Theconceptandtypesoflaborcontracts(2)種類Types②無固定期限勞動合同Unfixedtermlaborcontract無固定期限勞動合同,是指用人單位與勞動者約定無確定終止時間的勞動合同。用人單位與勞動者協商一致,可以訂立無固定期限勞動合同。Unfixedtermlaborcontractreferstoalaborcontractwheretheemployerandtheemployeeagreeonanindefiniteterminationtime.Employersandworkerscanenterintoopen-endedlaborcontractsthroughconsultationandagreement.有下列情形之一,勞動者提出或者同意續訂、訂立勞動合同的,除勞動者提出訂立固定期限勞動合同外,應當訂立無固定期限勞動合同:Ifaworkerproposesoragreestoreneworenterintoalaborcontractunderanyofthefollowingcircumstances,inadditiontotheworkerproposingtoenterintoafixedtermlaborcontract,anopen-endedlaborcontractshallbeconcluded:(一)勞動者在該用人單位連續工作滿十年的;(1)Theworkerhasworkedcontinuouslyfortheemployerforatleasttenyears;(二)用人單位初次實行勞動合同制度或者國有企業改制重新訂立勞動合同時,勞動者在該用人單位連續工作滿十年且距法定退休年齡不足十年的;(2)Whenanemployerimplementsthelaborcontractsystemforthefirsttimeorwhenastate-ownedenterpriserestructuresandsignsanewlaborcontract,theemployeehasworkedcontinuouslyfortheemployerforatleasttenyearsandislessthantenyearsfromthestatutoryretirementage;(三)連續訂立二次固定期限勞動合同,且勞動者沒有用人單位可以解除勞動合同的情形,續訂勞動合同的。(3)Continuouslysigningtwofixedtermlaborcontracts,andtheemployeehasnosituationwheretheemployercanterminatethelaborcontract,andrenewthelaborcontract.用人單位自用工之日起滿一年不與勞動者訂立書面勞動合同的,視為用人單位與勞動者已訂立無固定期限勞動合同。Ifanemployerfailstosignawrittenlaborcontractwiththeemployeeforoneyearfromthedateofemployment,itshallbedeemedthattheemployerandtheemployeehavesignedanopen-endedlaborcontract.

Nonfull-timeemployment非全日制用工是指以小時計酬為主,勞動者在同一用人單位一般平均每日工作時間不超過四小時,每周工作時間累計不超過二十四小時的用工形式。Nonfull-timeemploymentreferstoaformofemploymentwherewagesaremainlycalculatedbythehour,andtheaveragedailyworkinghoursofworkersinthesameemployergenerallydonotexceedfourhours,andthecumulativeweeklyworkinghoursdonotexceedtwenty-fourhours.2、勞務用工模式Laboremploymentmode(2)非全日制用工

勞動保護是指依靠技術進步和科學管理,采取技術和組織措施,消除勞動過程中危及人身安全和健康的不良條件與行為,防止傷亡事故和職業病,保障勞動者在勞動過程中的安全和健康。Laborprotectionreferstorelyingontechnologicalprogressandscientificmanagement,adoptingtechnicalandorganizationalmeasurestoeliminateadverseconditionsandbehaviorsthatendangerpersonalsafetyandhealthduringthelaborprocess,preventingaccidentsandoccupationaldiseases,andensuringthesafetyandhealthofworkersduringthelaborprocess.3、勞動保護和勞動條件Laborprotectionandworkingconditions

ManagementofLaborEmployment(1)勞務人員:其年齡和身體條件必須符合崗位要求;勞務人員上崗前應接受相應的崗前培訓,掌握一定的技術技能,提高文明施工、安全生產及法律法規意識,以適應相應的工作崗位的需要。Laborpersonnel:Theirageandphysicalconditionsmustmeetthejobrequirements;Laborpersonnelshouldreceivecorrespondingprejobtrainingbeforestartingwork,mastercertaintechnicalskills,improveawarenessofcivilizedconstruction,safetyproduction,andlawsandregulations,inordertoadapttotheneedsofthecorrespondingjobposition.2、勞務用工的管理
ManagementofLaborEmployment(2)勞務分包隊伍進場:其資質必須符合《建筑業企業資質管理規定》,且其承接的業務需符合資質許可的規定范圍;勞務分包企業施工隊伍還必須配備相應的管理人員,全部管理人員應100%持有國家相關部門頒發的管理崗位證。
Mobilizationoflaborsubcontractingteams:Theirqualificationsmustcomplywiththe"RegulationsontheManagementofConstructionEnterpriseQualifications",andthebusinesstheyundertakemustcomplywiththeprescribedscopeofthequalificationpermit;Theconstructionteamoflaborsubcontractingenterprisesmustalsobeequippedwithcorrespondingmanagementpersonnel,andallmanagementpersonnelshouldhold100%ofthemanagementpositioncertificatesissuedbyrelevantnationaldepartments.二、勞務分包款管理

Managementoflaborsubcontractingpayments勞務分包合同價款Priceoflaborsubcontractingcontract1.工人工資Workers'wages2.文明施工及環保費中的人工費Laborcostsincivilizedconstructionandenvironmentalprotectionfees3.管理費Managementfees4.勞動保護費LaborProtectionracketfee5.各項保險費Variousinsurancepremiums6.低值易耗材料費Lowvalueconsumablescost7.工具用具費Toolandequipmentcosts8.利潤Profits3、勞務分包合同價款應當分別約定和必須明確的內容Thepriceoflaborsubcontractingcontractsshouldbeseparatelyagreeduponandclearlydefined⑴發包人將工程勞務作業發包給一個承包人的,正負零以下工程、正負零以上結構、裝修、設備安裝工程等應分別約定;Iftheemployercontractsengineeringlaboroperationstoacontractor,theprojectsbelowplusorminuszero,structuresaboveplusorminuszero,decoration,andequipmentinstallationprojectsshouldbeseparatelyagreedupon;⑵工人工資、管理費、工具用具費、低值易耗材料費等應分別約定;
Workers'wages,managementfees,toolandequipmentfees,andlowvalueconsumablesfeesshouldbeseparatelyagreedupon;3、勞務分包合同價款應當分別約定和必須明確的內容Thepriceoflaborsubcontractingcontractsshouldbeseparatelyagreeduponandclearlydefined⑶承包低值易耗材料的,應當明確材料價款總額,并明確材料款的支付時間、方式;Forcontractinglowvalueandconsumablematerials,thetotalamountofthematerialpriceshouldbespecified,andthepaymenttimeandmethodofthematerialpaymentshouldbespecified;⑷勞務分包合同價格風險幅度范圍應明確約定,超過風險幅度范圍的,應當及時調整。
Theriskrangeofthelaborsubcontractingcontractpriceshouldbeclearlystipulated,andifitexceedstheriskrange,itshouldbeadjustedinatimelymanner.4、勞務分包合同價款結算的時間限制Timelimitforsettlementoflaborsubcontractingcontractprice發包人、承包人應當在勞務分包合同中明確約定對勞務作業驗收的時限,以及勞務合同價款結算和支付的時限。Theemployerandcontractorshallclearlystipulateinthelaborsubcontractingcontractthetimelimitfortheacceptanceoflaboroperations,aswellasthetimelimitforthesettlementandpaymentofthelaborcontractprice.5、勞務分包合同價款支付的有關規定Relevantregulationsonpaymentoflaborsubcontractingcontractprice⑴合同價款支付的時間限制Timelimitforpaymentofcontractprice⑶支付形式Paymentform⑵農民工工資的支付
