thecostoftheservicesprovidedandthoseoftheservicescarriedoutfromthemomentofadvancedre-entry如果其他變更的方案不可行，或者因嚴重和正當的原因被消費者所拒絕，組織者應以原先所預期的交通方式將消費者送回出發地點，或者最終協商的其他地點，為其提供交通方式和座位/艙位，并返還消費者已經支付的服務費用與返回時已給予了的服務所用費用之間的差價。11.SUBSTITUTIONS合同當事方的替代人Therenouncingclientcanbesubstitutedbyanotherpersonprovidedthat:明示放棄合同的當事方可以由其他人替代。只要替代人符合以下條件：a.)Theorganizerisinformedinwritingatleast4workingdaysbeforethefixeddateofdeparture,receivingcontextuallycommunicationregardingthegeneralitiesofthetransfereeassignee;組織者在約定啟程前至少提前4個工作日得到書面通知，并接到有關受讓方的的一般情況的常規通報。b.)Thes?ubstitutesatisfiesalltheconditionsforthefruitionoftheservice(exart.89Cod.Cons.)andinparticulartheprerequisitesrelativetopassport,visaandhealthcertificates;替代方應符合接受服務的條件，如：消費者法第89條(art.89Cod.Cons.)之規定，特別是有必需的護照、簽證和健康證明。12.OBLIGATIONSOFTHEPARTICIPANTS參團人員的義務Theparticipantsmusthavean(individualorpersonal)passportorotherdocumentationvalidforallthecountriesinthecontentsoftheitinerary,aswellasavisaoftransportationandhealthcertificatesthatwillberequested.TheparticipantsmustadheretotherulesofprudenceandcautionandtothoserulesthelawsenforcedwithintheItalianterritory,toalltheinformationprovidedtothembytheorganizer,andtotherulesandadministrativeandlegislativeprovisionsrelativetothetourismpackage.參團人員必須持有個人護照或旅行路線上各個國家都有效的其他證件，以及旅行簽證和必需的健康證明。參團人員必須審慎遵守規定，遵守意大利境內實施的法律法規，依從組織者提供給他們的所有信息以及涉及團隊旅游的規章、行政法令和其他立法。13.HOTELCLASSIFICATION酒店的等級TheofficialclassificationofthehotelsareprovidedbytheprogramwithinformativematerialbasedontheexplicitandformalindicationsbycompetentauthorityoftheProvinceofArezzo.Theorganizerreservestherighttoprovideintheprogramortouristbrochureapersonaldescriptionoftheaccommodationstructure,sotopermitanevaluationandconsequentacceptanceonbehalfoftheconsumer.酒店的等級是在日程中根據Arezzo省主管當局的明文正式規定在通報資料中提供的。組織者有權在日程中或者旅游宣傳冊中做自己的描述，因此也允許代表消費者做評估和接受。14.SYSTEMOFRESPONSIBILITY責任劃分Theorganizerisresponsiblefordamagescausedtotheconsumerduetopartialortotalnon-fulfilmentofthecontractualservicesdue,bothifthesearecausedbyhimorbythirdpartyserviceproviders,unlessprovedbytheconsumer(therewithinitiativeindependentlytakenuponthemselvesinthecourseofthetouristservices)orbyextraneouscircumstancestotheservicesprovidedinthecontract,afortuitousevent,circumstancesbeyondone’scontrolorcircumstancesthattheorganizercouldnot,inaccordancewithstandardprofessionalism,reasonablyforeseeorresolve.組織者要對由于自己未能部分或者全部履行合同服務而給消費者造成的傷害負責，包括這些傷害是組織者或者第三方服務提供者的責任，除非能夠證明是消費者在旅游過程中自己造成的，或者是合同履行過程中外來因素、偶然事件、無法控制的因素、或者是由于組織者無法根據職業規范標準合理預見和解決的原因造成的。Thevendoratthelocationofwherethereservationwasmadeofthetourismpackageisnotresponsibleinanycaseoftheobligationsthatarisefromtheorganizationofthetrip,butisresponsibleexclusivelyfortheobligationsthatariseregardingtheintermediary’squalitiesandwithinthelimitsofresponsibilityoftheregulationsinforceonthesubject.在旅游團隊所預定的場所的客戶不對旅途中組織所發生的任何事件負責，但要對組織質量承擔完全義務，其責任限于對該事件的強制性規定。15.LIMITSOFCOMPENSATION賠償標準CompensationfordamagestothepersoncannotexceedtheforeseenlimitsbytheinternationalconventionsforwhichItalyandtheEuropeanUnionarepartofwithreferencetotheserviceswhoseperformancehasdeterminedtheresponsability.Inanycasethecompensationlimitcannotexceedtheamountof50,000Eurofordamagestopeople,2,000Eurofordamagestoobjects,5000Euroforanyotherdamage.對人身的傷害賠償，根據意大利和歐盟所參與的國際公約，不超過可預見的范圍，參照服務的履行而定責任。無論任何情況下，對人身的傷害賠償不超過5萬歐元；對財物的損失不超過2千歐元；其他賠償不超過5千歐元。16.OBLIGATIONSOFASSISTENCE組織者的協助義務Theorganizerisresponsibletoprovidethemeasureofassistancetotheconsumerthatisimposedbythecriteriaoftheprofessionalstandardexclusivelyinreferencetotheobligationsofhis/herjobundertheprovisionsofthelaworcontract.Theorganizerandthevendorareexoneratedfromtherespectiveresponsibilities.(art.14and15oftheseGeneralConditions)whenthemissingorinexactcarryingoutofthecontractischargeabletotheconsumerorisdependentonathirdpartyinanunforeseeableorinevitableway,orinthecaseoffortuitouseventorcircumstancesbeyondone’scontrol.組織者應根據法律和合同所規定的職責，按照職業規范為
