新加坡建筑工勞工合約(中英文)CONTRACTFORFOEMPLOYMENTREIGNCONSTRUCTIONWORKERSINTHEREPUBLICOFSINGAPORE(雇傭外籍建筑工人合同)ThisEmploymentContract(雇傭合同)ismadebetween茲由(1)havingitsregisteredaddressat:(hereinafterreferredtoasthe“Employer”)ononepartand(以下簡稱雇主,為一方,與):Name(姓名)Nationality(國籍)DateofBirth(出生日期)IdentificationNo.(身份證號碼)Address(家庭住址)(hereinafterreferredtoasthe“Employee”)ontheotherpartwhovoluntarilybindthemselvestothetermsandconditionsinthisemploymentcontract(以下簡稱為雇員,作為另一方,自愿達成以下雇傭條款):ITISHEREBYAGREEDTHATthisemploymentcontract,whichincludesthetermsandconditionsstatedinAnnexAandanydocumentsreferredtointhemandanyalterations,modifications,amendmentsorrevisionstothesamenotifiedbytheEmployertotheEmployeeformthecontractofemploymentbetweentheEmployerandtheEmployee:同時,本雇傭合同也包括附件A及其提及的文件內容以及在執行過程中根據情況對這些內容進行的補充、修改和完善,并相應通知雇員。GeneralPrinciple(總則)TheEmploymentContractistobesignedbytheEmployeeunderhisnotionandcommonunderstanding.Andithasbeenstudiedbyhimselfandconsideredcarefullyunderhisownsanityandhisfamily’spermission.本雇傭合同書是雇員在充分理解的基礎上簽訂的。雇員在簽署時,神智清醒,無任何壓力或引誘,并已取得家屬支持后,經多次閱讀和反復思考,完全自愿簽署的。AfterthisContractissigned,theemploymentrelationshipwillbeestablished.Anditshouldbethebehaviorstandardoftheemployee’s.Anybreachforit,theEmployeewillaccepttherelativepenaltyforhisowndeeds.本合同簽署后,雇員的一切言行必須以本合同為準則,若有違反,雇員自愿受罰。Task(工作安排)TheEmployermayattheirabsolutediscretionassigntheEmployeeinadifferenttrade/taskfromtimetotime.TheEmployerreservestheirrighttoadjusttheEmployee’spayaccordinglyiftheEmployeeisunableand/orisincompetenttocarryouttheassignedtrade/task.雇主有權根據需要將雇員安排在另一個職位工作。同時,雇主保留因雇員不能勝任工作而對其工資進行調整的權利。TheEmployeeshouldbephysicallyhealthyandpassallthemedicalcheckbyauthorizeddoctorsinSingapore.Andtheemployeeshouldbeaqualifiedconstructionworkerthatcanworkatheights,bearheat,andanyothertoughworkingenvironmentonsite.雇員必須身體健康,能通過新加坡醫院和診所組織的體檢。雇員必須是合格的建筑工人,工作時做到能吃苦,不怕曬,不怕熱、適應在高空、基坑或海上工作,能夠從事各項建筑施工。DutiesofEmployee(雇員職責)Location(工作地點)AnyoftheworksitesdesignatedbytheEmployerwithintheRepublicofSingapore.新加坡共和國內任何一個雇主指定的工地。WorkingTime(工作時間)TheworkingtimeshouldbedecidedbytheemployeeaccordingthelawofSingapore.雇員的工作時間按照新加坡的雇傭法由雇主決定。TheemployeeshouldfollowtheregulationsandinstructionbytheEmployer.Anyabsenceforworkwithoutavalidreason,theEmployercouldgivethefineofS$50.00.Iftheabsenceaccumulatedto3days,theEmployercouldperformtherightandrepatriatetheEmployee.雇員必須服從雇主的領導與管理。對于曠工的雇員,雇主可處以每天50.00新幣的曠工罰款。連續曠工3天者,雇主可以取消其準證并遣送回國。Contractperiod(■■■)Thecontractperiodisfortwo(2)years.Alltheemployeesshallstrictlyfollowthis2years’contractperiod.Otherwise,theEmployeeshallcompensatetotheEmployeraccordingtotherelativeclauseofthisEmploymentContract.本合同雇傭期為兩年,雇員務必嚴格遵守。否則,根據本雇傭合同相應條款,給予雇主補償。Uponcompletionofthefirstyear’semployment,theEmployermayattheirabsolutediscretiondecidenottorenewtheworkpermitforthesecondaryyearwithoutgivinganyreasonandwithoutbeingliableforanycompensationtotheEmployee.在第一年雇傭期滿后,雇主根據工作需要及雇員的工作表現,為雇傭辦理工作準證延期。