InspectiondeclareristhepersonwhoacquiresthequalificationspecifiedbytheAdministrationofQualitySupervision,InspectionandQuarantine,registersatinspectionandquarantineinstitutionandisresponsibletohandleentry-exitinspectionandquarantineformalities.Inspectiondeclarermustserveinacertaininspectiondeclarationunitandcannotworkindependently.Inspectoristhejointnameoftheinspectiondeclarationunitandinspectiondeclarerwhoimplemententry-exitinspectionandquarantineandcustomsinspection/applicationproceduresandformalitiesandundertakethecorrespondingobligationsandlegalresponsibilities.Inordertostrengthenthemanagementoverinspectiondeclarer,inspectionandquarantineinstitutionimplementscertificatesystemforinspectiondeclaration,andinspectiondeclarershallshowhis“CertificateforInspectionDeclaration”whenmakinginspectiondeclaration.GeneralAdministrationofQualitySupervisionhascentralizedthemanagementofthenationalInspectionDeclarers’registration;alldirectlyaffiliatedinspectionandquarantinebureausareresponsiblefortheinspectiondeclarers’registrationmanagementwithintherespectivejurisdictions.Alllocalinspectionandquarantineagenciesareresponsiblefordailysupervisionofinspectiondeclarers’registrationmanagement,whichcarriesoutthesystemoferrorregistrationmanagement.一、報檢員報檢員是指獲得國家質檢總局規定的資格，經檢驗檢疫機構注冊，負責辦理出入境檢驗檢疫報檢業務的人員，報檢員必須服務于某一個報檢單位而不能獨立其外。報檢人是對履行出入境檢驗檢疫報檢/申報程序和手續并承擔相應義務和法律責任的報檢單位和報檢員的統稱。為了加強對報檢員的管理，檢驗檢疫機構實行憑證報檢制度，報檢員報檢時應主動出示其“報檢員證”。國家質檢總局統一管理全國報檢員的注冊管理工作，各直屬檢驗檢疫局負責所轄地區報檢員注冊管理工作，各地檢驗檢疫機構負責報檢員注冊的日常監督管理工作。檢驗檢疫機構對報檢員日常的報檢行為實施差錯登記管理制度。Ⅱ.QualificationofInspectionDeclarerPersonnelwhoattendtheexaminationforthequalificationsofInspectionDeclarersshallmeetthefollowingconditions：①atleast18yearsoldwithcompletecapacityforcivilconduct;②withgoodmoralcharacter;③withhighschoolorsecondaryprofessionalschooloraboveeducationbackground;④otherconditionsstipulatedbyGeneralAdministrationofQualitySupervision.ThepersonwhohaspassedtheinspectionqualificationexamcanacquiretheQualificationCertificateofInspection,whichwouldbeinvalidautomaticallyifthepersondidnotengageininspectionbusinesswithin2years.二、報檢員資格參加報檢員資格考試的人員應當符合下列條件：①年滿18周歲，具有完全民事行為能力；②具有良好的品行；③具有高中或者中等專業學校以上學歷；④國家質檢總局規定的其他條件。報檢員資格考試合格的人員，取得“報檢員資格證”，2年內未從事報檢業務的，“報檢員資格證”自動失效。Ⅲ.InspectionDeclarers’RegistrationThepersonwhohasobtainedtheQualificationCertificateofInspectioncanapplyforinspectiondeclarerregistration.Theinspectiondeclarer’sregistrationshouldbeappliedbytheenterprisewhichhasregisteredattheinspectionandquarantineinstitutionsandobtainedinspectionunitcodeattheinspectionandquarantineinstitutionattheplaceofregistration,andsubmitthefollowingmaterials：①ApplicationFormforInspectionDeclarers’Registration;②theregistrationcertificateoftheenterprisethattheto-beinspectiondeclarerworksfor,issuedbyinspectionandquarantineinstitutions;③QualificationCertificateofInspectionoftheto-beinspectiondeclarer;④othersupportingdocumentsrequiredbyinspectionandquarantineinstitutions.AsforthosewhoseQualificationCertificateofInspectionisinvalid,orwhoseCertificateforInspectionDeclarationisrevokednomorethan3years,orthosewhohavebeenregisteredininspectionandquarantineagenciesasaninspectiondeclarerbuthavenotgonethroughtheprocessofcancellation,registrationwillnotbehandledforthembytheinspectionandquarantineagencies.

