3、public of China and other relevant regulations and laws, and with the intermediary services ofParty C, Party A and Party B agree to enter into this Contract in equal status and voluntarily with articles as follow:第一條 房屋基本情況 Article 1: General states of the house(一)房屋坐落于北京市 區(縣) 街道辦事處(鄉鎮) ,建筑面積 平方米。(

5、se Contract /Other certificate), the munimentNO.: , or the certificate of obtaining the house: , House-ownersname (Public houses lessee or house buyer): ,Whether the house has been mortgaged (YES/NO).第二條 房屋租賃情況及登記備案 Article 2: Rental situation and registration(一)租賃用途: ;如租賃用途為居住的,居住人數為: ,最多不超過 人。(a)
6、Rental purposes: If the rental purpose is for residence, the number of inhabitant is , and should not exceeding persons.(二)如租賃用途為居住的,甲方應自與乙方訂立本合同之日起7日內,到房屋所在地的社區來京人員和出租房屋服務站辦理房屋出租登記手續。對多人居住的,乙方應將居住人員情況告知甲方,甲方應建立居住人員登記簿,并按規定報送服務站。本合同變更或者終止的,甲方應自合同變更或者終止之日起5日內,到房屋所在地的社區來京人員和出租房屋服務站辦理登記變更、注銷手續。在本合同有效期內
7、,居住人員發生變更的,乙方應當自變更之日起2日內告知服務站,辦理變更登記手續。居住人員中有外地來京人員的,甲方應提供相關證明,督促和協助乙方到當地公安派出所辦理暫住證;居住人員中有境外人員的,(甲方 /乙方)應自訂立本合同之時起24小時內到當地公安派出所辦理住宿登記手續。租賃用途為非居住的,甲方應自訂立房屋租賃合同之日起30日內,到房屋所在地的房屋行政管理部門辦理房屋租賃合同備案手續。If the rental purposes is for residence, from the date when this Contract has been set up, within 7 days,
8、Party A should go to the Community Service Station for Foreigner and House Lease (hereinafter refers to as the “station”) to have the house lease contract registered. If the inhabitant is more than one person, Party B must inform the situation of inhabitants to Party A. On the other hand, Party A mu
9、st establish a register for inhabitants, and send it to the Station complying with regulation. If this contract has been amended or terminated, party A should go to the Station to change or logout the registration within 5 days. In the period of validity, provided the inhabitants have changed, from
10、the date of change, within 2 days, Party B must inform the Service Station and change the registration.Party A should supply the related information about himself and/or the house if there is foreigner from other provinces within the inhabitant, to assist and supervise Party B to handle the Temporar
11、y Residential Permit at Local Police Station. And Party B should go to Local police station to handle the Lodging Registration within 24 hours if there is any person from other countries, from the time when this contract has been set up.If the rental purpose is not residence, from the date when this
12、 contract has been set up, within 30 days, Party A should go to the department of Local House Administration to handle the Lease Contract Registration filing procedure.第三條 租賃期限 Article 3:Lease Term(一)房屋租賃期自 年 月 日至 年 月 日,共計 年 個月。甲方應于 年 月 日前將房屋按約定條件交付給乙方。房屋交割清單(見附件一)經甲乙雙方交驗簽字蓋章并移交房門鑰匙及 后視為交付完成。(a) Fro

14、delivered.(二)租賃期滿或合同解除后,甲方有權收回房屋,乙方應按照原狀返還房屋及其附屬物品、設備設施。甲乙雙方應對房屋和附屬物品、設備設施及水電使用等情況進行驗收,結清各自應當承擔的費用。乙方繼續承租的,應提前 30 日向甲方提出(書面 / 口頭)續租要求,協商一致后雙方重新簽訂房屋租賃合同。(b) Party A has the right to retract the house upon the expiration of the leasehold or the dissolution of the contract, and, Party B should return t
15、he leased house and accessary facilities in original state to Party A. Both parties must check and accept the house and the accessory facilities, meanwhile, settle accounts of the cost which should be bore by their own.If the Lessee intends to renew the leasehold, should notify (written/oral) the Le
16、ssor within one month before termination. Both parties should conclude a new lease contract based on the agreement.第四條 租金及押金 Article 4: Rental and deposit(一)租金標準及支付方式: 元/(月/ 季/ 半年/ 年),租金總計:人民幣 元整(: )。支付方式:(現金/轉賬支票/銀行匯款),押 付 ,各期租金支付日期: , , 。(a) Rental and payment terms: RMB(month/three months/a half