雇主有權辭退不合格的雇員,而不需給予原因和補償。IftheEmployeerefusestocomplywiththistwo(2)years’contractperiod,theEmployeeshallberesponsibleforhisownrepatriationcoststohisdomicilecountryandallthecompensationtotheEmployerwhichmaybepaidfromtheEmployee’ssalary.如果雇員在雇傭期內拒絕履行為期兩年的雇傭合同,雇員必須自己承擔相關遣返費用和對雇主的賠償。該費用由雇員從其工資中直接支付給雇主。Uponcompletionofthistwoyear’semployment,itcouldbeextendundertheconsensusbetweentheEmployerandtheEmployee.兩年雇傭期滿,如果雇主與雇員雙方同意,可以延長合同期限。WorkPermit(工作準證)TheEmployeeshallhandoverhistravel/passportdocumentsandWorkPermittotheEmployerduringtheemploymentintheRepublicofSingaporeforprocessing.雇員在到達新加坡的雇傭之日起,應將其護照及工作準證等有關證件交給雇主保管。Salary(工資)TheEmployee’ssalaryshallbecalculatedstrictlybasedonpieceworksystem.Pieceworksystemshalladoptthefollowingquotarate(S$)whichmayberevisedoradjustedbytheEmployerattheirabsolutediscretionfromtimetotime.AnyrevisionoradjustmentofthepieceworkratesperunitstatedbelowwillbenotifiedtotheEmployeeasandwhenmadeonthegeneralnoticeboardofeachworksiteandavailablefromthesupervisors:Timberformwork4.00-8.00/m2Metalformwork4.00-8.00/m2Rebar50.00-120.00/tonBricklaying2.00—3.50/m2Plastering1.50—3.00/m2Tiling5.00—8.00/m2Concrete3.00—9.00/m2Basedontheabovepieceworksystem,theEmployee’saverageincomeunderfullattendanceduringthisemploymentperiodshallbeS$1350permonthorevenhigher,providedthattheEmployeecanperformhisdutiescompetentlyandefficientlyandcandeliverthequalifiedproductsaccordingtotheEmployer’srequirementsandassignments.雇員在新加坡的工資收入嚴格按計件工資制計算。計件工資按以下定額單價(新元為單位)執行:木模4.00-8.00/平方米鐵模4.00-8.00/平方米鋼筋50.00-120.00/噸砌磚2.00—3.50/平方米抹灰1.50—3.00/平方米瓷磚5.00—8.00/平方米砼3.00—9.00/平方米雇主將根據實際情況對以上定額單價進行調整和修改并相應通知雇員。在以上定額計價體制下,雇員在確保施工質量并按時完成所分配的工作量的情況下,在雇傭合同期內,全勤雇員的平均每月工資總收入將達到或超過1350新元。Health,Safety&GoodFaith(健康、安全與忠誠)ItshallbethedutyoftheEmployeetotakereasonablecareforhisownhealthandsafetyandthatofotherpersonswhomaybeaffectedbyhisactsoromissionsatworkandtoco-operatewiththeEmployersofarasisnecessarytoperformanydutyortocomplywithanyrequirementonworkplacehealthandsafetyimposedbytheSingaporelawfromtimetotime.雇員有責任在工作時采取一切合理的方法照管好自己和可能受到自己行為影響的周圍其他人員的健康與安全,并配合雇主一切必要的健康與安全的措施和/或遵守新加坡法律針對工作場所而經常制定的健康安全要求。TheEmployeemustcomplyfullywithallhealth,safetyorworkregulationsfromtimetotimeintroducedbytheEmployerandnotifiedtotheEmployee.雇員必須完全遵守雇主制定的關于健康、安全或工作要求等方面的規定。TheEmployeeshalldevotethewholeofhistime,attentionandskillinhisworkinghourstothecompletehisassignedworkortaskinacompetentandefficientmanner.雇員在工作期間必須全力付出,毫無保留地用自己的工作技能來有效地完成雇主所分配的工作內容或任務。TheEmployeeshallnotdirectlyorindirectlycarryonorassistincarryingonorbeemployed,involvedorengagedinanyotherworkorbusinessforanyotherpersoninSingaporeotherthantheEmployerirrespectiveofwhethertheEmployeeispaidorreceivedaremunerationforsuchotherworkorbusiness.雇員不能直接或間接地為除雇主以外的其他任何人從事或涉及任何性質的工作或業務,不管是否從中獲得收益。SicknessorInjury(病假醫療)EveryEmployeeshallnotifyorarrangesomeonetonotifytheEmployeronthefirstdayofeachabsencefromworkorassoonafterasitispracticableandshallstatethereasonforandexpecteddurationoftheabsence.任何雇員如果不能上班,必須在沒有上班的第一天或盡可能最早的時間親自或委托他人通知雇主,并說明不能上班的原因及不能上班的預計天數。Wheretheabsenceisduetoillnessorinjury,theEmployeeshallberequiredtoproduce,withoutdemandbytheEmployer,theoriginalmedicalleavecertificatefromanapprovedhospital,polyclinicormedicalclinicattheendofseven(7)days(orsuchotherperiodasisappropriate)fromthestartoftheabsence.如果雇員因生病或受傷不能上班,必須在從沒有上班的第一天起,7天之內(或其他客觀合理的期限)主動向雇主出示經新加坡批準的醫院或診所等所出具的病假證明,而不需要雇主要求后才出示。TheEmployershallneitherberesponsiblenorliabletopayforanymedicalcharges,feesorexpensesoftheEmployeeinrespecttreatmentforanynonwork-relatedillness,injuryordisabilityoriftheinjury,illnessordisabilityariseoutsidethecourseofemploymentwiththeEmployer,exceptforS$20.00compensationpermonthduringtheemployment.雇員在雇傭期間因非工作性質的疾病或受傷而發生的任何醫藥費或診斷費或治療費等,雇員都應負責支付,雇主在其雇傭期內可以每月給予20新元的醫藥費報銷。雇員不是在本雇傭期內發生的疾病或受傷,所涉及的任何醫藥費或診斷費或治療費等,雇主也不予負責承擔。TheEmployerwillrendersuchreasonableassistancetotheEmployeetomakeaclaimunderthemedicalinsurancecoverageprovidedthattheEmployershallnotbeliabletopayortocompensatetheEmployeeifhisclaimexceedsthelimitoftheinsurancecoverageoriftheclaimisrejectedbytheinsurerforanyreasonwhatsoever.雇主也將為雇員提供合理的協助,以幫助他們在規定的保險范圍內向保險公司進行醫療索賠。但是,如果該醫療索賠超過強制保險規定的范圍或保險公司無論以任何理由拒絕該索賠,雇主不為此承擔任何支付或賠償的責任。GroupPersonalAccidentInsurance■■■■■■ItshallbemandatoryforeveryEmployeetoparticipateinagrouppersonalaccidentinsuranceprogramprovidedbyaninsurancecompanydesignatedbytheEmployerforanydeath,injuryorincapacitysufferedbytheEmployee,whetherwork-relatedorotherwise,forsolongasheremainsanEmployeeoftheEmployerinSingapore.為保障雇員在雇傭期內,無論是否與工作有關而發生意外事故致死或受傷或致殘后能夠有所賠償,雇員須參與雇主在新加坡指定保險公司為雇員投保的一份“人身安全保險計劃”。TheEmployeeherebyauthorizetheEmployertoretainS$100-150(orsuchinsurancepremiumfromtimetotimeasdeterminedbytheEmployer)fromtheEmployee’ssalaryeveryyeartopayfortheinsurancepremiumonbehalfoftheEmployeetothedesignatedinsurancecompany.雇員由此授權雇主每年從工資里保留100-150新元作為保費并由雇主代為支付給指定的保險公司。IndustrialAccident(工傷處理)IftherewasanindustrialaccidenthappenedintheEmployer’sconstructionsiteanditisreportabletoMinistryofManpower,theEmployeeshouldinformtherepresentativesoftheEmployerandtheSafetyOfficer(WorkplaceSafety&HealthOfficer-WSHOfficer)oftheMaincontractorduring24hoursoftheaccidenthappened.ThentheEmployercouldassisttheEmployeetomakeaclaimunderworkmencompensationpolicytocoverhisinjuryanddisability.如果雇員確實在雇主的工地發生工傷并需通報人力部,應在24小時內通知雇主的代表和主包的安全官,雇主根據相關程序協助雇員進行工傷索賠,以保護雇員因工作而導致的受傷或傷殘等。TheEmployeeagreesandundertakesto:(雇員同意并承諾:)givewrittennoticeofanyinjuryorillnesssufferedbytheEmployeeinanyindustrialaccidentduringthecourseofhisemploymentonthedayoftheindustrialaccidentitselforassoonafterasitispracticable(notmorethanthreedays)totheEmployer;在工傷或工作疾病發生的當天或盡可能最早的時間內(不超過三天),■■通知雇主;fullyco-operatewithanyinvestigationintotheindustrialaccidentcarriedoutorconductedbytheEmployer;全力配合雇主為此工傷所進行的調查;givefullandfrankdisclosuretotheEmployerofallinformationandcircumstancesconcerningtheindustrialaccidentandtoidentifyanddisclosethenameofalleyewitnesses,ifany.