三、報檢員注冊獲得“報檢員資格證”的人員，方可申請報檢員注冊。報檢員注冊應當由在檢驗檢疫機構登記并取得報檢單位代碼的企業向登記地檢驗檢疫機構提出申請，并提交下列材料：①報檢員注冊申請書；②擬任報檢員所屬企業在檢驗檢疫機構的登記證書；③擬任報檢員的《報檢員資格證》；④檢驗檢疫機構需要的其他證明文件。對“報檢員資格證”失效的，被吊銷“報檢員證”不滿3年的，已在檢驗檢疫機構注冊為報檢員并且未辦理注銷手續的，檢驗檢疫機構不予以注冊。Ⅳ.TheTransferenceofInspectionDeclarerInspectionstafftransferredtootherlocalenterprisestoengageinthebusinessofinspectionshalltaketheproofdocumentsofthenewenterpriseandapplyfortransferringformalitiesattheissuinginstitutionofinspectionandquarantine.Iftransferredtoenterprisesinadifferentplacetoengageintheinspectionbusiness,heorsheshallapplyfortheinspectionandquarantineinstitutionandgothroughthecancellationprocedures,andreregisterattheinspectionandquarantineinstitutionattheplaceofthenewenterprisewiththecancellationcertificate.四、報檢員變更報檢員調往當地其他企業從事報檢業務的，應當持調入企業的證明文件，向發證檢驗檢疫機構辦理變更手續；調往異地企業從事報檢業務的，應當向調出地檢驗檢疫機構辦理注銷手續，并持注銷證明向調入企業所在地檢驗檢疫機構重新辦理注冊手續。Ⅴ.ManagementofInspectionDeclarer1.CertificateofInspectionDeclarationisanidentitycertificateoftheinspectiondeclarerforhandlinginspectiondeclaration,soitshallnotbelentoralteredtoothers.2.Inspectiondeclarershallnotservefortwoormoredeclarationinspectionunitsfortheinspectionworkconcurrently.3.Inordertosupervisetheinspectiondeclarer,inspectionandquarantineagenciesadoptasystemoferrorregistration.4.CertificateforInspectionDeclarationisonlyvalidfor2years,and30daysbeforetheexpirationdate,inspectiondeclarershallapplyforextensionattheissuanceorgan.Inspectionandquarantineagenciesexaminethembytheirdailyinspectionworkrecord.Ifthepersonpassestheexamination,thecertificatecanbeextendedfor2years.Ifnot,thecertificatecanbeextendedfor2yearsaftertheinspectiondeclarer'squalifiedtraining;iftheinspectiondeclarerdidnotapplyforextensionbeforetheprescribedtimelimit,orattendtrainingandexaminationasrequired,orfailedtheexamination,theextensionwouldnotbepermittedandboththeCertificateforInspectionDeclarationandtheQualificationCertificateofInspectionwouldlosevalidity.5.AsforthelossoftheCertificateforInspectionDeclaration,thestatementonthesituationshouldbesubmittedwithin7daystotheissuanceagencywithadeclarationofitsinvalidityinthenewspaper;ifthecertificatewasstillvalid,itcouldbereissued.Beforethereissuance,thedeclarercannothandleinspectiondeclaration.

6.Underanyofthefollowingcircumstances,companieswhichinspectiondeclarersworkforshouldcollecttheCertificateforInspectionDeclarationandhandittothelocalinspectionandquarantineagencies,andapplyforthecancellationproceduresofCertificateforInspectionDeclarationinwrittenform：①theinspectiondeclarernolongerengageininspectionbusiness;②theenterpriseshasstoppedinspectionbusinessforsomereasons;③enterprisehasdismissedtheinspectiondeclarers.Inspectionandquarantineagenciesshalldealwithitintimeaccordingtotheprovisions,andissuetheCancellationCertificateofInspectionDeclarer.Asforthelegaldisputesresultedfromhandlingthecancellationformalities,theenterpriseoftheinspectiondeclarershouldundertakethelegalconsequences.7.IfInspectiondeclarershaveoneoffollowingactions,inspectionandquarantineagenciesshallsuspendtheinspectionqualificationfor3monthsor6months：①notperformobligationsasinspectiondeclarerforsubstitutedinspectionunitandthecircumstancesareserious;②therearethreetimesormoreofinspectionerrorsinayearandthecircumstancesareserious;③lendingoralteringtheCertificateofInspectionDeclaration.

