勞動合同變更協議英文?PartyA(Employer):Name:[CompanyName]RegisteredAddress:[Address]LegalRepresentative:[Name]PartyB(Employee):Name:[EmployeeName]IDNumber:[IDNumber]Address:[Address]I.IntroductionThisLaborContractAmendmentAgreement(the"Agreement")ismadeandenteredintoasof[Date]byandbetweenPartyAandPartyBinaccordancewiththe"CivilCodeofthePeople'sRepublicofChina"andotherrelevantlawsandregulations,aimingtoamendandsupplementtheoriginalLaborContract(the"OriginalContract")enteredintobetweenthetwopartieson[OriginalContractDate].II.AmendmentContentA.AmendmentofWorkPosition1.OriginalPosition:PartyBwasoriginallyemployedinthepositionof[OriginalPositionName]inPartyA.2.NewPosition:Aftertheamendment,PartyB'spositionwillbechangedto[NewPositionName].Thespecificresponsibilitiesandjobrequirementsofthenewpositionareasfollows:[Describeindetailthemainresponsibilitiesofthenewposition,suchasdailyworktasks,projectassignments,etc.].[Listanyspecificskills,qualifications,orexperiencerequiredforthenewposition].B.AmendmentofWorkLocation1.OriginalWorkLocation:PartyB'soriginalworklocationwas[OriginalWorkLocation].2.NewWorkLocation:Thenewworklocationaftertheamendmentis[NewWorkLocation].PartyBshallreporttothisnewlocationforworkstartingfrom[ReportingDate].C.AmendmentofSalaryandCompensation1.OriginalSalaryStructure:PartyB'soriginalmonthlysalarywasposedof[BaseSalaryAmount]asthebasesalary,[PerformancerelatedSalaryComponents]forperformancerelatedpay,andotherallowancesandbenefitsinaccordancewiththepany'sregulations.2.NewSalaryStructure:Aftertheamendment,PartyB'smonthlysalarywillbeadjustedto[NewBaseSalaryAmount],andtheperformancerelatedpayandotherallowanceswillbereevaluatedandadjustedaccordingtothenewposition'sperformanceassessmentsystem.Thenewperformancerelatedpayponentsandcalculationmethodsareasfollows:[Describeindetailhowperformancerelatedpayisdetermined,e.g.,performanceevaluationindicators,weightofeachindicator,andthecalculationformulabasedonperformancescores].PartyAshallpayPartyB'ssalaryona[SalaryPaymentCycle,e.g.,monthly]basis,andthesalaryshallberemittedtoPartyB'sbankaccount[BankAccountDetails]onorbeforethe[PaymentDate]ofeachmonth.D.AmendmentofWorkingHoursandLeaveArrangements1.OriginalWorkingHours:PartyBwasoriginallyworkingunderthe[OriginalWorkingHourSystem,e.g.,standardworkinghours]system,withadailyworkinghoursof[OriginalDailyWorkingHours]andaweeklyworkinghoursof[OriginalWeeklyWorkingHours].2.NewWorkingHours:Duetothenatureofthenewposition,PartyBwillnowworkunderthe[NewWorkingHourSystem,e.g.,flexibleworkinghours]system.Thespecificworkinghoursarrangementisasfollows:PartyBisrequiredtoplete[RequiredWorkingHoursperWeek]workinghoursperweekonaverage.PartyBcanadjusthis/herworkinghourswithinacertainrange[Specifytherange,e.g.,9:0018:00witha1hourlunchbreak]accordingtotheworkneeds,butmustensurethatthetotalworkinghoursperweekmeettherequirements.PartyBneedstorecordhis/herworkinghoursaccuratelythroughthepany'sapprovedtimetrackingsystem[Describethetimetrackingsystem].3.LeaveArrangements:TheleavepoliciesandproceduresforPartyBremainbasicallythesameasthoseintheOriginalContract,exceptforthefollowingadjustmentsrelatedtothenewposition:PartyBisentitledto[NewAnnualLeaveDays]daysofannualleaveperyearbasedonhis/herlengthofserviceinthenewposition.Thecalculationmethodofannualleavedaysisinaccordancewiththerelevantlawsandregulations.Incaseofspecialbusinessneedsofthepany,PartyAmay,inaccordancewiththelaw,arrangeforPartyBtoworkovertime.Overtimeworkshallbepensatedinaccordancewiththe"LaborLawofthePeople'sRepublicofChina"andthepany'sovertimepensationpolicy.Theovertimepensationstandardis[Describetheovertimepensationstandard,e.g.,1.5timesthehourlywagefornormalworkinghoursonweekdays,2timesforweekends,and3timesforstatutoryholidays].III.RightsandObligationsofBothPartiesA.RightsandObligationsofPartyA1.Rights:PartyAhastherighttoadjustPartyB'sworkposition,worklocation,salary,andotherlaborcontracttermsinaccordancewiththepany'sbusinessneedsandrelevantlawsandregulations,providedthatpropernoticeandproceduresarefollowedasstipulatedinthisAgreement.PartyAhastherighttorequirePartyBtoabidebythepany'sworkrules,regulations,andpolicies,andtoperformhis/herdutiesinaccordancewiththerequirementsofthenewposition.2.Obligations:PartyAshallprovidePartyBwithnecessaryworkingconditionsandresourcesrequiredforthenewposition,includingbutnotlimitedtoofficeequipment,workspace,andrelevanttrainingopportunities