20XX專(zhuān)業(yè)合同封面COUNTRACTCOVER20XX專(zhuān)業(yè)合同封面COUNTRACTCOVER甲方:XXX乙方:XXXPERSONALRESUMERESUME辦公室租賃合同英文版本合同目錄一覽1.1合同雙方基本信息1.2租賃物描述1.3租賃期限1.4租金及支付方式1.5租金調(diào)整1.6押金及退還1.7租賃物使用及維護(hù)1.8修繕責(zé)任1.9違約責(zé)任1.10合同解除1.11爭(zhēng)議解決1.12其他約定1.13合同生效及修改1.14合同附件第一部分:合同如下:1.1合同雙方基本信息1.2租賃物描述1.2.1租賃物位于:[租賃物具體位置]。1.2.2租賃物面積為:[租賃物面積]平方米。1.3租賃期限1.3.1本合同租賃期限自[起始日期]起至[終止日期]止,共計(jì)[租賃期限]年。1.4租金及支付方式1.4.1租金為每月人民幣[租金金額]元,共計(jì)人民幣[租金總額]元。1.4.2乙方應(yīng)于每月[支付日期]前支付當(dāng)月租金,逾期支付需支付每日[滯納金比例]%的滯納金。1.5租金調(diào)整1.5.1在租賃期間,如遇政府相關(guān)政策調(diào)整,租金可按政府規(guī)定進(jìn)行調(diào)整。1.6押金及退還1.6.1乙方需在簽訂本合同當(dāng)日向甲方支付押金人民幣[押金金額]元。1.6.2租賃期滿(mǎn)或合同解除后,甲方應(yīng)無(wú)息退還乙方押金,但需扣除應(yīng)由乙方承擔(dān)的違約金、維修費(fèi)用等。1.7租賃物使用及維護(hù)1.7.1乙方在租賃期間應(yīng)合理使用租賃物,不得擅自改變租賃物的結(jié)構(gòu)或用途。1.8修繕責(zé)任1.8.1租賃物及其附屬設(shè)施在正常使用過(guò)程中發(fā)生的自然磨損,由甲方負(fù)責(zé)維修。1.8.2乙方在使用過(guò)程中造成的損壞,由乙方負(fù)責(zé)維修或賠償。1.9違約責(zé)任1.9.1任何一方違反本合同約定,應(yīng)承擔(dān)相應(yīng)的違約責(zé)任。1.9.2違約金為人民幣[違約金金額]元,乙方違約需支付違約金。1.10合同解除1.10.1本合同在下列情況下可解除:a)雙方協(xié)商一致;b)甲方因故需要收回租賃物;c)乙方違反本合同約定,經(jīng)甲方書(shū)面通知后仍未糾正;d)因不可抗力導(dǎo)致合同無(wú)法履行。1.11爭(zhēng)議解決1.11.1雙方在履行本合同過(guò)程中發(fā)生的爭(zhēng)議,應(yīng)友好協(xié)商解決;協(xié)商不成的,可向租賃物所在地人民法院提起訴訟。1.12其他約定1.12.1本合同未盡事宜,雙方可另行協(xié)商簽訂補(bǔ)充協(xié)議,補(bǔ)充協(xié)議與本合同具有同等法律效力。1.13合同生效及修改1.13.1本合同自雙方簽字蓋章之日起生效。1.13.2本合同在履行過(guò)程中,任何一方不得擅自修改,如需修改,應(yīng)經(jīng)雙方協(xié)商一致并簽訂書(shū)面協(xié)議。1.14合同附件a)租賃物清單;b)租賃物設(shè)施清單;c)本合同簽訂當(dāng)日雙方簽字蓋章的文件。8.1合同解除條件8.1.1乙方有下列情形之一的,甲方有權(quán)解除合同:a)乙方未按約定支付租金,逾期超過(guò)[天數(shù)]日;b)乙方擅自改變租賃物的結(jié)構(gòu)或用途;c)乙方造成租賃物嚴(yán)重?fù)p壞,經(jīng)修復(fù)仍無(wú)法正常使用;d)乙方違反合同約定的其他行為。8.2合同終止8.2.1租賃期滿(mǎn),本合同自動(dòng)終止。8.2.2合同解除后,本合同終止。