8.IftheinspectiondeclarerwantstoapplyforregistrationoftheCertificateofInspectionDeclarationafteritscancellation,inadditiontoprovidingthesamematerialasthefirsttime,youshouldprovidetheCancellationCertificateofInspectionDeclarerissuedbytheinspectionandquarantineorganattheplaceoftheoriginalregistration;iftheCertificateforInspectionDeclarationwasnotregisteredwithin2yearsaftercancellation,theQualificationCertificateofInspectionwouldbeinvalidautomatically.9.Inspectiondeclarersfromself-serviceinspectionunitscanhandleinspectionformalitiesofthesubordinateunitsintheinspectionandquarantineinstitutionsoutsidetheregistrationplacesandreceivethemanagementofthelocalinspectionandquarantineinstitutions.10.Inspectionandquarantineinstitutionsadoptascoringsystemfortheerrorsandregulationviolationsofinspectiondeclarersduringhandlinginspectionformalities.

五.報檢員管理1.“報檢員證”是報檢員辦理報檢業務的身份憑證，不得轉借、涂改。2.報檢員不得同時兼任兩個或兩個以上報檢單位的報檢工作。3.檢驗檢疫機構對報檢員的管理實施差錯登記制度。4.“報檢員證”的有效期為2年，有效期屆滿的，在30日前，報檢員應當向發證機構提出延期申請，檢驗檢疫機構結合日常報檢工作記錄對報檢員進行審核，審核合格的，延期2年；審核不合格的，經過培訓合格的，延期2年；沒有在規定期限前提出延期申請，或未按要求參加培訓和考試的，或考試不合格的，不予延長，其“報檢員證”和“報檢員資格證”同時失效。5.遺失“報檢員證”的，應在7日內向發證機構遞交情況說明，并登報聲明作廢；在有效期內的，予以補發，補發前不得辦理報檢業務。6.有下列情形之一的，報檢員所屬企業應該收回其“報檢員證”交當地檢驗檢疫機構，并以書面形式申請“報檢員證”注銷手續：①報檢員不再從事報檢業務的；②企業因故停止報檢業務的；③企業解聘報檢員的。檢驗檢疫機構按規定及時予以辦理，并出具“報檢員證注銷證明”。因為辦理“報檢員證”注銷手續而產生的法律糾紛由報檢員所屬的企業承擔法律后果。7.報檢員有下列行為之一的，由檢驗檢疫機構暫停其3個月或者6個月報檢資格：①不履行代理報檢單位報檢員義務，情節嚴重的；②1年內出現3次以上報檢差錯行為，情節嚴重的；③轉借或者涂改報檢員證的。8.“報檢員證”注銷后申請重新注冊的，除提供與首次注冊相同的材料外，還應提交原注冊地檢驗檢疫機構出具的“報檢員注銷證明”；“報檢員證”注銷后二年內未申請重新注冊的，“報檢員資格證”自動失效。9.自理報檢單位的報檢員可以在注冊地以外的檢驗檢疫機構辦理本單位的報檢業務，并接受當地檢驗檢疫機構的管理。10.檢驗檢疫機構對報檢員在辦理報檢業務過程中出現的差錯或違規行為實行記分管理。First,scoringmethod.①Accordingtotheerrorortheseverityoftheviolations,thetotalscoreforeachtimeisdividedintofourtypesincluding12points,4points,2pointsand1point.②Thescoringperiodisoneyearandthefullmarkis12points.CountingfromtheinitialissuancedateoftheCertificateofInspectionDeclaration,ifthetotalscoredoesnotaccumulateto12pointsattheendofthescoringperiod,thescoreofthisperiodwillbeeliminatedandnotbetransferredintothenextperiod.③Iftwoormorescoringeventstakeplaceinoneinspectionbusiness,thescoreshouldbecalculatedseparatelyandaccumulated.④AsfortheCertificateofInspectionDeclarationwhichhasbeenreregisteredaftercancellationorreissuedowingtoalterationofpersonalregistrationinformation,theoriginalscoresarestillvalid.⑤Wheninspectionandquarantineagenciesrecordtheerrorsorillegalbehaviorsofinspectiondeclarers,theyshouldfillinthe"InspectionDeclarerError/RegulationViolationsRecordSheet,andrequiretheinspectiondeclarerstoconfirmandsignit.Thesheetshouldbeputonrecordforfuturereference.⑥Havinganyobjectiontothescores,theinspectiondeclarerisallowedtoappealitonthespotorwithin3days,inspectionandquarantineagenciesshallfullylistentotheopinionsandcarryoutreverification.Duringscoring,theinspectionandquarantineagenciesshouldalsohelptocorrecttheerrorsorirregularitiesandannouncethescoringperiod,scoringevents,scoresandrelevantsettlementregulations.

