安全生產責任制是最基本的安全管理制度是所有安全生產管理制度的核心。安全生產責任制是按照安全生產管理方針和“管生產的同時必須管安全”的原則,將各級負責人員、各職能部門及其工作人員和各崗位生產工人在安全生產方面應做的事情及應負的責任加以明確規定的一種制度。具體來說,就是將安全生產責任分解到相關單位的主要負責人、項目負責人、班組長以及每個崗位的作業人員身上。Safetyproductionresponsibilitysystemisthemostbasicsafetymanagementsystemisthecoreofallsafetyproductionmanagementsystem.Thesafetyproductionresponsibilitysystemisasystemthatclearlydefinesthethingsandresponsibilitiesthatresponsiblepersonnelatalllevels,functionaldepartmentsandtheirstaffandproductionworkersatallpositionsshoulddoinsafetyproductioninaccordancewiththesafetyproductionmanagementpolicyandtheprincipleof"managingproductionwhilemanagingsafety."Specifically,itistodecomposethesafetyproductionresponsibilitytothemainpersoninchargeoftherelevantunit,theprojectleader,theteamleaderandtheoperatorofeachpost.

安全生產責任制度的主要內容如下:Themaincontentsofthesafetyproductionresponsibilitysystemareasfollows:

(1)安全生產責任制度主要包括企業主要負責人的安全責任,負責人或其他副職的安全責任,項目負責人(項目經理)的安全責任,生產、技術、材料等各職能管理負責人及其工作人員的安全責任,技術負責人(工程師)的安全責任、專職安全生產管理人員的安全責任,施工員的安全責任,班組長的安全責任和崗位人員的安全責任等。

(1)Thesafetyproductionresponsibilitysystemmainlyincludesthesafetyresponsibilityofthemainpersoninchargeoftheenterprise,thesafetyresponsibilityofthepersoninchargeorotherdeputy,thesafetyresponsibilityoftheprojectleader(projectmanager),thesafetyresponsibilityofthepersoninchargeofproduction,technology,materialsandotherfunctionsandtheirstaff,thesafetyresponsibilityofthetechnicalpersonincharge(engineer),thesafetyresponsibilityofthefull-timesafetyproductionmanagementpersonnel,thesafetyresponsibilityoftheconstructionpersonnel,thesafetyresponsibilityoftheteamleaderandthesafetyresponsibilityofthepostpersonnel.(2)項目應對各級、各部門安全生產責任制規定檢查和考核辦法,并按規定期限進行考核,對考核結果及兌現情況應有記錄。(2)Theprojectshouldstipulatetheinspectionandassessmentmethodsforthesafetyproductionresponsibilitysystemofalllevelsanddepartments,andcarryouttheassessmentaccordingtotheprescribedtimelimit,andrecordtheassessmentresultsandfulfillment.

(3)項目獨立承包的工程在簽訂承包合同中必須有安全生產工作的具體指標和要求。工程由多單位施工時,總分包單位在簽訂分包合同的同時要簽訂安全生產合同(協議),簽訂合同前要檢查分包單位的營業執照、企業資質證、安全資格證等。分包隊伍的資質應與工程要求相符,在安全合同中應明確總分包單位各自的安全職責。(3)Theindependentcontractingprojectmusthavespecificindicatorsandrequirementsofsafetyproductioninthecontract.Whentheprojectisconstructedbymultipleunits,thesubcontractorshouldsignthesafetyproductioncontract(agreement)whilesigningthesubcontract.Beforesigningthecontract,thesubcontractor'sbusinesslicense,enterprisequalificationcertificateandsafetyqualificationcertificateshouldbechecked.Thequalificationofthesubcontractingteamshouldbeconsistentwiththeengineeringrequirements,andtherespectivesafetyresponsibilitiesofthesubcontractingunitsshouldbeclarifiedinthesafetycontract.

原則上,實行總承包的由總承包單位負責,分包單位向總包單位負責,服從總包單位對施工現場的安全管理,分包單位在其分包范圍內建立施工現場安全生產管理制度,并組織實施。Inprinciple,thegeneralcontractingunitisresponsiblefortheimplementationofthegeneralcontracting,andthesubcontractingunitisresponsibleforthegeneralcontractingunit,whichissubjecttothesafetymanagementoftheconstructionsitebythegeneralcontractingunit.Thesubcontractingunitestablishestheconstructionsitesafetyproductionmanagementsystemwithinitssubcontractingscopeandorganizesandimplementsit.

(4)項目的主要工種應有相應的安全技術操作規程,砌筑、抹灰、混凝土、木工、電工、鋼筋、機械、起重司機、信號指揮、腳手架、水暖、油漆、塔吊、電梯、電氣焊等工種,特殊作業應另行補充。應將安全技術操作規程列為日常安全活動和安全教育的主要內容,并應懸掛在操作崗位前。(4)Themaintypesofworkoftheprojectshouldhavethecorrespondingsafetytechnicaloperationprocedures,masonry,plastering,concrete,carpentry,electrician,steel,machinery,cranedriver,signalcommand,scaffold,plumbing,paint,towercrane,elevator,electricalweldingandothertypesofwork,specialoperationsshouldbesupplemented.Safetytechnicaloperationproceduresshouldbelistedasthemaincontentofdailysafetyactivitiesandsafetyeducation,andshouldbesuspendedinfrontoftheoperationpost.

