1、集裝箱租賃合同操作務集裝箱租賃合同是規租箱人與租箱公司雙方權利、義 務和費用的協議和合文本。租箱人在簽署合同之前一般要 與租箱公司或其代理)商租箱方式量租, 交還 期,地點,租、退箱損害理責任及保險等事宜。租箱 合同的主要條款一般 個面內容。交箱條款交箱條款主要是制約箱公司的條款,是指租箱公司應 在合同規定的時間和點將答合合同條件的集裝箱交給租 箱人。其內容主要有交箱期是指租箱公將箱子交給租箱人的時間為 了給雙方都提供一些便箱通常規定一個期限 ,般為 730 天交箱量。為了適應市上箱,貨供求關系的變化,合 同中對交箱量有兩種定方法是規定的交箱數量(或 低交箱)另一種是際交箱量 ( 可高于或低于
2、前者 )。交箱時箱子狀況箱公司交給租箱人的箱子應符合 有關國際公約與標準規定,同時租和相人還箱時應保證箱子保持和接近原來的況了證這一點 雙方在箱時箱 子的狀況是通過雙方署的設備交接單來體現的。在具體操 作,規定租箱人雇的司機和箱子所在堆場的箱管 ,門衛 可作為雙方代表簽署備交接單。還箱條款租箱合同中的還箱條主要是制約租箱人的條款,是指 租箱人應在租用期滿,按合同規定的時間,地點將狀況良 好的箱子還給租箱公。其主要內容為:還箱時間。指規定的箱日期。如超期還箱,合同一 般通過對超期天數加租金方式解決;如果可能提前還箱, 則要求事先訂立提前止條款,定有該條款時,租箱人可提 前還箱;如未訂立此款,即使
3、是提前還箱,租箱人仍需補 交提前日數的追加租。還箱地點租箱人應合同規定或租箱公司另用書面 形式確認的具體地點箱。在訂立合同時,租箱人應盡量使 還箱地點與箱子最終用地點一致或接近,這樣可以減少空 箱運輸費用。還箱時箱子狀況箱人在還箱時應保證箱子外表狀 態良好,即保證箱子持提箱時雙方簽訂的設備交接單上說明的狀況。該條款一規定如果還箱時外表有損壞,租箱人 應承擔修理責任與費。租箱合同中一般還規還箱期滿若干 (有的是 30 天 后,租箱人仍未還箱租箱公司將作為箱子全損處理。租箱 人應按合同規定的金支付賠償金,在租箱公司未收到賠償 金前,租箱人仍需按際天數支付租金。損害修理責任條款租箱人還箱時,應按備交
4、接單上記載的狀況還箱,如 有損壞應負責將子修理好后還箱承擔修一時費用。 如租箱時在合同中訂損害修理 Damage Protection Plan,DPP)條款并按規定付費,則箱人對租箱期內所造成 的損壞在一定程度上負修理責任,可將未修理的箱子退還 租箱公司不論箱子租箱期內是否損壞DPP 費用一律不 予退還。DPP 條款從某仲意義上講當租箱人對租箱期內集 裝箱的損害進行了保 (但不是向保險司投保但租箱人 必須了解DPP 費用一般保箱子的部分損害不承擔全損 和共同海損等責任。慣上只負責比箱子當時價值低一些的 一個因定限額之內,租箱公司承擔;如超過此限額則,則超過部分仍需要租箱承擔。DPP 用一般按
5、租箱數收 取。租金及費用支付條款租箱人應按時支付合中規定承擔的各種費用及租金, 這是自由使用集裝箱具有某些權利和減少責任的前提,不 按時支付費用和租金則構成違約,租箱公司有權采取適當 的行動直至收回集裝。租箱合同的租金與費用支付條款主 要包括下列內容:租期租期一般理解從交箱之日起至還箱之日止的 一段時間。租金計算方法租金第箱天計收用天數計算一 般從交箱當日起算至箱公司接受還箱的次日為止。在超期 還箱情況下期天按合同規定的租金另行支 (通常比正 常租金高一倍如合中定有提前終止的條款租箱人支付 提前終止費用一般相于 5-7 天金后,租期到集箱進 入還箱堆場日終止。租金支付方式一般金支付方式有兩種按
6、月支付 或按季支付。租箱人在收到租金付通知單后,在規定時間 內一般為 )付。如延則需按合規定的費率加付利 息。(4)交還箱手續費。租箱人按合同規定支付交、還箱 手續費。該費用主要來抵償因在堆場交、還箱所產生的費 用裝卸車費、單證費 ),其數額或由同規定,或按交、 還箱所在堆場的費用定。租箱合同中除上述條款外,一般 還有設備標志更改條及其他有關租箱責任,義務,保險和 轉租等條款。珠江口水域航行注意項珠江口水域 事部門規定的地理覆蓋范圍為 11332E1142400 215500N222000N 線內水域在航海的 實踐中,往往從蒲臺開始至馬友石燈船之間的水域稱之為 珠江口水域。此段水域是水上交通忙