其一，記分方法①一次記分的分值,依據差錯或違規行為的嚴重程度,分為12分,4分,2分和1分四種。②記分周期為一年度,滿分12分,從“報檢員證”初次發證之日起計算，一個記分周期期滿后,記分分值累計未達到12分的,該周期內的記分分值予以消除,不轉入下一個記分周期。③報檢員在同一批次報檢業務中出現兩處或以上記分事項的,應分別計算,累加分值。④報檢員經注銷后重新注冊或變更個人注冊信息換發“報檢員證”的,原記分分值繼續有效。⑤檢驗檢疫機構對報檢員的差錯或違規行為進行記分時,應填制“報檢員差錯/違規行為記錄單”，并要求報檢員簽字確認,存檔備查。⑥對記分有異議的,應允許報檢員當場或在3日內提出申訴,檢驗檢疫機構應充分聽取其意見并進行復核。檢驗檢疫機構在對報檢員記分的同時，應對其差錯或違規行為進行糾正，并將有關記分周期、記分事項與分值以及處理規定等內容予以公告。Second,supervisionandadministration.Underanyofthefollowingcircumstances,thequalificationofinspectiondeclarationshouldbesuspended：①Asfortheinspectiondeclarerwithascoringupto12pointswithinoneperiod,inspectionandquarantineinstitutionsshouldsuspendtheinspectionqualificationforthreemonths;②Ifthescoreisaccumulatedto12pointsagainduringorafterthesuspensionoftheinspectionqualificationwithinthesamescoringperiod,theinspectionandquarantineinstitutionsshallsuspendthequalificationfor6months;③Whenthesuspensionofthequalificationcomestotheend,theoriginalscorewouldbeclearedandresettilltheendofthisperiod;④Inspectiondeclarersshallnotdealwiththeinspectionbusinessduringtheperiodwheninspectionqualificationissuspended.TheinspectionandquarantineinstitutionsshalltemporarilycollecttheCertificateforInspectionDeclarationandmakeanannouncementaboutthesuspensionifthecertificatescannotbecollected;⑤Asfortheinspectiondeclarerstransferredtothelocalenterprisesorenterprisesintheotherplacesforinspectionbusinessduringthecertificatesuspensionperiod,theinspectionandquarantineinstitutionsshallnotgothroughtransferenceformalitiesforthem,orissueCancellationCertificateofInspectionDeclarer.Underanyofthefollowingcircumstances,inspectionandquarantineinstitutionsshallcanceltheinspectiondeclarers’inspectionqualificationandrevoketheirCertificateforInspectionDeclaration：①unfaithfulinspectionresultinginseriousconsequences;②providingfakecontracts,invoices,billofladinganddocuments;③counterfeiting,faking,buying,selling,stealingoralteringthecustomsclearancecertificate,documents,stamps,logos,sealingandqualitycertificationmarksofinspectionandquarantine;④otheractsviolatinglawsandregulationsoninspectionandquarantineregulationsandthecircumstancesareserious.

其二，監督管理報檢員有下列情形之一的，暫停其報檢資格：①對在一個記分周期內記分滿12分的報檢員,檢驗檢疫機構應暫停其3個月報檢資格；②在同一記分周期內,被檢驗檢疫機構暫停報檢資格期間或期限屆滿后,被再次記滿12分的,檢驗檢疫機構應暫停其6個月報檢資格；③報檢員被暫停報檢資格期限屆滿后,原記分分值予以清除,重新記分至該記分周期終止；④報檢員在被暫停報檢資格期間,不得辦理報檢業務。檢驗檢疫機構應暫時收回有關“報檢員證”,無法收回的應予以公告；⑤被暫停期限未滿,調往當地或異地其他企業從事報檢業務的,檢驗檢疫機構不予辦理變更手續,不予出具“報檢員證注銷證明”。報檢員出現下列情況之一的，檢驗檢疫機構應取消其報檢資格，吊銷“報檢員證”：①不如實報檢，造成嚴重后果的；②提供虛假合同、發票、提單等單據的；③偽造、變造、買賣或者盜竊、涂改檢驗檢疫通關證明、檢驗檢疫證單、印章、標志、封識和質量認證標志的；④其他違反檢驗檢疫法律法規規定，情節嚴重的。11.Iftheinspectiondeclarerdoesnotactfaithfullyduringinspectiondeclarationandthecircumstancesareserious,thequalificationwillbecancelledandtheCertificateforInspectionDeclarationwillbesuspended.Thosewhoseinspectionqualificationshavebeencancelledarenotallowedtoattendinspectionqualificationexaminationwithinthreeyears.11.報檢員在報檢活動中沒有如實報檢的，情節嚴重的，取消其報檢資格，吊銷其“報檢員證”，被取消報檢員資格的，3年內不允許參加報檢員資格考試。

