Mission6ValueInsuredRailTraffic陳斌ChenBinProject5HandlingofFreightLossThecarriershouldbeliableforloss,deficiency,deterioration,pollutionanddamageoftheinsuredfreight承運人從承運貨物時起，至將貨物交付收貨人時止，對保價貨物發生的滅失、短少、變質、污染、損壞承擔賠償責任，但由于下列原因造成的,承運人fromcarriageofthefreighttodeliveryofthefreight.不承擔賠償責任Butthecarriershallnotbeliableforanyofthefollowingcauses:一、保價責任范圍與免責條款TheResponsibilitiesandExceptionsforValueInsuredRailFreight1.不可抗力1.Forcemajeure.2.貨物本身的自然屬性或合理損耗2.Naturalpropertiesofthefreightorreasonablewearandtear.3.托運人收貨人或押運人的過錯3.Mistakesmadebyconsigneesorescorts.知識點二保價賠償與限額賠償KnowledgepointⅡValueInsuredCompensationandLimitedCompensation辦理保價運輸的貨物按保價賠償Insuredfreightshouldbecompensatedaccordingtotheinsuredvalueofthefreight.Accordingtotheactualloss,thecompensationshouldnotexceedtheinsuredvalueofthefreight.按照實際損失賠償，最高不超過保價金額不受保價額的限制，按照實際損失賠償thecompensationshouldbemadeaccordingtotheactuallosswithoutlimitsofinsuredvalue.二、保價賠償Ⅱ.

CompensationofInsuredFreightIfthelossiscausedintentionallyorcausedduetogrossnegligenceoftherailwaytransportenterprises,如果損失是鐵路運輸企業的故意或者重大過失造成的Incaseofpartialloss,compensationshouldbemadeaccordingtotheproportionofthelostfreightinthewholefreightmultiplyingtheinsuredvalue.部分損失時,按損失貨物占全批貨物的比例乘以保價金額賠償Ifthecompensationfailstobepaidwithintimelimit,thestationshouldpaycompensationtotheclaimant.逾期未能賠付時,處理站應向賠償要求人支付違約金知識點二保價賠償與限額賠償KnowledgepointⅡValueInsuredCompensationandLimitedCompensation不辦理保價運輸的貨物按限額賠償Non-insuredfreightshouldbecompensatedaccordingtolimitedcompensation.Themaximumcompensationis100yuanpertonforfreightcarriedbyweight.按重量承運的貨物，每噸最高賠償100元按照實際損失賠償，由鐵路運輸企業承擔Thecompensationshouldbemadebyrailtransportenterprisesaccordingtotheactuallossofthefreight.三、限額賠償Ⅲ.LimitedCompensation知識點二保價賠償與限額賠償KnowledgepointⅡValueInsuredCompensationandLimitedCompensationThemaximumcompensationis2000yuanpertonforfreightcarriedbyweightandnumberofpackages.按件數和重量承運，每噸最高賠償2000元Ifthelossiscausedintentionallyorcausedduetogrossnegligenceoftherailwaytransportenterprises,itisbeyondtherulesoflimitedcompensation.如果損失是鐵路運輸企業的故意或者重大過失造成的，不適用賠償限額的規定實際損失低于賠償限額時,按貨物實際損失價格賠償Iftheactuallossislesst