7、區域 2004 年 6 月 日起 實行珠江口水域船舶線制。定線制有多航路交叉,水 道縱橫交錯,港口密,在該水域有多條船舶航路產生多種 方向的交叉。大濠水道定線制有四分道通航段,加上現有的香港大 嶼山快速船東段分道航段有 條分道通航段的航路交 叉,交通流狀況復雜 為解決多條航路交叉的問題,避 免船舶交叉碰撞,設了第三警戒區,警戒區內設有半徑為 80 米“安全島”,要求船穿越警戒區時,圍繞“安全 島”逆時針航行。擔水道定線制與香港東博寮水道分道通 航航路也形成交叉,二警戒區就是為解決兩條分道通航航 路的交叉而專門設置。在警戒區中心設置燈船,為了使船 舶易于辨明大濠水道線制警戒區“安全島”的位置,在
8、警 戒區中心設置 1 安裝有雷達應答器的燈船。現以船舶西行為例,蒲臺島之后,由東博寮水道進入 香港水域的船只多為型船舶,由于受到龍鼓洲西水道水深 的制約,駛往深圳赤港的大型船舶也借道東博寮水道由龍 鼓水道進港。所以,經東博寮水域外側時,要嚴格遵守珠 江口水域船舶定線制規定,行駛在自己的航線上,遇有從 東博寮水道駛出的大船舶,應根據 1972 年國際海上避碰 規則進行避讓,必要慢車等讓,同時可以保持香港海事的 12 頻守聽,密切注意出口舶的動態。這里也是海事高 發水域,具體原因也是交叉船舶互相爭行,因為西行船是 規則上規定的讓路船所以應主動避讓出口船,以免出現緊 迫局面。在遇有香港域漲潮時,停泊
9、在擔桿列島內側的錨 泊船也要依次進港,特別注意其搶頭。駛過東博寮水域之后,應當注意東行往丫島拋錨的船舶,及早與之聯系,確 定會讓意圖。有些西行船舶在過外仃島之后,向左轉向進入桂山錨 地或外伶仃島的大型舶錨地拋錨,追越時要尤其謹慎,做 到提前聯系,取得對同意后方可追越。再往西船舶駛經東南告線。即以桂山引航錨地中心點 54N/1134650為圓心,半徑 海里, 從擔桿水道2208N/1135730至東澳 島西南方附近水域(1600E)的 圓弧線。在實踐中,把他設為一個經度:即 113 度 分 東經,船舶應當用 VHF09 頻道向桂山交管報告自己的息 和動態。進入大濠水道東南段第四分隔帶北側通航分道
10、,航向 306 度轉向進入前可把大鴉洲燈樁參照,同時應注意從 第四分隔帶南側出口行的船船,進入第三警戒區時,將航 路 號燈船即我們習慣稱的桂山燈船置于舷,靠警戒區 右側半圓航行進入第分隔帶東側通航分道,航向 348 度, 再經大濠水道北段駛廣州或珠江三角洲其他港口,通過第 五分隔帶北側端部時航 2 號燈浮(白豎條相間球形 望板,裝雷達反射器3 米標)于左舷。在第三警戒區行 時,應注意從第三分帶東側通航分道進口的船舶,以及經第六分隔帶、大嶼山速船分道兩側通航分道穿越第三警戒 區的高速客船。在由分流角駛入珠江域的過程中,會與進入深圳的船 舶航向形成交叉,此應當確定會讓意圖,謹慎避讓。此外 在漁汛期
11、,還要注意航道中穿越的拖網漁船。航運操作分油機常見故障1.離筒達不到規定轉速原因:制動器未松開摩擦離合器內混入油脂,摩擦片 打滑或損壞;電動機電氣設備故障。2.能進油或分油過程斷油(1)由泵或管路的問題不能生足夠低的吸入壓力油 泵傳動齒輪錐銷折斷泵嚴重磨損間太大泵轉速太低;吸如管漏氣;油柜已。(2) 泵吸入壓力過低:油柜油太低;供油泵前濾器堵 塞或管路不通;油溫低,粘度太大。3.水口跑油水封水未能建立或受破壞動時水封水未加或加 得太少;進油閥開得猛,水封被破壞;轉速不足使水封壓 力不夠;分離盤片間堵。油水分界面外移至分 :外重力環內徑過大;油未 加熱至要求值,密度。4.渣口跑油:(排渣口未能封