Ⅵ.RightsandObligationsofInspectionDeclarerRights：1.Fortheexitgoods,inspectiondeclarersshouldhandleinspectionformalitiesattheinspectionandquarantineinstitutionsattheprescribedplacewithinprescribedtimebyentry-exitinspectionandquarantineorgans.2.Fortheentrygoods,inspectiondeclarershavetherighttorequestinspectionandquarantineinstitutionstocompleteinspectionandquarantineworkwithintheprescribedtimeorclaimperiodstatedintheforeigntradecontract,andissuetheproofdocumentsafterhandlinginspectionformalitiesattheprescribedplacewithinprescribedtimebyinspectionandquarantineinstitutionsandprovidingeveryconditionofsampling,inspectionandquarantine.3.Ifinspectiondeclarershaveobjectiontotheinspectionandquarantineresultsmadebyinspectionandquarantineinstitutions,theyhavetherighttoapplytooriginalinspectionandquarantineinstitutionsorsuperiorinstitutionsforreinspectionaccordingtorelevantlaws.4.Ifinspectiondeclarershavejustifiablereasonstocanceltheinspectiondeclaration,theyhavetherighttohandlethecancellationformalitiesinaccordancewithrelevantregulations.5.Theinspectiondeclarershavetherighttorequireinspectionandquarantineinstitutionanditsstafftokeepsecret,whentheyproviderelevantcommercialandshippingdocumentsinconfidentialcircumstances.6.Theinspectiondeclarershavetherighttochargeandaccusethestaffininspectionandquarantineinstitutionsoftheiranyactivitiesviolatinglawsorregulationslikeabuseofpower,malpracticesandfalsificationofinspectionandquarantineresults.Obligations：1.Inspectiondeclarersshallnotconcurrentlyserveforself-serviceinspectionunits,substitutedinspectionunitsormorethanoneunit.2.Inspectiondeclarershavethedutytoconveyandexplaintherelevantlaws,regulations,announcementsandadministrativemeasuresonentry-exitinspectionandquarantinetotheirsubordinateenterprises.3.Inspectiondeclarers

shallabidebytherelevantlawsandregulationsofinspectionandquarantine,handleinspectiondeclarationformalitiesattheprescribedplaceandtime,providefaithfuldata,completeandvaliddocumentstotheinspectionandquarantineinstitutions,andfillinthedeclarationformaccurately,detailedlyandclearly.Allthesubmitteddocumentsshouldbecompleteandauthentic,andhelpthesubordinateenterpriseswiththefilingofinspectionmaterials.4.Inspectiondeclarershavethedutytoprovidenecessaryworkingconditionsforinspectionandquarantineinstitutions,suchassampling,inspection,quarantine.5.Theinspectiondeclarershavethedutytostrengthenthebatchmanagementofgoodsthathavepassedtheinspectionandquarantineconductedbytheinspectionandquarantineinstitutions.Wrongdeliveryormissingdeliveryisnotpermittedincasethatdocumentsandgoodsdonotconformwitheachother;theentrygoodssubjecttostatutoryinspectionandquarantinecannotbesold,used,unloadedordeliveredwithoutinspectionandquarantineorpermissionfrominspectionandquarantineinstitutions.6.Inspectiondeclarersshouldpayinspectionandquarantinefeesinaccordancewithregulationswhenapplyingforinspection,quarantineandappraisal.7.Inspectiondeclarers

muststrictlyabidebythelawsandregulationsoninspectionandquarantine,andtheyshallnotalter,falsifyorcounterfeitinspectionandquarantinecertificates（paper）withoutpermission.8.Asfortheins
