紡織品出口臨時管理辦法?第一章總則第一條目的為加強(qiáng)紡織品出口管理，規(guī)范紡織品出口秩序，根據(jù)《中華人民共和國對外貿(mào)易法》和相關(guān)法律法規(guī)，制定本辦法。TheseMeasuresareformulatedinaccordancewiththeForeignTradeLawofthePeople'sRepublicofChinaandrelevantlawsandregulationstostrengthentheadministrationoftextileexports,standardizetheorderoftextileexports.第二條適用范圍本辦法適用于對列入《紡織品出口臨時管理商品目錄》（以下簡稱《管理商品目錄》）的紡織品出口的管理。TheseMeasuresapplytotheadministrationofexportsoftextilesincludedinthe"InterimCatalogueofGoodsSubjecttoTemporaryAdministrationofTextileExports"(hereinafterreferredtoasthe"CatalogueofGoods").第三條管理原則國家對紡織品出口實(shí)行臨時管理，在一定時期內(nèi)以數(shù)量和價格等手段調(diào)控紡織品出口。Thestateimplementstemporaryadministrationoftextileexportsandregulatestextileexportsbymeansofquantity,priceandothermeasureswithinacertainperiod.第四條管理機(jī)構(gòu)商務(wù)部負(fù)責(zé)全國紡織品出口臨時管理工作，并根據(jù)工作需要會同海關(guān)總署和質(zhì)檢總局等有關(guān)部門，建立紡織品出口臨時管理工作協(xié)調(diào)機(jī)制，加強(qiáng)部門間協(xié)作配合。TheMinistryofCommerceisresponsiblefortheoveralladministrationoftemporarytextileexportsacrossthecountry.Asneeded,itwill,togetherwithrelevantdepartmentssuchastheGeneralAdministrationofCustomsandtheGeneralAdministrationofQualitySupervision,InspectionandQuarantine,establishacoordinationmechanismfortheadministrationoftemporarytextileexportstoenhanceinterdepartmentalcooperation.各省、自治區(qū)、直轄市、計劃單列市及新疆生產(chǎn)建設(shè)兵團(tuán)商務(wù)主管部門（以下簡稱各地商務(wù)主管部門）負(fù)責(zé)本地區(qū)紡織品出口臨時管理工作。Themercedepartmentsofprovinces,autonomousregions,municipalitiesdirectlyundertheCentralGovernment,citiesspecificallydesignatedinthestateplan,andXinjiangProductionandConstructionCorps(hereinafterreferredtoaslocalmercedepartments)areresponsiblefortheadministrationoftemporarytextileexportsintheirrespectiveregions.第二章臨時管理商品目錄及管理方式第五條臨時管理商品目錄商務(wù)部會同海關(guān)總署、質(zhì)檢總局根據(jù)中國加入世界貿(mào)易組織工作組報告書第242段有關(guān)規(guī)定，制定、調(diào)整和發(fā)布《管理商品目錄》。TheMinistryofCommerce,togetherwiththeGeneralAdministrationofCustomsandtheGeneralAdministrationofQualitySupervision,InspectionandQuarantine,formulates,adjustsandissuesthe"CatalogueofGoods"inaccordancewiththerelevantprovisionsofParagraph242oftheReportoftheWorkingPartyontheAccessionofChinatotheWorldTradeOrganization.第六條管理方式（一）對列入《管理商品目錄》的紡織品，實(shí)行出口配額管理。配額分為數(shù)量配額和關(guān)稅配額。1.Fortextilesincludedinthe"CatalogueofGoods",exportquotaadministrationisimplemented.Quotasaredividedintoquantityquotasandtariffquotas.（二）對列入《管理商品目錄》的紡織品，實(shí)行出口許可證管理。2.Fortextilesincludedinthe"CatalogueofGoods",exportlicenseadministrationisimplemented.第三章出口配額管理第七條配額分配原則出口配額按照對所有申請企業(yè)公平、公正、公開的原則進(jìn)行分配。Exportquotasareallocatedinaccordancewiththeprinciplesoffairness,impartialityandopennesstoallapplicantenterprises.第八條配額申請條件申請紡織品出口臨時管理商品出口配額的企業(yè)，應(yīng)具備以下條件：1.在商務(wù)主管部門登記備案；2.具有良好的商業(yè)信譽(yù)、經(jīng)營業(yè)績和健全的財務(wù)管理制度；3.近兩年內(nèi)無違法、違規(guī)行為。Enterprisesapplyingforexportquotasforgoodssubjecttotemporaryadministrationoftextileexportsshallmeetthefollowingconditions:1.Registeredwiththemercedepartment;2.Havinggoodbusinessreputation,businessperformanceandsoundfinancialmanagementsystem;3.Withoutanyillegalorirregularactsinthepasttwoyears.第九條配額申請程序企業(yè)申請紡織品出口臨時管理商品出口配額，應(yīng)向所在地商務(wù)主管部門提出書面申請，并提交相關(guān)材料。