(5)工程項目部專職安全人員的配備應按住房和城鄉建設部的規定,1萬m2以下工程1人;1萬一5萬m2的工程不少于2人;5萬m2以上的工程不少于3人。

總之,企業實行安全生產責任制必須做到在計劃、布置、檢查、總結、評比生產的時候,同時計劃、布置、檢查、總結、評比安全工作。

(5)Theallocationoffull-timesafetypersonnelintheengineeringprojectdepartmentshouldbeinaccordancewiththeprovisionsoftheMinistryofHousingandUrban-RuralDevelopment,1personforprojectsbelow10,000m2;notlessthan2personsforaprojectof115,000m2;morethan50,000m2oftheprojectisnotlessthan3people.Inshort,theimplementationofthesafetyproductionresponsibilitysystemmustbedoneintheplanning,layout,inspection,summary,evaluationofproduction,whileplanning,layout,inspection,summary,evaluationofsafetywork.二、安全生產許可證制度(Safetyproductionlicensesystem)

國務院建設主管部門負責中央管理的建筑施工企業安全生產許可證的頒發和管理,其他企業由省、自治區、直轄市人民政府建設主管部門進行頒發和管理,并接受國務院建設主管部門的指導和監督。

企業取得安全生產許可證,應當具備下列安全生產條件：ThecompetentdepartmentofconstructionundertheStateCouncilisresponsiblefortheissuanceandmanagementofsafetyproductionlicensesforconstructionenterprisesunderthecentralgovernment,andotherenterprisesareissuedandmanagedbythecompetentdepartmentofconstructionunderthepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernment,andaccepttheguidanceandsupervisionofthecompetentdepartmentofconstructionundertheStateCouncil.Enterprisesshouldhavethefollowingsafetyproductionconditionstoobtainsafetyproductionlicense:

(1)建立、健全安全生產責任制,制定完備的安全生產規章制度和操作規程。

(2)安全投入符合安全生產要求。

(3)設置安全生產管理機構,配備專職安全生產管理人員。

(4)主要負責人和安全生產管理人員經考核合格。

(5)特種作業人員經有關業務主管部門考核合格取得特種作業操作資格證書。

(6)從業人員經安全生產教育和培訓合格。

(7)依法參加工傷保險,為從業人員繳納保險費。(1)Establishandimprovethesafetyproductionresponsibilitysystem,formulatecompletesafetyproductionrulesandregulationsandoperatingprocedures.(2)Safetyinvestmentmeetstherequirementsofsafetyproduction.(3)Setupsafetyproductionmanagementinstitutions,equippedwithfull-timesafetyproductionmanagementpersonnel.(4)Themainpersoninchargeandsafetyproductionmanagementpersonnelhavepassedtheexamination.(5)Thespecialoperationpersonnelobtainedthespecialoperationqualificationcertificatebytherelevantbusinessdepartment.(6)Theemployeesarequalifiedbysafetyeducationandtraining.(7)Participateinindustrialinjuryinsuranceaccordingtolaw,payinsurancepremiumsforemployees.

(8)廠房、作業場所和安全設施、設備、工藝符合有關安全生產法律、法規、標準和規程的要求。

(9)有職業危害防治措施,并為從業人員配備符合國家標準或者行業標準的勞動防護用品。

(10)依法進行安全評價。

(8)Workshops,workplacesandsafetyfacilities,equipmentandprocessesshallmeettherequirementsofrelevantlaws,regulations,standardsandproceduresforworksafety.(9)Haveoccupationalhazardpreventionandcontrolmeasures,andequipemployeeswithlaborprotectionproductsthatmeetnationalstandardsorindustrystandards.(10)Conductsafetyevaluationaccordingtolaw.

(11)有重大危險源檢測、評估、監控措施和應急預案。

(12)有生產安全事故應急救援預案、應急救援組織或者應急救援人員,配備必要的應急救援器材、設備。

(13)法律、法規規定的其他條件。(11)Therearemajorhazarddetection,assessment,monitoringmeasuresandemergencyplans.(12)Haveproductionsafetyaccidentemergencyrescueplan,emergencyrescueorganizationoremergencyrescuepersonnel,equippedwiththenecessaryemergencyrescueequipment.(13)Otherconditionsstipulatedbylawsandregulations.