全面而真實地告訴雇主所有與該工傷有關的信息和當時的工作環境。如果有目擊證人,必須全部列出;TheEmployeemuststrictlycomplywithalltheEmployer’srulesandregulationsinrespectofindustrialaccidentstatedinAnnexAfailingwhichtheEmployermayattheirabsolutediscretiontakeappropriatedisciplinaryaction.雇員發生工傷后,必須嚴格遵守雇主為工傷管理制定的相關規章制度(詳見附件A)。如果違犯,雇主將采取一切合適的紀律處罰措施。Employee’sSavingsScheme(雇員托存款)TheEmployeeherebyirrevocablyandunconditionallyauthorizestheEmployertoretainasumofmoneyfromhissalaryeverymonthascompulsorysavingfortheEmployeeinthefollowingmanner:雇員特此授權雇主按照以下方式每月從其工資中留存部分數額作為必需的托存款。本授權不可撤回和無條件執行。TheEmployeeherebyirrevocablyauthorizesandempowerstheEmployertodealwiththecompulsorysavingoftheEmployeeinthefollowingorderofpriority:雇員特此授權雇主按照以下優先順序處理以上必需的托存款。本授權不可撤回和無條件執行。topayincometax,ifany,imposedontheEmployeebytheSingaporetaxauthority;支付新加坡政府要求的個人所得稅(如果有);topayanyindebtednesshowsoeverarisingduefromtheEmployeetotheEmployerwhichmayincludebutnotlimitedtoaccommodationand/orutilitiesservicesprovided,medicalfees/chargespaidbytheEmployeronbehalfoftheEmployee(ifany),advancesorloansoradjustmentofover-paymentofsalary(ifany),repatriationcostsoranylossanddamagesufferedbytheEmployerarisingfromanybreachoftheemploymentcontractbytheEmployee支付雇主以下費用(但不限于):住宿水電費;雇主代雇員墊付的本應由雇員自己承擔的醫療費(如果有);雇員借款或雇主預發或多發的工資(如果有);雇員違犯雇傭合同相關條款而給雇主造成的損失(如果有)等。Repatriation(送返)Uponthesuccessfulcompletionofthistwo(2)years’employmentcontractbytheEmployeewithoutcommittinganybreachoftheemploymentcontract,theEmployerundertakestobeartheair-ticketcostsoftheEmployeetohisdomicilecountryprovided.Andthearrivalplaceshouldbedecidedbytheemployer.Thetransportfeefromairportinhisdomicilecountrytotheoriginalresidentialplaceshallbebornbytheemployeehimself.雇員完整履行兩年的雇傭合同后,雇主將負責安排機票,將雇員送回國。但降落機場由雇主根據當時的實際情況決定,從國內機場至國內居住地的交通費由雇員承擔。TerminationGenerally(終止合同)IftheEmployeeterminatestheemploymentcontractatanytimebeforetheexpiryofthistwo-yearcontractduetohisownvolition,orhisneglect,defaultormisconductoriftheEmployeeisdeportedbytheSingaporeauthorityduetohisowndefaultorneglectoriftheworkpermitoftheEmployeeiscancelledorcannotberenewedduetothedefaultorneglectoftheEmployee,theEmployeeshallbeliableforthelossoftheemployer’s.ThedetailspleaserefertoAnnexA.如果雇員在兩年合同期滿之前任何時候主動終止合同,或由于雇員不能勝任工作或違規犯錯或不正當行為而導致被雇主解雇或被新加坡政府驅逐出境或準證不能延長等,在此情況下,雇員必須賠償雇主。具體細節參照附件A.ReturnoftheEmployer'sbelongings(歸還雇主財物)OncethisContractwasterminated,theEmployeemustreturnallthebelongingsoftheEmployer’s.在雇傭關系終止的同時,雇員必須歸還產權屬于雇主或由雇主提供的一切財物。Terminationformedicalreasons(IfthehealthoftheEmployee,ascertifiedbythemedicalpractitioner,issoimpairedand/orisunfittocarryonwithhisassignedtrade/taskundertheemploymentcontractwithoutanydefaultorneglectonthepartoftheEmployee,theEmployerreservestherighttoterminatethisemploymentagreementwithoutbeingliableforanycompensationtotheEmployee.經醫生證明,雇員因病不能適合正常工作,雇主有權終止合同。