Enterprisesapplyingforexportquotasforgoodssubjecttotemporaryadministrationoftextileexportsshallsubmitawrittenapplicationtothelocalmercedepartmentandproviderelevantmaterials.各地商務(wù)主管部門對企業(yè)提交的申請進(jìn)行審核后，將符合條件的申請上報商務(wù)部。Afterreviewingtheapplicationssubmittedbyenterprises,localmercedepartmentsshallsubmittheeligibleapplicationstotheMinistryofCommerce.第十條配額分配方式商務(wù)部根據(jù)企業(yè)申請情況，按照配額分配原則，通過招標(biāo)、拍賣等方式分配出口配額。TheMinistryofCommerceshallallocateexportquotasthroughmethodssuchasbiddingandauctioninaccordancewiththequotaallocationprinciplesbasedontheenterpriseapplicationsituation.第十一條配額使用期限紡織品出口臨時管理商品出口配額使用期限為當(dāng)年1月1日至12月31日。ThevalidityperiodofexportquotasforgoodssubjecttotemporaryadministrationoftextileexportsisfromJanuary1toDecember31ofthecurrentyear.第十二條配額調(diào)整在配額使用過程中，如因市場需求變化等原因需要調(diào)整配額數(shù)量，商務(wù)部將根據(jù)實(shí)際情況進(jìn)行調(diào)整。Duringtheuseofquotas,ifthequotaquantityneedstobeadjustedduetoreasonssuchaschangesinmarketdemand,theMinistryofCommercewillmakeadjustmentsaccordingtotheactualsituation.第四章出口許可證管理第十三條許可證申請條件企業(yè)憑有效的出口配額證明，向所在地商務(wù)主管部門申請出口許可證。Enterprisesshallapplyforexportlicensestothelocalmercedepartmentwithvalidexportquotacertificates.第十四條許可證申請程序企業(yè)申請出口許可證，應(yīng)填寫出口許可證申請表，并提交相關(guān)材料。Enterprisesapplyingforexportlicensesshallfillintheexportlicenseapplicationformandsubmitrelevantmaterials.各地商務(wù)主管部門對企業(yè)提交的申請進(jìn)行審核后，將符合條件的申請上報商務(wù)部。Afterreviewingtheapplicationssubmittedbyenterprises,localmercedepartmentsshallsubmittheeligibleapplicationstotheMinistryofCommerce.第十五條許可證發(fā)放商務(wù)部對各地商務(wù)主管部門上報的申請進(jìn)行審核，符合要求的，予以發(fā)放出口許可證。TheMinistryofCommerceshallreviewtheapplicationssubmittedbylocalmercedepartments.Iftheymeettherequirements,exportlicenseswillbeissued.第十六條許可證有效期出口許可證有效期不得超過6個月。Thevalidityperiodofexportlicensesshallnotexceedsixmonths.第五章監(jiān)督管理第十七條檢驗檢疫列入《管理商品目錄》的紡織品出口前，企業(yè)應(yīng)按照國家有關(guān)規(guī)定辦理檢驗檢疫手續(xù)。Beforeexportingtextilesincludedinthe"CatalogueofGoods",enterprisesshallgothroughinspectionandquarantineproceduresinaccordancewithrelevantnationalregulations.第十八條海關(guān)監(jiān)管海關(guān)憑商務(wù)部及其授權(quán)發(fā)證機(jī)關(guān)簽發(fā)的出口許可證驗放列入《管理商品目錄》的紡織品。Thecustomsshallreleasetextilesincludedinthe"CatalogueofGoods"againsttheexportlicensesissuedbytheMinistryofCommerceanditsauthorizedlicenseissuingorgans.第十九條違規(guī)處理對違反本辦法規(guī)定的企業(yè)，商務(wù)部將視情節(jié)輕重給予警告、暫?；蛉∠浼徔椘烦隹谂R時管理商品配額和出口許可證等處罰。ForenterprisesviolatingtheseMeasures,theMinistryofCommercewillimposepenaltiessuchaswarnings,suspensionorcancellationoftheirexportquotasandexportlicensesforgoodssubjecttotemporaryadministrationoftextileexportsaccordingtotheseriousnessofthecircumstances.第二十條統(tǒng)計與監(jiān)測各地商務(wù)主管部門應(yīng)做好紡織品出口臨時管理商品的統(tǒng)計工作，并及時向商務(wù)部報送相關(guān)數(shù)據(jù)。LocalmercedepartmentsshalldoagoodjobinthestatisticsofgoodssubjecttotemporaryadministrationoftextileexportsandreportrelevantdatatotheMinistryofCommerceinatimelymanner.商務(wù)部建立紡織品出口監(jiān)測預(yù)警機(jī)制，加強(qiáng)對紡織品出口情況的監(jiān)測和分析。TheMinistryofCommerceshallestablishamonitoringandearlywarningmechanismfortextileexportstostrengthenthemonitoringandanalysisoftextileexportsituations.第六章附則第二十一條解釋權(quán)本辦法由商務(wù)部負(fù)責(zé)解釋。TheseMeasuresshallbeinterpretedbytheMinistryofComme
