ethefinalpaymentapplicationandmakethepaymentwithinthespecifiedtimelimit.第九條工程進度與時間安排9.1工程進度計劃9.2關鍵節點時間9.3延期及違約處理9.3.2TheOwnershallhavetherighttoimposeliquidateddamagesorpenaltiesforthedelaysinaccordancewiththeContractDocuments.9.3.3TheContractorshallberesponsibleforthecostsandexpensesincurredtheOwnerduetothedelays.第十條設計要求及標準10.1設計文件要求TheContractorshallprepareandsubmitdesigndocumentsthatmeettherequirementsandstandardsspecifiedintheContractDocuments,includingbutnotlimitedtodrawings,specifications,andtechnicaldocuments.10.2設計標準及規范10.3設計變更及修改10.3.1TheContractorshallsubmitdesignchangeorderstotheOwnerforanychangesormodificationstothedesigndocumentsthatarenecessaryduringthecourseoftheWork.10.3.2TheOwnershallreviewandapproveordisapprovethedesignchangeordersinaccordancewiththeContractDocuments.10.3.3TheContractorshallmakethenecessarychangesormodificationstothedesigndocumentsandcoordinatewiththeOwnerfortheimplementationofthedesignchanges.第十一條施工要求及標準11.1施工標準及規范TheContractorshallperformtheconstructionworkinaccordancewiththerequirementsandstandardsspecifiedintheContractDocuments,includingbutnotlimitedtotherelevantconstructionsandstandards.11.2施工組織設計11.3施工材料及設備TheContractorshallusehighqualitymaterialsandequipmentthatmeettherequirementsandstandardsspecifiedintheContractDocumentsfortheconstructionwork.11.4施工質量控制TheContractorshallestablishandimplementaqualitycontrolsystemtoensurethattheWorkmeetsthequalityrequirementsspecifiedintheContractDocuments.第十二條工程驗收及保修12第二部分：第三方介入后的修正13.第三方介入13.1定義13.1.1第三方介入是指除合同雙方（甲乙雙方）外的其他方，根據本合同約定或法律、法規的要求，參與并提供服務、材料或設備等。13.1.2第三方介入包括但不限于設計咨詢單位、材料供應商、設備供應商、檢測機構、監理機構等。13.2第三方責任13.2.1第三方應按照合同約定及相關法律法規的要求，提供符合質量、安全、環保等標準的服務、材料或設備。13.2.2第三方應承擔因其提供的服務、材料或設備不符合約定標準而導致的全部責任。13.2.3第三方介入的費用、責任及權益等，均應由甲乙雙方在本合同中予以明確。13.3第三方選擇與審查13.3.1甲乙雙方應共同對第三方進行選擇和審查，確保第三方具備相應的資質、能力和信譽。13.3.2甲乙雙方應共同參與第三方的選擇過程，包括但不限于資質審查、價格談判、合同簽訂等。13.3.3甲乙雙方應共同監督第三方的工作過程，確保第三方按照合同約定和法律法規的要求進行操作。13.4第三方協調與溝通13.4.2甲乙雙方應共同解決第三方在介入過程中出現的問題和困難。13.4.3甲乙雙方應定期召開會議，討論第三方介入的相關事宜，確保項目進度和質量的保障。13.5第三方責任限額13.5.1甲乙雙方應在合同中明確第三方的責任限額，包括但不限于賠償限額、違約金等。13.5.2甲乙雙方應確保第三方了解其責任限額，并在合同執行過程中嚴格遵守。13.5.3如第三方因違約或其他原因導致甲乙雙方損失，甲乙雙方有權依據合同約定向第三方追償。14.第三方與其他方的劃分14.1第三方與甲乙雙方14.1.1第三方應明確其與甲乙雙方之間的合同關系，遵循甲乙雙方的合同約定。14.1.2甲乙雙方應確保第三方的介入不會侵犯其他方的合法權益。14.2第三方與項目其他參與方14.2.2第三方應遵守項目相關的合同約定和法律法規要求，不得損害項目其他參與方的合法權益。14.3第三方與業主方及承包方14.3.1第三方應理解并尊重業主方和承包方的合同權益，不得擅自變更合同約定。14.3.2第三方應按照合同約定和業主方、承包方的要求，提供符合質量、安全、環保等標準的服務、材料或設備。15.第三方介入的合同修改15.1甲乙雙方應在本合同中明確第三方介入的相關條款，包括第三方的責任、權益、義務等。15.2如合同執行過程中需要調整第三方介入的相關內容，甲乙雙方應簽訂補充協議，明確調整事項和具體條款。15.3甲乙雙方應確保第三方介入的合同修改符合法律法規的要求，并經雙方共同認可。第三部分：其他補充性說明和解釋說明一：附件列表：1.合同主體資格證明文件：包括甲乙雙方的營業執照、資質證書、法定代表人身份證明等。2.工程設計文件：包括設計圖紙、技術規范、設計說明等。3.施工組織設計方案：包括施工計劃、施工進度、施工安全措施等。4.材料設備采購清單：包括材料設備名稱、規格、數量、供應商等。5.施工圖紙及技術規范：包括施工圖紙、技術規范、施工要求等。6.工程驗收標準：包括工程驗收規范、驗收程序、驗收標準等。7.工程保修協議：包括保修期限、保修范圍、保修責任等。8.第三方資質及合同文件：包括第三方的資質證書、合同文本、責任限額等。9.合同變更協議：包括合同變更內容、變更原因、變更日期
