2、ons,rBtheprinciplesofequality,freewill,goodfaith,compliancewithlawandmutualnegotiation,PartyAandPartyBherebyenterintothisContractandagreetojointlyabidebythetermsandconditionscontainedherein.Article 1 ContractTerm1.1 BothPartiesagreetodeterminethetermofthisContractbyofthefollowingmethods:1.1.1 Fixedt

3、erm:fromto.1.1.2 Unfixedterm:o1.1.3 Completionofcertainworkastheterm:fromtocompletionofwork.Thestandardoncompletionoftheworkshallbe.1.2 Theprobationperiodshallbenone(theprobationperiodshallbeincludedinthetermofthisContract.Incaseofnoprobationperiod,fill“none"intheblank).Article 2 ContentsofWork

4、ThePartyBshallactas(positionortypeofwork)salesengineer,whoshallberesponsibleforsaleofprintingequipmentoftheplasticpackingdepartmentofPartyAandotherworkinChina,andshallreporttotherelevantresponsiblepersonsofSwissHeadquartersandThailandBranchCompany.Article 3 WorkingTime3.1 Standardworkingtimesystemsh

5、allbeadoptedforPartyB,thatis,PartBshallwork8hoursperdayand5daysperweek,withoutadditionalremunerationforovertimework.3.2 AnyextensionofworktimeasrequiredbyPartyAproductionandoperationshallbegovernedbyArticle41oftheLaborLaw.Article 4 SalaryandTreatment4.1 PartyAshallformulatethesalarysystemaccordingto

6、lawandnotifyPartyBthereof.ThesalarypaidbyPartyAtoPartyBshallnotbelowerthantheminimumsalaryissuedbythelocalmunicipalgovernmentinthatyear.4.2 ThemonthlysalaryofPartyBshallbeRMB。4.3 PartyAshallpaythesalarytoPartyBonthe30thdayofeachmonth.PartyAshallpaytoPartyBthesalaryatleastonceineachmonthbymeansofcurr

7、ency.4.4 Theovertimesalary,salaryduringvacation,leaveandparticularcircumstancesshallbegovernedbytherelevantlawsandregulations,suchastheRegulationsofShenzhenRegardingPaymentofEmployeesSalaries.4.5 OtherprovisionsonsalaryasagreedbybothParties:withinthevalidtermofthisContract,performancebonusshallbedet

8、erminedbasedonthenetsalepriceofequipment(i.e.,thepriceafterthefreightandtheexpensesforinstallationandcommissioningarededucted).Thecontractsforsaleofsparepartsandcomponentsandforinstallationshallnotbeincludedintheplanonperformancebonus.Article 5 LaborProtectionandLaborConditions5.1 PartyAshall,inacco

9、rdancewiththerelevantprovisionsonlaborprotectionoftheState,providethelaborandoperationplacesandnecessarylaborprotectivearticlesinconformitywiththehealthstandardsoftheState,soastopracticablyensurethesafetyandhealthofPartyBintheproductionandwork.5.2 PartyBwillbeengagedintheoperationof/thatmaycausethep

10、rofessionaldangerof/,so,PartyAshalltaketheprotectivemeasuresof/andarrangePartyBformedicalcheck/timeeachyear.5.3 PartyBshallhavetherighttorefusetooperateifPartyAcommandstheoperationinviolationofrulesandregulationsorforcesPartyBtorunrisksinoperation;PartyBshallhavetherighttorequirePartyAtorectifytheac

11、tsofPartyAendangeringthesafetyofhislifeandhealthorreportsuchcasetothecompetentdepartments.Article 6 SocialInsuranceandWelfare6.1 PartyAshallhandletheproceduresforsocialinsuranceforPartyBaccordingtolaw,andthepaymentofsocialinsurancepremiumshallbegovernedbythelaws,regulationsandrulesregardingsocialins

12、urance.6.2 IfPartyBissickorsuffersjob-unrelatedinjury,PartyAshallprovidethemedicaltreatmentperiodandmedicaltreatmentinaccordancewithrelevantprovisionsoftheState.6.3 IfPartyBcontractsanoccupationaldisease,orsuffersjob-relatedinjuryordeath,PartyAshallhandlethecaseinaccordancewiththerelevantlawsandregu

13、lationssuchastheLawonPreventionfromandTreatmentofOccupationalDiseaseandtheRegulationsonJob-RelatedInsurance.6.4 PartyBshallbeentitledtolegalholidays,annualvacation,marriageleave,maternityleaveandfuneralleave,etc.,accordingtolaw.Article 7 LaborDiscipline7.1 TherulesandregulationsformulatedbyPartyAacc

14、ordingtolawshallbemadepublicandnotifiedtoPartyB.7.2 PartyBshallconsciouslyabidebytherelevantlawsandregulationsatthelevelofState,provinceandcityandtherulesandregulationsformulatedbyPartyAaccordingtolaw,complywiththeoperationregulationsinsafety,besubjecttothemanagementoftheCompany,andcompletehisworkin

15、gtaskstimely.7.3 PartyBshallconsciouslyabidebytheprovisionsonfamilyplanatthelevelofState,provinceandcity.Article 8 ChangeThisContractmaybechangeduponagreementreachedbybothPartiesthroughconsultation.AnychangeofthisContractshallbehandledinwriting.Article 9 Revocation9.1 PriortoexpirationofthisContract

16、,anyrevocationofthisContractbybothPartiesoreitherpartyinadvanceshallcomplywiththerelevantprovisionsofthelawsandregulations.9.2 Iftheconditionsonpaymentofeconomiccompensationaremet,PartyAshallpaytoPartyBtheeconomiccompensationaccordingtolaw.9.3 IfthisContractisrevokedbybothParties,PartyAshallprovidea

17、writtencertificatetoPartyB,andtimelyhandletherelevantproceduresforrevocationofthisContract.Article 10 Termination10.1 UponexpirationofthisContractorsatisfactionoftheconditionsonterminationofthisContractasagreedbybothParties,thisContractshallbeterminated.Incaseofsuchtermination,PartyAshallprovideawri

18、ttencertificatetoPartyB,andtimelyhandletherelevantproceduresforterminationofthisContract.10.2 IfbothPartiesagreetorenewthisContractuponexpirationofthisContract,therelevantproceduresshallbehandledwithin30dayspriortoexpirationofthisContract.Article 11 LiabilityforBreachofContract11.1 PartyAsliabilityf

19、orbreachofcontract:.11.2 PartyBsliabilityforbreachofcontract:Article 12 DisputeResolutionAnylabordisputebetweenbothPartiesshallberesolvedthroughconsultation,failingwhich,itmaybesubmittedtotheLaborDisputeMediationCommitteeoftheCompanyformediation,oritmaybesubmitteddirectlytotheLaborDisputeArbitration

20、Committeeforarbitration.Incaseofnoobjectiontothearbitrationaward,bothPartiesmustperformtheaward;shouldtherebeanyobjectiontotheaward,eitherpartymaybringalawsuitinthepeoplescourt.Article 13 OtherMattersRequiredtobeAgreedbybothParties:TheinformationontheclientsandthebusinesssecretsoftheCompanyshallnotbedisclosedtoanythirdpa