8.3租賃物返還8.3.1租賃期滿(mǎn)或合同解除后,乙方應(yīng)將租賃物及附屬設(shè)施完好無(wú)損地返還給甲方。8.3.2乙方在返還租賃物時(shí),應(yīng)確保租賃物符合合同約定的使用狀態(tài)。8.4不可抗力8.4.1不可抗力是指不能預(yù)見(jiàn)、不能避免并不能克服的客觀(guān)情況,如自然災(zāi)害、戰(zhàn)爭(zhēng)、政府行為等。8.4.2發(fā)生不可抗力事件,雙方應(yīng)相互理解,積極采取措施減少損失,并盡快通知對(duì)方。8.5通知與送達(dá)8.5.1雙方任何一方變更地址、聯(lián)系人或聯(lián)系方式,應(yīng)及時(shí)通知對(duì)方。8.5.2通知應(yīng)以書(shū)面形式發(fā)出,自發(fā)出之日起[天數(shù)]日內(nèi)送達(dá)對(duì)方。8.6法律適用與爭(zhēng)議解決8.6.1本合同適用中華人民共和國(guó)法律。8.6.2雙方在履行本合同過(guò)程中發(fā)生的爭(zhēng)議,應(yīng)通過(guò)友好協(xié)商解決;協(xié)商不成的,任何一方均可向租賃物所在地人民法院提起訴訟。8.7合同份數(shù)8.7.1本合同一式[份數(shù)]份,甲乙雙方各執(zhí)[份數(shù)]份,具有同等法律效力。8.8合同生效8.8.1本合同自雙方簽字蓋章之日起生效。8.9合同附件a)租賃物清單;b)租賃物設(shè)施清單;c)本合同簽訂當(dāng)日雙方簽字蓋章的文件。8.10合同修改8.10.1本合同在履行過(guò)程中,任何一方不得擅自修改,如需修改,應(yīng)經(jīng)雙方協(xié)商一致并簽訂書(shū)面協(xié)議。8.11合同解除通知8.11.1合同解除時(shí),一方應(yīng)提前[天數(shù)]日以書(shū)面形式通知對(duì)方。8.12合同解除后果8.12.1合同解除后,雙方應(yīng)按照本合同約定處理租賃物的返還、租金支付、押金退還等事宜。8.13合同終止通知8.13.1合同終止時(shí),一方應(yīng)提前[天數(shù)]日以書(shū)面形式通知對(duì)方。8.14合同終止后果8.14.1合同終止后,雙方應(yīng)按照本合同約定處理租賃物的返還、租金支付、押金退還等事宜。第二部分:第三方介入后的修正9.1第三方定義9.1.1本合同中所稱(chēng)的“第三方”是指除甲乙雙方以外的,為達(dá)成合同目的或履行合同義務(wù)而介入合同關(guān)系的任何個(gè)人、企業(yè)或組織。9.2第三方介入目的9.2.1第三方介入合同關(guān)系的目的包括但不限于提供專(zhuān)業(yè)服務(wù)、促成交易、提供擔(dān)保、監(jiān)督執(zhí)行等。9.3第三方類(lèi)型a)中介方:協(xié)助甲乙雙方達(dá)成交易的第三方;b)評(píng)估方:對(duì)租賃物進(jìn)行評(píng)估的第三方;c)監(jiān)理方:對(duì)合同執(zhí)行過(guò)程進(jìn)行監(jiān)督的第三方;d)擔(dān)保方:為甲乙雙方提供擔(dān)保的第三方。9.4第三方責(zé)任限額9.4.1第三方的責(zé)任限額應(yīng)根據(jù)其介入合同關(guān)系的目的和方式確定,具體如下:a)中介方:中介方的責(zé)任限于其收取的中介費(fèi)用范圍內(nèi);b)評(píng)估方:評(píng)估方的責(zé)任限于其評(píng)估結(jié)果與實(shí)際價(jià)值偏差的范圍內(nèi);c)監(jiān)理方:監(jiān)理方的責(zé)任限于其監(jiān)理過(guò)程中因疏忽導(dǎo)致的損失范圍內(nèi);d)擔(dān)保方:擔(dān)保方的責(zé)任限于其擔(dān)保金額的范圍內(nèi)。