Each payment shall be made (二)押金:人民幣 元整 (: ) 租賃期滿或合同解除后,房屋租賃押金除抵扣應由乙方承擔的費用、租金,以及乙方應當承擔的違約賠償責任外,剩余部分應如數返還給乙方。(b) Deposit:_RMB. The deposit shall be refundable after its exp
18、iration or early termination, deducting the expense which Party B owed and the amends for any loss of unusual damage.第五條 其他相關費用的承擔方式 Article 5: Other fees租賃期內的下列費用中, 由甲方承擔, 由乙方承擔:(1)水費(2)電費(3)電話費(4)電視收視費(5)供暖費(6)燃氣費(7)物業管理費(8)房屋租賃稅費(9)衛生費(10)上網費(11)車位費(12)室內設施維修費(13) 費用。During the lease term, Party

20、 maintenance costs(m) others本合同中未列明的與房屋有關的其他費用均由甲方承擔。如乙方墊付了應由甲方支付的費用,甲方應根據乙方出示的相關繳費憑據向乙方返還相應費用。The Party A should bear other fees which this contract has not listed which concern the house. If the Party B had paid the fees related proof, Party A should returned corresponding fees to Party B.第六條居間服務
21、Article 6: Intermediary services(一)丙方應當認真負責地為甲乙雙方訂立房屋租賃合同提供機會或媒介服務,如實報告有關訂立房屋租賃合同的事項,并協助甲乙雙方辦理物業交驗。(a) Party C should provide the opportunity or the medium service to both parties conscientiously and earnestly, and notice the information of this contract to both parties faithfully, and assist them t
22、o check and accept the property.(二)本合同簽訂后(即時/ 日內),甲方應向丙方支付月租金的 %即人民幣 元整(: )作為傭金,支付方式:現金/轉帳支票/銀行匯款;乙方應向丙方支付月租金的 %即人民幣 元整(: )作為傭金,支付方式:現金/轉帳支票/銀行匯款。甲乙雙方支付的傭金總合應不超過月租金標準。(b) Upon the contract have been signed (Immediate/within days), Party A should pay % of the monthly rental to Party C as service fee.

The total of remuneration should not surpass the monthly rental. (三)本合同簽訂后,如租賃雙方解除、中止或變更租賃關系的,租賃雙方仍應向丙方支付所約定的傭金
24、。(c) Once the contract has been signed, the remuneration couldnt be returned whether this contract is rescinded or suspended, or modified.第七條 房屋維護及維修 Article 7: Maintenance and repair(一)甲方應保證房屋的建筑結構和設備設施符合建筑、消防、治安、衛生等方面的安全條件,不得危及人身安全;承租人保證遵守國家、北京市的法律法規規定以及房屋所在小區的物業管理規約。(a) Party A should ensure that
25、 the construction and facilities of rental house is conformed to relevant laws and regulations. Party B could not do any unlawful or illegal activities which are not allowed according to the State laws, the government regulations and the local byelaw. In the period of rents, both parties should keep
26、 the house, the facilities and goods attached to the house in safe and suitable.(二)租賃期內,甲乙雙方應共同保障房屋及其附屬物品、設備設施處于適用和安全的狀態:(b)In the period of rents, both parties should keep the house, the good and facilities attached to the house in applicable and safe:1、對于房屋及其附屬物品、設備設施因自然屬性或合理使用而導致的損耗,乙方應及時通知甲方修復。甲
27、方應在接到乙方通知后的 7 日內進行維修。逾期不維修的,乙方可代為維修,費用由甲方承擔。因維修房屋影響乙方使用的,應相應減少租金或延長租賃期限。aParty B should notice Party A about any damage of the houses due to poor quality, natural tear and wear or calamities. Party A should be responsible for repairing in 7 days and bear the expenses. Provided Party A has not repair
28、ed on schedule, Party B could repair instead of Part A. Party A should bear the expenses which should be undertaken by himself. Once the repairing has made an impact on the usual life, Party A should reduce rental or extend the period of rent correspondingly.2、因乙方保管不當或不合理使用,致使房屋及其附屬物品、設備設施發生損壞或故障的,乙
29、方應負責維修或承擔賠償責任。bThe damage of the premises or the fittings that is within the control of the party B should be borne by party B.第八條 轉租 Article 8: Transfer or Sublet除甲乙雙方另有約定以外,乙方需事先征得甲方書面同意,方可在租賃期內將房屋部分或全部轉租給他人,并就受轉租人的行為向甲方承擔責任。Party B should not partly or totally sublet without the written permissio