.PartyAshallpayPartyB'ssalaryandotherpensationinfullandontimeinaccordancewiththeprovisionsofthisAgreement.PartyAshallhandlePartyB'ssocialinsuranceandhousingprovidentfundinaccordancewiththelawandrelevantregulations,andensurethatPartyBenjoyscorrespondingwelfarebenefits.B.RightsandObligationsofPartyB1.Rights:PartyBhastherighttoknowthedetailsoftheamendmenttothelaborcontractinadvanceandtoexpresshis/heropinionsandsuggestions.PartyBhastherighttorequirePartyAtoprovidenecessarysupportandassistanceforhim/hertoadapttothenewposition.PartyBhastherighttoenjoythesalary,benefits,andleaverightsasstipulatedinthisAgreement.2.Obligations:PartyBshallabidebyPartyA'sworkrules,regulations,andpolicies,andperformhis/herdutiesinaccordancewiththerequirementsofthenewpositionwithduediligenceandprofessionalism.PartyBshallacceptPartyA'sreasonableworkarrangementsandadjustments,andshallnotrefusewithoutjustifiablereasons.PartyBshallmaintainconfidentialityofPartyA'sbusinesssecrets,tradesecrets,andothersensitiveinformationduringtheperformanceofthisAgreement.IV.ConfidentialityandNonCompeteA.Confidentiality1.DefinitionofConfidentialInformation:ConfidentialinformationreferstoallinformationrelatedtoPartyA'sbusiness,includingbutnotlimitedtobusinessplans,customerlists,productdesigns,technicalknowhow,financialinformation,andanyotherinformationthatisnotpubliclyavailableandisofmercialvaluetoPartyA.2.ObligationofConfidentiality:PartyBshallkeepallconfidentialinformationofPartyAconfidentialduringthetermofthisAgreementandfor[ConfidentialityPeriod,e.g.,2years]aftertheterminationorexpirationofthisAgreement.PartyBshallnotdisclose,use,orallowanythirdpartytousesuchconfidentialinformationwithoutthepriorwrittenconsentofPartyA.3.Exceptions:Thisconfidentialityobligationdoesnotapplytoinformationthat:IsalreadypubliclyknownorbespubliclyknownthroughnofaultofPartyB;Isrequiredtobedisclosedbylaworbyacourtorder;IsdisclosedtoPartyBbyPartyAwithoutanyconfidentialityrestrictions.B.NonCompete1.ScopeofNonCompete:DuringthetermofthisAgreementandfor[NonCompetePeriod,e.g.,1year]aftertheterminationorexpirationofthisAgreement,PartyBshallnotengageinanyactivitiesthatpetewithPartyA'sbusinessinthe[NonCompeteBusinessScope,e.g.,thesameindustryorrelatedfields]withinthe[NonCompeteGeographicScope,e.g.,aspecificregion].2.ObligationofNonCompete:PartyBshallnotdirectlyorindirectlybeemployedby,provideservicesto,orhaveanyequityorfinancialinterestinanyentitythatpeteswithPartyAduringthenonpeteperiod.3.CompensationforNonCompete:InconsiderationofPartyB'snonpeteobligation,PartyAshallpayPartyBanonpetepensationof[NonCompeteCompensationAmount]permonthduringthenonpeteperiod.ThenonpetepensationshallbepaidtogetherwithPartyB'ssalaryonamonthlybasis.V.DurationoftheAgreementThisAgreementshalleintoforceasofthedateofsigningbybothpartiesandshallremaininforceuntiltheexpirationorterminationoftherelevantlaborrelationshipbetweenPartyAandPartyBinaccordancewiththelawandthetermsofthisAgreement.VI.AmendmentandTerminationA.Amendment1.AnyamendmenttothisAgreementshallbemadeinwritingandsignedbybothparties.Amendmentsshallbeeffectiveuponthedateofsigningbybothparties.2.IncaseofanyconflictbetweentheamendmentprovisionsofthisAgreementandtheOriginalContract,theamendmentprovisionsshallprevail.B.Termination1.ThisAgreementmaybeterminatedunderthefollowingcircumstances:Bymutualagreementofbothparties;InaccordancewiththeprovisionsofthelawandtheOriginalContract;IncaseofforcemajeureorotherunforeseeableandirresistiblecircumstancesthatmakeitimpossibletoperformthisAgreement.2.IntheeventofterminationofthisAgreement,bothpartiesshallhandletherelevantmattersinaccordancewiththelawandtheOriginalContract,includingbutnotlimitedtosettlementofsalary,handoverofwork,andreturnofpanyproperty.VII.違約責任與爭議解決A.LiabilityforBreach1.IfPartyAfailstoperformitsobligationsunderthisAgreement,suchasdelayingsalarypayment,refusingtoprovidenecessaryworkingconditions,orviolatingtheconfidentialityandnonpeteprovisions,PartyAshallbearthecorrespondinglegalliability.PartyBhastherighttorequirePartyAtoperformitsobligations,andmayalsoclaimdamagesforanylossessufferedasaresultofPartyA'sbreach.2.IfPartyBfailstoperformitsobligationsunderthisAgreement,suchasrefusingtoacceptworkarrangementswithoutjustifiablereasons,breachingtheconfidentialityornonpeteprovisions,PartyBshallbearthecorrespondinglegalliability.PartyAhastherighttorequirePartyBtoperformitsobligations,andmaydeduct