12、閉(1)滑圈不能上移堵死密封腔泄水口。分離筒上小空堵塞不泄水;滑動圈下方彈簧失效;滑 動圈上方塑料堵頭失。(2)滑底盤下部缺密封水高置水箱無水;工作系統管道或控制閥堵塞或嚴重漏 泄;滑動底盤周向密圈失效漏泄。(3)滑底盤與分離筒蓋不能緊滑動底盤上端面密封失效;傳動齒輪和軸承過度磨損 使立軸下沉。5.能排渣缺少壓下滑動圈的開工作水:高置水箱無水;工作系 統管道或控制閥堵塞嚴重漏泄,有關工作水孔臟堵不通; 滑動全周向密封失效6.現異常振動或噪聲分離筒安裝不正確固件松動或與機蓋水盤摩擦, 傳動機械因缺油或油差而覺壞;軸承過度磨損而使立軸下 沉,供油泵卡阻或損;摩擦離合器損壞或過度磨損,質量 不均勻,
13、排渣不凈;離筒內積渣不均。提單操作一、打制訂艙單。訂艙單用下貨紙根據主提供的委托單制作填 制的項目有SHIPPER、CONSIGNEE、NOTIFY 、POR、 MARKSNOS、QUANTITY、DESCRIPTION OF GOODS、GROSS WEIGHT IN KILOS、 MEASUREMENT、TOTAL。打制完上述內容后明運輸條款訂艙單的右上 角打上代理人的電話傳真,并加蓋代理人方章,送至配載 的船公司。二、收到貨主正式單后進行審單。1.證必須齊全。貨主必須提供的單據:合同副本(售貨確認書、形式 發票)、正本裝箱單少一份、正本發票至少一份、正本出 口收匯核銷單,出口物如需海關監
14、管條件還必須提供相應 證件。2.果貨主提供的單據已繕制好以下方面審核:A、合同、委托與裝單、發票上顯示的尺碼、重量是 否一致。合同、委托與裝箱單發票上顯示的金額以及幣種 是否一致(合同金額小于發票金額)。合同、委托與裝箱單發票上顯示的發票號是否一 致。合同、委托與裝箱單發票上顯示的合同號是否一 致。正本單據不許有任何改。合同不能是手寫,否用打字機重新繕制。3.果貨主提供的單據空白,可按下項目繕制:裝箱單主要填制的內為麥頭、發票號碼、合同號、 裝貨港、卸貨港、品、規格、數量、毛重、凈重。發票主要填制的內容嘜頭、合同號、發票號、裝 貨港、卸貨港、貨物述、數量、單價、總價。三、轉報關單據。接到船公司
15、集港通知,取回下貨紙。在集港前一天下 午 時前同港務局貨運科做集港劃下小一 式三聯)。轉至報關行的單據有裝箱單、發票、合同、委托 報關協議、報關單、貨紙、聯系單(一式兩聯)、海關監 管條件涉及的證件,述單據各 1 份。編號為 1、2、3 的據必須由貨主提供。委托報關協議(副本可以),用規定格式加蓋出 口單位公章,填上相內容。下貨紙。在前述訂艙的基礎上,在相應的位置補 充船名、航次、提單,貨物描述需用中文加以標識,報關 只需提供裝貨單收貨留底聯,每一聯的右上角都應加蓋代 理人方章。下貨紙裝單應蓋有該條船船代的簽章。聯系單。聯系單是代人與報關行聯系的單據,上 面列明代理人轉給報行何種單據及份數,將
16、單據轉至報關 行前,應填好一式兩的聯系單,單據轉至報關行后,其中 一聯應有報關行相關員的簽字,以備存檔。合同、裝箱單、發票報關單、許可證、商檢證轉 至報關行前應有留底四、確認提單。繕制提單前應注意貨有無特殊要求,一般情況下, 貨主都會在委托中注。如要求在提單中顯示SHIPPED ON BOARD簽 單時,應注意上、下章中之一應簽在 SHIPPED ON BOARD 旁邊)。如果涉及倒簽、預借應事先與船公司確認好是否 能接受,如果可以接,應填制好保函傳真給貨主,讓其加 蓋公章,返回后再由理人提供給相關船公司。貿易操作租賃需辦理的手續一、以租賃方式引進備,其報批手續同一般技改引進項目 相同,需報請
17、有關上批準立項。引進單位將上述批件其復印本提交租賃公司,經審查 同意后即可受理。根據引進單位自行選或上租的推薦,決定國外制造廠 商,進行詢價,組織術洽談和商務談判,對金額較大或技 術性很強的項目,組赴國外考察,談妥后,由上租同國外 制造廠簽訂購貨合同并與承租人簽訂租賃合同。設備價款由上租籌措匯支付,設備由制造廠直接交貨 給承租人,在設備到后,由承租單位在規定期限內分期以 外匯償付租金,因此建立項目時承租單位應對按期支付的 外匯金額做出妥善安。為保證租金的按期償,承租單位在提出租賃委托書的 同時,應向上租提交主管局(公司)或當地金融機構出具 的經濟保證書,擔保租單位按期償付租金。租賃期滿,承租人