企業進行生產前,應當依照該條例的規定向安全生產許可證頒發管理機關申請領取安全生產許可證,并提供該條例第六條規定的相關文件、資料。安全生產許可證頒發管理機關應當自收到申請之日起45日內審查完畢,經審查符合該條例規定的安全生產條件的,頒發安全生產許可證;不符合該條例規定的安全生產條件的,不予頒發安全生產許可證,書面通知企業并說明理由。

Beforeproduction,theenterpriseshallapplytotheadministrativeorganfortheissuanceofproductionsafetylicensestoobtainproductionsafetylicensesinaccordancewiththeprovisionsoftheregulations,andproviderelevantdocumentsandmaterialsstipulatedinArticle6oftheregulations.Theadministrativeorganfortheissuanceofproductionsafetylicensesshallcompletetheexaminationwithin45daysfromthedateofreceiptoftheapplication.Iftheexaminationmeetstheconditionsofproductionsafetystipulatedintheregulations,theproductionsafetylicenseshallbeissued.Ifitdoesnotmeetthesafetyproductionconditionsstipulatedintheregulations,itwillnotissueasafetyproductionlicense,andnotifytheenterpriseinwritingandexplainthereasons.

安全生產許可證的有效期為3年。安全生產許可證有效期滿需要延期的,企業應當于期滿前3個月向原安全生產許可證頒發管理機關辦理延期手續。

企業在安全生產許可證有效期內,嚴格遵守有關安全生產的法律法規,未發生死亡事故的,安全生產許可證有效期屆滿時,經原安全生產許可證頒發管理機關同意,不再審查,安全生產許可證有效期延期3年。

企業不得轉讓、冒用安全生產許可證或者使用偽造的安全生產許可證。

Theproductionsafetylicenseisvalidfor3years.Iftheexpirationofthesafetyproductionlicenseneedstobeextended,theenterpriseshouldgothroughtheextensionformalitieswiththeoriginalsafetyproductionlicenseissuancemanagementauthoritythreemonthsbeforetheexpiration.Duringthevalidityperiodofthesafetyproductionlicense,theenterprisestrictlyabidesbythelawsandregulationsrelatedtosafetyproduction.Ifthereisnodeathaccident,whenthevalidityperiodofthesafetyproductionlicenseexpires,withtheconsentoftheoriginalsafetyproductionlicenseissuingandmanagementauthority,itwillnotbereviewed,andthevalidityperiodofthesafetyproductionlicensewillbeextendedby3years.Enterprisesshallnottransferorfraudulentlyusesafetyproductionlicensesoruseforgedsafetyproductionlicenses.

三、政府安全生產監督檢查制度

政府安全監督檢查制度是指國家法律、法規授權的行政部門,代表政府對企業的安全生產過程實施監督管理。《建設工程安全生產管理條例》第五章“監督管理”對建設工程安全監督管理的規定內容如下：

(1)國務院負責安全生產監督管理的部門依照《中華人民共和國安全生產法》的規定,對全國建設工程安全生產工作實施綜合監督管理。

GovernmentsafetysupervisionandinspectionsystemThegovernmentsafetysupervisionandinspectionsystemreferstotheadministrativedepartmentauthorizedbynationallawsandregulations,whichsupervisesandmanagesthesafetyproductionprocessofenterprisesonbehalfofthegovernment.Theprovisionsofthe"RegulationsontheAdministrationofSafetyProductioninConstructionProjects"Chapter5"SupervisionandManagement"onthesafetysupervisionandmanagementofconstructionprojectsareasfollows:(1)ThedepartmentresponsibleforthesupervisionandmanagementofsafetyproductionoftheStateCouncilimplementscomprehensivesupervisionandmanagementofthesafetyproductionofconstructionprojectsnationwideinaccordancewiththeprovisionsofthe"SafetyProductionLawofthePeople'sRepublicofChina."

(2)縣級以上地方人民政府負責安全生產監督管理的部門依照《中華人民共和國安全生產法》的規定,對本行政區域內建設工程安全生產工作實施綜合監督管理。(2)Inaccordancewiththeprovisionsofthe"People'sRepublicofChinaProductionSafetyLaw,"thedepartmentsresponsibleforthesupervisionandmanagementofproductionsafetyofthelocalpeople'sgovernmentsatorabovethecountylevelimplementcomprehensivesupervisionandmanagementoftheproductionsafetyofconstructionprojectsintheadministrativeregion.

(3)國務院建設行政主管部門對全國的建設工程安全生產實施監督管理。國務院鐵路、交通、水利等有關部門按照國務院規定的職責分工,負責有關專業建設工程安全生產的監督管理。(3)TheconstructionadministrativedepartmentoftheStateCouncilsupervisesandmanagesthesafetyproductionofconstructionprojectsnationwide.Therailway,transportation,waterconservancyandotherrelevantdepartmentsoftheStateCouncilareresponsibleforthesupervisionandmanagementofthesafetyproductionofrelevantprofessionalconstructionprojectsinaccordancewiththedivisionofresponsibilitiesstipulatedbytheStateCouncil.

(4)縣級以上地方人民政府建設行政主管部門對本行政區域內的建設工程安全生產實施監督管理。縣級以上地方人民政府交通、水利等有關部門在各自的職責范圍內,負責本行政區域內的專業建設工程安全生產的監督管理。