9.5第三方責(zé)任劃分9.5.1第三方的責(zé)任劃分如下:a)中介方:僅對(duì)中介服務(wù)本身承擔(dān)責(zé)任,不對(duì)合同履行結(jié)果承擔(dān)責(zé)任;b)評(píng)估方:對(duì)評(píng)估結(jié)果的真實(shí)性和準(zhǔn)確性承擔(dān)責(zé)任;c)監(jiān)理方:對(duì)監(jiān)理過(guò)程中的監(jiān)督職責(zé)承擔(dān)責(zé)任;d)擔(dān)保方:對(duì)擔(dān)保事項(xiàng)承擔(dān)責(zé)任。9.6第三方權(quán)利9.6.1第三方在合同中的權(quán)利包括但不限于:a)中介方:有權(quán)收取中介費(fèi)用;b)評(píng)估方:有權(quán)要求甲乙雙方提供必要的信息;c)監(jiān)理方:有權(quán)對(duì)合同執(zhí)行過(guò)程進(jìn)行監(jiān)督并提出改進(jìn)建議;d)擔(dān)保方:有權(quán)要求甲乙雙方履行合同義務(wù)。9.7第三方義務(wù)9.7.1第三方的義務(wù)包括但不限于:a)中介方:如實(shí)告知甲乙雙方合同相關(guān)信息,協(xié)助雙方達(dá)成交易;b)評(píng)估方:客觀(guān)、公正地進(jìn)行評(píng)估,確保評(píng)估結(jié)果的真實(shí)性和準(zhǔn)確性;c)監(jiān)理方:認(rèn)真履行監(jiān)理職責(zé),確保合同執(zhí)行過(guò)程符合約定;d)擔(dān)保方:按照約定履行擔(dān)保義務(wù)。9.8第三方變更9.8.1若合同中涉及的第三方需變更,應(yīng)經(jīng)甲乙雙方同意,并簽訂書(shū)面協(xié)議。9.9第三方介入程序a)雙方協(xié)商一致,確定第三方介入;b)雙方與第三方簽訂書(shū)面協(xié)議;c)第三方按協(xié)議履行職責(zé)。9.10第三方介入費(fèi)用9.10.1第三方介入合同關(guān)系的費(fèi)用由甲乙雙方根據(jù)協(xié)議約定承擔(dān)。9.11第三方介入爭(zhēng)議9.11.1第三方介入合同關(guān)系過(guò)程中發(fā)生的爭(zhēng)議,應(yīng)通過(guò)友好協(xié)商解決;協(xié)商不成的,可依法向人民法院提起訴訟。9.12第三方介入終止9.12.1第三方介入合同關(guān)系終止時(shí),甲乙雙方應(yīng)與第三方簽訂書(shū)面協(xié)議,明確各方權(quán)利義務(wù)。9.13第三方介入記錄9.13.1雙方應(yīng)妥善保存第三方介入合同關(guān)系的相關(guān)記錄,以備查證。第三部分:其他補(bǔ)充性說(shuō)明和解釋說(shuō)明一:附件列表:1.租賃物清單詳細(xì)要求:列出租賃物的具體名稱(chēng)、型號(hào)、數(shù)量、規(guī)格、使用狀況等信息。說(shuō)明:本清單作為合同附件,用于確認(rèn)租賃物的具體內(nèi)容和狀態(tài)。2.租賃物設(shè)施清單詳細(xì)要求:列出租賃物所包含的設(shè)施設(shè)備,包括但不限于家具、電器、辦公設(shè)備等。說(shuō)明:本清單作為合同附件,用于明確租賃物的配套設(shè)施。3.合同簽訂當(dāng)日雙方簽字蓋章的文件詳細(xì)要求:包括但不限于合同副本、附件、雙方身份證復(fù)印件等。說(shuō)明:本文件作為合同附件,用于證明合同的有效性和雙方的身份。4.租賃物使用說(shuō)明詳細(xì)要求:包括租賃物的操作指南、維護(hù)保養(yǎng)方法等。說(sh