If the house has been transferred or sublet, Party B should be liable for compensating for any behavior of sublet person.第九條 合同解除 Article 9: Dissolution of Contract(一)經甲乙雙方協商一致,可以解除本合同。(a) The contract can be rescind based on the agreement(二)因不可抗力導致本合同無法繼續履行的,本合同自行解除。(b) If Force Maj
31、eure cause to terminating the contract, the contract is rescinded.(三)甲方有下列情形之一的,乙方有權單方解除合同:(c) If Party A has one of the following behaviors, Party B has the right to rescind this Contract unilaterally.1、遲延交付房屋達 7 日的。a Within 7 days, Party A has not turn over the house.2、交付的房屋嚴重不符合合同約定或影響乙方安全、健康的。b
32、The house does not conform to the contract seriously or affects the safety and healthy of Party B.3、不承擔約定的維修義務,致使乙方無法正常使用房屋的。c Because Party A has not repaired house, Party B could not use house normally.4、 。d (四)乙方有下列情形之一的,甲方有權單方解除合同,收回房屋:(d) If Party B has one of the following behaviors, Party A h
33、as the right to rescind the Contract unilaterally and take back the house.1、不按照約定支付租金達 日的。a If Party B delays rental payment in the excess of _days.2、欠繳各項費用達 元的。b If Party B delays kinds of fees in the excess of _yuan.3、擅自改變房屋用途的。c If Party B changes the use of the leased house unilaterally.4、擅自拆改變動
34、或損壞房屋主體結構的。d If Party B changes or damages the main structure of house unilaterally.5、保管不當或不合理使用導致附屬物品、設備設施損壞并拒不賠償的。e The damage of the premises or the fittings that is within the control of party B and party B refuses to compensate.6、利用房屋從事違法活動、損害公共利益或者妨礙他人正常工作、生活的。f The Party Bs behaviors in the h
35、ouse are unlawful or interfere with other peoples life.7、擅自將房屋轉租給第三人的。g The Party B transfer or sublet the leased house unilaterally.8、 。 h (五)其他法定的合同解除情形。(e) Other legal situations of contract rescission.第十條 違約責任 Article10: Responsibility for breach of the Contract(一)甲方有第九條第三款約定的情形之一的,應按月租金的 200 %向
36、乙方支付違約金;乙方有第八條第四款約定的情形之一的,應按月租金的 200 %向甲方支付違約金,甲方并可要求乙方將房屋恢復原狀或賠償相應損失。(a) Either of Parties behaviors results in the termination of the contract before its expiration, the penalty for breach should be 200% of monthly rental . Party A has the right to take back the premises and take actions against p
37、arty Bs breach.(二)租賃期內,甲方需提前收回房屋的,或乙方需提前退租的,應提前 30 日通知對方,并按月租金的 200 %向對方支付違約金;甲方還應退還相應的租金。(b) In the period of rent, either Party A shall take back the house ahead, or Party B shall return the house before the contract expiration, he should informed the other party ahead of 30 days. Tort-feasor agre
38、es that the penalty for breach of contract shall be 200% of monthly rental. At the same time, Party A should return the surplus rent.(三)因甲方未按約定履行維修義務造成乙方人身、財產損失的,甲方應承擔賠償責任。(c) Party A has not repaired the house in time according to the contract, so Party Bs security has been damaged. Party A should
39、undertake the liability of compensation. (四)甲方未按約定時間交付房屋或者乙方不按約定支付租金但未達到解除合同條件的,以及乙方未按約定時間返還房屋的,應按 日租金的200% 標準支付違約金。(d) Having not rescinded the Contract, but tort-feasor agree that the penalty for breach of Contract shall be 200% of daily rental surpasses one day.a Party A shall not turn over the h
40、ouses on schedule to Party B for use.b Party B shall not pay the rental on schedule according to the provisions of the Contract.c Party B shall not return the house on schedule according to the provisions of the Contract. (五)丙方提供虛假信息、隱瞞重要事實或有惡意串通行為的,除退還已收取的傭金外,還應賠償由此給甲方或乙方造成的損失。(e) Having behaviors
41、in the following, besides returning the service fees received, the party C should also compensate the loss of Party A or Party B.a Party C provided the false information to two parties.b Party C concealed important fact to two parties.c Party C colluded with the third party maliciously.(六) 。(f) 第十一條
42、 合同爭議的解決辦法 Article 11: Handling of disputes本合同項下發生的爭議,由雙方當事人協商解決;協商不成的,依法向有管轄權的人民法院起訴,或按照另行達成的仲裁條款或仲裁協議申請仲裁。(a) Any dispute arising from the execution of, or in connection with, the contract shall be settled through friendly negotiation between tripartite parties. In case no settlement can be reached, the disputes shall be submitted to the peoples court, which has jurisdiction over the houses. Or compelled arbitration in accordance with the arbitration clause or the arbitrati
