fUCP500,theintroductionoftheICC’sDocumentaryCreditDisputeResolutionExpertiseRules(DOCDEX)inOctober1997(subsequentlyrevisedinMarch2002)hasresultedinmorethan60casesbeingdecided.Toaddresstheseandotherconcerns,theBankingCommissionestablishedaDraftingGrouptoreviseUCP500.Itwasalsodecidedtocreateasecondgroup,knownastheConsultingGroup,toreviewandadviseonearlydraftssubmittedbytheDraftingGroup.TheConsultingGroup,madeupofover40individualsfrom26countries,consistedofbankingandtransportindustryexperts.Ablyco-chairedbyJohnTurnbull,DeputyGeneralManager,SumitomoMitsuiBankingCorporationEuropeLtd,LondonandCarloDiNinni,Adviser,ItalianBankersAssociation,Rome,theConsultingGroupprovidedvaluableinputtotheDraftingGrouppriortoreleaseofdrafttextstoICCnationalcommittees.TheDraftingGroupbeganthereviewprocessbyanalyzingthecontentoftheofficialOpinionsissuedbytheBankingCommissionunderUCP500.Some500Opinionswerereviewedtoassesswhethertheissuesinvolvedwarrantedachangein,anadditiontooradeletionofanyUCParticle.Inaddition,considerationwasgiventothecontentofthefourPositionPapersissuedbytheCommissioninSeptember1994,thetwoDecisionsissuedbytheCommission(concerningtheintroductionoftheeuroandthedeterminationofwhatconstitutedanoriginaldocumentunderUCP500sub-article20(b)andthedecisionsissuedinDOCDEXcases.Duringtherevisionprocess,noticewastakenoftheconsiderableworkthathadbeencompletedincreatingtheInternationalStandardBankingPracticefortheExaminationofDocumentsunderDocumentaryCredits(ISBP),ICCPublication645.ThispublicationhasevolvedintoanecessarycompaniontotheUCPfordeterminingcomplianceofdocumentswiththetermsoflettersofcredit.ItistheexpectationoftheDraftingGroupandtheBankingCommissionthattheapplicationoftheprinciplescontainedintheISBP,includingsubsequentrevisionsthereof,willcontinueduringthetimeUCP600isinforce.AtthetimeUCP600isimplemented,therewillbeanupdatedversionoftheISBPtobringitscontentsinlinewiththesubstanceandstyleofthenewrules.ThefourPositionPapersissuedinSeptember1994wereissuedsubjecttotheirapplicationunderUCP500;therefore,theywillnotbeapplicableunderUCP600.TheessenceoftheDecisioncoveringthedeterminationofanoriginaldocumenthasbeenincorporatedintothetextofUCP600.TheoutcomeoftheDOCDEXcaseswereinvariablybasedonexistingICCBankingCommissionOpinionsandthereforecontainednospecificissuesthatrequiredaddressingintheserules.OneofthestructuralchangestotheUCPistheintroductionofarticlescoveringdefinitions(article2)andinterpretations(article3).Inprovidingdefinitionsofrolesplayedbybanksandthemeaningofspecifictermsandevents,UCP600avoidsthenecessityofrepetitivetexttoexplaintheirinterpretationandapplication.Similarly,thearticlecoveringinterpretationsaimstotaketheambiguityoutofvagueorunclearlanguagethatappearsinlettersofcreditandtoprovideadefinitiveelucidationofothercharacteristicsoftheUCPorthecredit.Duringthecourseofthelastthreeyears,ICCnationalcommitteeswerecanvassedonarangeofissuestodeterminetheirpreferencesonalternativetextssubmittedbytheDraftingGroup.TheresultsofthisexerciseandtheconsiderableinputfromnationalcommitteesonindividualitemsinthetextisreflectedinthecontentofUCP600.TheDraftingGroupconsidered,notonlythecurrentpracticerelativetothedocumentarycredit,butalsotriedtoenvisagethefutureevolutionofthatpractice.ThisrevisionoftheUCPrepresentstheculminationofoverthreeyearsofextensiveanalysis,review,debateandcompromiseamongstthevariousmembersoftheDraftingGroup,themembersoftheBankingCommissionandtherespectiveICCnationalcommittees.ValuablecommenthasalsobeenreceivedfromtheICCCommissiononTransportandLogistics,theCommissiononCommercialLawandPracticeandtheCommitteeonInsurance.Itisnotappropriateforthispublicationtoprovideanexplanationastowhyanarticlehasbeenwordedinsuchawayorwhatisintendedbyitsincorporationintotherules.ForthoseinterestedinunderstandingtherationaleandinterpretationofthearticlesofUCP600,thisinformationwillbefoundintheCommentarytotherules,ICCPublication601,whichrepresentstheDraftingGroup’sviews.OnbehalfoftheDraftingGroupIwouldliketoextendourdeepappreciationtothemembersoftheConsultingGroup,ICCnationalcommitteesandmembersoftheBankingCommissionfortheirprofessionalcommentsandtheirconstructiveparticipationinthisprocess.SpecialthanksareduetothemembersoftheDraftingGroupandtheirinstitutions,whoarelistedbelowinalphabeticalorder.NicoleKeller-VicePresident,ServiceInternationalProducts,DresdnerBankAG,Frankfurt,Germany;RepresentativetotheICCCommissiononBankingTechniqueandPractice;LaurenceKooy-LegalAdviser,BNPParibas,Paris,France;RepresentativetotheICCCommissiononBankingTechniqueandPractice.KatjaLehr-BusinessManager,TradeServicesStandards,SWIFT,LaHulpe,Belgium,thenVicePresident,MembershipRepresentation,InternationalFinancialServicesAssociation,NewJersey,USA;RepresentativetotheICCCommissiononBankingTechniqueandPractice;OleMalmqvist-VicePresident,DanskeBank,Copenhagen,Denmark;RepresentativetotheICCCommissiononBankingTechniqueandPractice;PaulMiserez-HeadofTradeFinanceStandards,SWIFT,LaHulpe,Belgium;RepresentativetotheICCCommissiononBankingTechniqueandPractice;ReneMueller-Dir bysuchcontract,evenifanyreferencewhatsoevertoitisincludedinthecredit.Consequently,theundertakingofabanktohonour,tonegotiateortofulfilanyotherobligationunderthecreditisnotsubjecttoclaimsordefencesbytheapplicantresultingfromitsrelationshipswiththeissuingbankorthebeneficiary.Abeneficiarycaninnocaseavailitselfofthecontractualrelationshipsexistingbetweenbanksorbetweentheapplicantandtheissuingbank.Anissuingbankshoulddiscourageanyattemptbytheapplicanttoinclude,asanintegralpartofthecredit,copiesoftheunderlyingcontract,proformainvoiceandthelike.Documentsv.Goods,ServicesorPerformanceBanksdealwithdocumentsandnotwithgoods,servicesorperformancetowhichthedocumentsmayrelate.Availability,ExpiryDateandPlaceforPresentationAcreditmuststatethebankwithwhichitisavailableorwhetheritisavailablewithanybank.Acreditavailablewithanominatedbankisalsoavailablewiththeissuingbank.Acreditmuststatewhetheritisavailablebysightpayment,deferredpayment,acceptanceornegotiation.Acreditmustnotbeissuedavailablebyadraftdrawnontheapplicant.i.Acreditmuststateanexpirydateforpresentation.Anexpirydatestatedforhonourornegotiationwillbedeemedtobeanexpirydateforpresentation.Theplaceofthebankwithwhichthecreditisavailableistheplaceforpresentation.Theplaceforpresentationunderacreditavailablewithanybankisthatofanybank.Aplaceforpresentationotherthanthatoftheissuingbankisinadditiontotheplaceoftheissuingbank.Exceptasprovidedinsub-article29(a),apresentationbyoronbehalfofthebeneficiarymustbemadeonorbeforetheexpirydate.IssuingBankUndertakingProvidedthatthestipulateddocumentsarepresentedtothenominatedbankortotheissuingbankandthattheyconstituteacomplyingpresentation,theissuingbankmusthonourifthecreditisavailableby:sightpayment,deferredpaymentoracceptancewiththeissuingbank;sightpaymentwithanominatedbankandthatnominatedbankdoesnotpay;deferredpaymentwithanominatedbankandthatnominatedbankdoesnotincuritsdeferredpaymentundertakingor,havingincurreditsdeferredpaymentundertaking,doesnotpayatmaturity;acceptancewithanominatedbankandthatnominatedbankdoesnotacceptadraftdrawnonitor,havingacceptedadraftdrawnonit,doesnotpayatmaturity;negotiationwithanominatedbankandthatnominatedbankdoesnotnegotiate.Anissuingbankisirrevocablyboundtohonourasofthetimeitissuesthecredit.Anissuingbankundertakestoreimburseanominatedbankthathashonouredornegotiatedacomplyingpresentationandforwardedthedocumentstotheissuingbank.Reimbursementfortheamountofacomplyingpresentationunderacreditavailablebyacceptanceordeferredpaymentisdueatmaturity,whetherornotthenominatedbankprepaidorpurchasedbeforematurity.Anissuingbank'sundertakingtoreimburseanominatedbankisindependentoftheissuingbank’sundertakingtothebeneficiary.ConfirmingBankUndertakingProvidedthatthestipulateddocumentsarepresentedtotheconfirmingbankortoanyothernominatedbankandthattheyconstituteacomplyingpresentation,theconfirmingbankmust:honour,ifthecreditisavailablebysightpayment,deferredpaymentoracceptancewiththeconfirmingbank;sightpaymentwithanothernominatedbankandthatnominatedbankdoesnotpay;deferredpaymentwithanothernominatedbankandthatnominatedbankdoesnotincuritsdeferredpaymentundertakingor,havingincurreditsdeferredpaymentundertaking,doesnotpayatmaturity;acceptancewithanothernominatedbankandthatnominatedbankdoesnotacceptadraftdrawnonitor,havingacceptedadraftdrawnonit,doesnotpayatmaturity;negotiationwithanothernominatedbankandthatnominatedbankdoesnotnegotiate.negotiate,withoutrecourse,ifthecreditisavailablebynegotiationwiththeconfirmingbank.Aconfirmingbankisirrevocablyboundtohonourornegotiateasofthetimeitaddsitsconfirmationtothecredit.Aconfirmingbankundertakestoreimburseanothernominatedbankthathashonouredornegotiatedacomplyingpresentationandforwardedthedocumentstotheconfirmingbank.Reimbursementfortheamountofacomplyingpresentationunderacreditavailablebyacceptanceordeferredpaymentisdueatmaturity,whetherornotanothernominatedbankprepaidorpurchasedbeforematurity.Aconfirmingbank'sundertakingtoreimburseanothernominatedbankisindependentoftheconfirmingbank’sUndertakingtothebeneficiary.Ifabankisauthorizedorrequestedbytheissuingbanktoconfirmacreditbutisnotpreparedtodoso,itmustinformtheissuingbankwithoutdelayandmayadvisethecreditwithoutconfirmation.AdvisingofCreditsandAmendmentsAcreditandanyamendmentmaybeadvisedtoabeneficiarythroughanadvisingbank.Anadvisingbankthatisnotaconfirmingbankadvisesthecreditandanyamendmentwithoutanyundertakingtohonourornegotiate.Byadvisingthecreditoramendment,theadvisingbanksignifiesthatithassatisfieditselfastotheapparentauthenticityofthecreditoramendmentandthattheadviceaccuratelyreflectsthetermsandconditionsofthecreditoramendmentreceived.Anadvisingbankmayutilizetheservicesofanotherbank(“secondadvisingbank”)toadvisethecreditandanyamendmenttothebeneficiary.Byadvisingthecreditoramendment,thesecondadvisingbanksignifiesthatithassatisfieditselfastotheapparentauthenticityoftheadviceithasreceivedandthattheadviceaccuratelyreflectsthetermsandconditionsofthecreditoramendmentreceived.Abankutilizingtheservicesofanadvisingbankorsecondadvisingbanktoadviseacreditmustusethesamebanktoadviseanyamendmentthereto.Ifabankisrequestedtoadviseacreditoramendmentbutelectsnottodoso,itmustsoinform,withoutdelay,thebankfromwhichthecredit,amendmentoradvicehasbeenreceived.Ifabankisrequestedtoadviseacreditoramendmentbutcannotsatisfyitselfastotheapparentauthenticityofthecredit,theamendmentortheadvice,itmustsoinform,withoutdelay,thebankfromwhichtheinstructionsappeartohavebeenreceived.Iftheadvisingbankorsecondadvisingbankelectsnonethelesstoadvisethecreditoramendment,itmustinformthebeneficiaryorsecondadvisingbankthatithasnotbeenabletosatisfyitselfastotheapparentauthenticityofthecredit,theamendmentortheadvice.AmendmentsExceptasotherwiseprovidedbyarticle38,acreditcanneitherbeamendednorcancelledwithouttheagreementoftheissuingbank,theconfirmingbank,ifany,andthebeneficiary.Anissuingbankisirrevocablyboundbyanamendmentasofthetimeitissuestheamendment.Aconfirmingbankmayextenditsconfirmationtoanamendmentandwillbeirrevocablyboundasofthetimeitadvisestheamendment.Aconfirmingbankmay,however,choosetoadviseanamendmentwithoutextendingitsconfirmationand,ifso,itmustinformtheissuingbankwithoutdelayandinformthebeneficiaryinitsadvice.Thetermsandconditionsoftheoriginalcredit(oracreditincorporatingpreviouslyacceptedamendments)willremaininforceforthebeneficiaryuntilthebeneficiarycommunicatesitsacceptanceoftheamendmenttothebankthatadvisedsuchamendment.Thebeneficiaryshouldgivenotificationofacceptanceorrejectionofanamendment.Ifthebeneficiaryfailstogivesuchnotification,apresentationthatcomplieswiththecreditandtoanynotyetacceptedamendmentwillbedeemedtobenotificationofacceptancebythebeneficiaryofsuchamendment.Asofthatmomentthecreditwillbeamended.Abankthatadvisesanamendmentshouldinformthebankfromwhichitreceivedtheamendmentofanynotificationofacceptanceorrejection.Partialacceptanceofanamendmentisnotallowedandwillbedeemedtobenotificationofrejectionoftheamendment.Aprovisioninanamendmenttotheeffectthattheamendmentshallenterintoforceunlessrejectedbythebeneficiarywithinacertaintimeshallbedisregarded.TeletransmittedandPre-AdvisedCreditsandAmendmentsAnauthenticatedteletransmissionofacreditoramendmentwillbedeemedtobetheoperativecreditoramendment,andanysubsequentmailconfirmationshallbedisregarded.Ifateletransmissionstates"fulldetailstofollow"(orwordsofsimilareffect),orstatesthatthemailconfirmationistobetheoperativecreditoramendment,thentheteletransmissionwillnotbedeemedtobetheoperativecreditoramendment.Theissuingbankmustthenissuetheoperativecreditoramendmentwithoutelayintermsnotinconsistentwiththeteletransmission.Apreliminaryadviceoftheissuanceofacreditoramendment(“pre-advice”)Shallonlybesentiftheissuingbankispreparedtoissuetheoperativecreditoramendment.Anissuingbankthatsendsapre-adviceisirrevocablycommittedtoissuetheoperativecreditoramendment,withoutdelay,intermsnotinconsistentwiththepre-advice.NominationUnlessanominatedbankistheconfirmingbank,anauthorizationtohonourornegotiatedoesnotimposeanyobligationonthatnominatedbanktohonourornegotiate,exceptwhenexpresslyagreedtobythatnominatedbankandsocommunicatedtothebeneficiary.Bynominatingabanktoacceptadraftorincuradeferredpaymentundertaking,anissuingbankauthorizesthatnominatedbanktoprepayorpurchaseadraftacceptedoradeferredpaymentundertakingincurredbythatnominatedbank.Receiptorexaminationandforwardingofdocumentsbyanominatedbankthatisnotaconfirmingbankdoesnotmakethatnominatedbankliabletohonourornegotiate,nordoesitconstitutehonourornegotiation.Bank-to-BankReimbursementArrangementsIfacreditstatesthatreimbursementistobeobtainedbyanominatedbank("claimingbank")claimingonanotherparty("reimbursingbank"),thecreditmuststateifthereimbursementissubjecttotheICCrulesforbank-to-bankreimbursementsineffectonthedateofissuanceofthecredit.IfacreditdoesnotstatethatreimbursementissubjecttotheICCrulesforbankto-bankreimbursements,thefollowingapply:Anissuingbankmustprovideareimbursingbankwithareimbursementauthorizationthatconformswiththeavailabilitystatedinthecredit.Thereimbursementauthorizationshouldnotbesubjecttoanexpirydate.Aclaimingbankshallnotberequiredtosupplyareimbursingbankwithacertificateofcompliancewiththetermsandconditionsofthecredit.Anissuingbankwillberesponsibleforanylossofinterest,togetherwithanyexpensesincurred,ifreimbursementisnotprovidedonfirstdemandbyareimbursingbankinaccordancewiththetermsandconditionsofthecredit.Areimbursingbank'schargesarefortheaccountoftheissuingbank.However,ifthechargesarefortheaccountofthebeneficiary,itistheresponsibilityofanissuingbanktosoindicateinthecreditandinthereimbursementauthorization.Ifareimbursingbank'schargesarefortheaccountofthebeneficiary,theyshallbedeductedfromtheamountduetoaclaimingbankwhenreimbursementismade.Ifnoreimbursementismade,thereimbursingbank'schargesremaintheobligationoftheissuingbank.Anissuingbankisnotrelievedofanyofitsobligationstoprovidereimbursementifreimbursementisnotmadebyareimbursingbankonfirstdemand.StandardforExaminationofDocumentsa.Anominatedbankactingonitsnomination,aconfirmingbank,ifany,andtheissuingbankmustexamineapresentationtodetermine,onthebasisofthedocumentsalone,whetherornotthedocumentsappearontheirfacetoConstituteacomplyingpresentation.b.Anominatedbankactingonitsnomination,aconfirmingbank,ifany,andtheissuingbankshalleachhaveamaximumoffivebankingdaysfollowingthedayofpresentationtodetermineifapresentationiscomplying.Thisperiodisnotcurtailedorotherwiseaffectedbytheoccurrenceonorafterthedateofpresentationofanyexpirydateorlastdayforpresentation.Apresentationincludingoneormoreoriginaltransportdocumentssubjecttoarticles19,20,21,22,23,24or25mustbemadebyoronbehalfofthebeneficiarynotlaterthan21calendardaysafterthedateofshipmentasdescribedintheserules,butinanyeventnotlaterthantheexpirydateofthecredit.Datainadocument,whenreadincontextwiththecredit,thedocumentitselfandinternationalstandardbankingpractice,neednotbeidenticalto,butmustnotconflictwith,datainthatdocument,anyotherstipulateddocumentorthecredit.Indocumentsotherthanthecommercialinvoice,thedescriptionofthegood
