在缺點,危及乙方安全。ThePropertydeliveredupbyPartyAfallsshortoftheagreementofthisContract,causingfailuretorealizethepurposeofthelease;orthePropertydeliveredbyPartyAisdefectiveandaffectsthesafetyofPartyB;(三)乙方未取得甲方書面同意改變房屋用途,致使房屋損壞;PartyBalterstheuseofthePropertywithoutthewrittenconsentofPartyA,causingdamagestotheProperty;(四)因乙方原因造成房屋主體結構損壞;DamagescausedtothemainstructureofthePropertyattributabletoPartyB;(五)乙方私自轉租該房屋、轉讓該房屋承租權或與她人交換各自承租房屋;PartyBsubleasestheProperty,assignsthePropertytoorexchangesthePropertywiththethirdpartywithoutconsent;(六)乙方逾期不支付租金累計超出壹月;PartyBfailstopayrentforover1months;十、違約責任LiabilitiesforBreachofContract10-1該房屋交付時存在缺點,甲方應自交付之日起 日內進行修復,逾期不修復,甲方同意降低租金并變更相關租金條款。Fordefectsexistatthetimeofdeliveryoftheproperty,PartyAshallperformtherepairworkwithindaysafterthedelivery,intheeventofdelayandnon-repair,PartyAagreestoreducetherentpayableandalterstherelevantrentalprovisions.10-2因甲方未通知乙方,該房屋出租前已抵押或產權轉移已受到限制,造成乙方損失,甲方應負責賠償。 PartyAshallbeliabletocompensationforlossincurredbyPartyBduetoPartyA’sfailureinnotifyingPartyBoftherestrictionofthePropertyundermortgageorassignmentofinterestsbeforetheleaseoftheProperty.10-3租賃期間,甲方不立刻推行本協議約定維修、養護責任,致使房屋損壞,造成乙方財產損失或人身傷害,甲方應負擔賠償責任。Duringtheleaseterm,ifPartyAfailstoperformthedutiesofmaintenanceandrepairunderthisContract,causingdamagesorlossestothePropertyand/orpersonalinjuriestoPartyB,PartyAshallbeliabletocompensation.10-4租賃期間,非本協議要求情況,甲方私自解除本協議,提前收回該房屋,甲方應按月租金2倍向乙方支付違約金。若違約金不足抵付乙方損失,甲方還應負責賠償。Duringtheleaseterm,ifPartyAterminatesthisContractandtakesbackthePropertybeforetheexpirationoftheleaseinanyeventotherthanthosestipulatedinthisContract,itshallpaytoPartyBapenaltyof2timesofrentpayablefortheremainingdaysoftheterm.PartyAshallbeliableforcompensationifthepenaltyisnotsufficienttooffsetthelossessufferedbyPartyB.10-5乙方未取得甲方書面同意或者超出甲方書面同意范圍和要求裝修房屋或者增設隸屬設施,甲方能夠要求乙方 恢復房屋原狀 (恢復房屋原狀/賠償損失)。PartyBhasrenovatedthePropertyoraddedfacilitiesattachedtothePropertywithoutobtainingthewrittenconsentofPartyAoroutsidethescopeofthewrittenapprovalofPartyA,PartyAmayrequirePartyBtorestorethePropertytoitsoriginalstate.10-6租賃期間,非本協議要求情況,乙方中途私自退租,乙方應按月租金2倍向甲方支付違約金。若違約金不足抵付甲方損失,乙方還應負責賠償。甲方可從租賃確保金中抵扣。確保金不足抵扣,不足部分則由乙方另行交付。Duringtheleaseterm,exceptforcircumstancesstipulatedinthisContract,ifPartyBwithdrawsfromtheleasewithoutobtainingtheapprovalofPartyA.PartyBshallpayapenaltytoPartyA2timestherentpayablefortheremainingdaysoftheterm.IfthepenaltyisnotsufficienttooffsetthelosssufferedbyPartyA,PartyBshallbeliabletocompensation.PartyAmayoffsettheamountfromthedeposit.Ifthedepositisnotsufficienttooffsettheamount,theoutstandingamountshallbepaidbyPartyB.十一、其她條款OtherClauses11-1租賃期間,甲方需抵押該房屋,應該書面通知乙方,并向乙方承諾房屋抵押后當事人協議以折價、變賣方法處分該房屋前叁十日書面咨詢乙方購置該房屋意見。Duringtheleaseterm,ifPartyAshallrequiretomortgagetheProperty,itshallnotifyPartyBinwritingandguaranteetoPartyBthatafterthemortgageoftheProperty,PartyB’sopinionastothepurchaseofthePropertywouldbeconsultedinwriting30daysbeforeagreementonmethodofdisposalofthePropertyisreached.11-2本協議自雙方簽字/簽字后立即生效。生效后15日內,由甲方負責按要求向房屋所在地域、縣房地產交易中心或農場系統受理處辦理登記立案,領取房屋租賃登記立案證實;本協議經登記立案后,凡變更、終止本協議,由甲方(甲方/乙方)負責在本協議變更終止之日起15日內,向原登記機構辦理變更、終止登記立案手續。因甲方未辦理房屋租賃登記立案或變更、終止登記立案,所引發法律糾紛,由甲方負擔一切責任。ThisContractshalltakeeffectaftersignedbybothparties.Within15daysofthesigningofthisContract,PartyAshallberesponsibletoregisterwiththeRealEstateTradeManagementDepartmentortheMinistryofAgriculturalSystemswherethePropertyislocatedandobtaintheCertificateofLeaseuponregistration:IncasesofmodificationorterminationofthisContractaftertheregistrationofthisContract,PartyAshallberesponsibletoregisterthemodificationorterminationwiththeoriginalregistrationofficewithin15daysofsuchmodificationortermination.AnylegaldisputesarisingfromthefailureofPartyAtoregistertheCertificateofLeaseortoregisterthemodificationorterminationshallbebornebyPartyA.11-3本協議未盡事宜,經甲、乙雙方協商一致,可簽訂補充條款。本協議補充條款及附件均為本協議不可分割一部分,本協議及其補充條款和附件內空格部分填寫文字與鉛印文字含有相同效力。PartyAandPartyBmaythroughmutualconsultationenterintothesupplementaryclausesonmattersnotstipulatedinthisContract.TheSupplementaryclausesandappendicesshallformanindispensablepartofthisContract.WordsintheblanksprovidedinthisContractanditssupplementaryclausesandappendicessh