DisciplinaryRules(紀律處分)TheEmployeemustatalltimesstrictlyobserveallthetermsandconditionsoftheemploymentcontract,includingbutnotlimitedtoalltherulesandregulationsoftheEmployersetoutinAnnexAwhichmaybeamended,revisedormodifiedbytheEmployerfromtimetotimeandanysuchamendments,revisionsormodificationsshallcontinuetobindtheEmployeeaccordinglyuponnotificationtotheEmployeefromhissupervisorand/orpostedonthenoticeboardatthegeneralofficeoftheworksite.雇員必須嚴格遵守本合同條款,包括附件A中雇主制定的各項規章制度等。雇主將根據實際情況對附件A中的內容進行修改、完善和增補等并將相關內容通知雇員,而這些修改和增補的內容及通知和或/張貼在工地上的通知內容等也同樣對雇員具有約束力。Incasesofseriousmisconductorincompetence,theEmployeemaybedismissedwithoutanyperiodofpriornoticeorwarning.Inothercases,theEmployeewillbegivenanoralwarninginthecaseoffirstoffenceandawrittenwarninginthecaseofasubsequentoffencebeforebeingdismissed.如果雇員有嚴重不當行為或嚴重不能勝任工作,雇主將即刻解雇雇員而不需要提前警告或通知。但在一般違規情況下,雇主將第一次口頭警告和第二次書面警告,在此之后雇員如果繼續再犯,將被解雇。TheEmployeemaybesuspendedfromemploymentwithoutpayasanalternativetodismissalorduringtheinvestigationofanyallegedmisconductorincompetence.作為雇主終止合同的替代辦法,雇主可對雇員處以停工,或在調查雇員不當行為或不能勝任工作的具體情況期間要求雇員停工。在停工期間雇員沒有工資。TheEmployermaytakesomedisciplinaryactionotherthandismissalsuchassuspensionwithoutpay,demotion,withdrawalorsuspensionofsubsidizedaccommodation,foodandutilitiesservices,transfertosomeotherplaceortypeofworkorlossofallowances,privileges,etc.雇主對違規雇員除采取解雇的處罰方式以外,還可以對其處以紀律處分,譬如無薪停工,降級,取消住宿、水電及設施津貼,調換工地或工作性質,取消各項津貼或待遇等。Withoutprejudicetothegeneralityoftheaboveandwithoutsettingoutacomprehensivedefinitionoftheexpression,seriousmisconductbytheEmployeemayinclude:一般情況下,雇員嚴重不當行為主要包括:theftorreasonablesuspicionoftheftorothercriminaloffence偷竊或任何違法行為-breachesofworkplacesafetyandhealthrulesandregulations違反工地健康及安全條規breachesoffireandsafetyregulations違反消防及安全條規smokinginanareanotdesignatedforsmoking在禁煙區域吸煙assault,fighting,strike,rioting,disorderlybehaviour,gambling,immoralactivityorprostitutionnearoronthepremisesoftheEmployerortheworkplaceortheworksite打架斗毆,游行示威,罷工,暴動,行為不軌,非法賭博,不道德行為或在雇主工作場所或提供的宿舍或工地等附近嫖妓等beingundertheinfluenceofalcoholordrugswhileatworkoronornearthepremisesoftheEmployerortheworkplaceortheworksite在雇主工作場所或工地或住宿酗酒或吸毒等beingissuedWarningLetterbytheEmployer接獲雇主警告信timekeepingoffences多次反復違規犯錯wilfulneglectinthedischargeofduties工作玩忽職守wilfuldisobedienceofproperandreasonableinstructions不服從合理指示workingillegallyinSingaporeotherthanfortheEmployerincontraventionofSingaporelaw為雇主以外的任何人員打黑工,違反新加坡法律seriousorpersistentbreachoftheseterms嚴重或反復違反以上條款等AnoralwarningmaybegivenbytheimmediatesupervisoroftheEmployee.Writtenwarningswillbegivenbyeithertheprojectmanagerortheprojectdirector.DismissalorothermajordisciplinaryactionwillbemadebytheOfficeoftheEmployer.口頭警告由雇員的直接上司發出,書面警告由雇員的項目經理或項目董事發出,解雇或其他嚴重違紀違規行為,其處罰由雇主的辦公室發出。Precedent&Severance(優先和異議)IntheeventofanyinconsistenciesorconflictbetweentheEnglishandChinesetranslatedversionsofanytermsandconditionsoftheemploymentagreement,theEnglishversionshalltakeprecedence.本合同條款均有中英文對照翻譯,如有不符,以英
