2025年度住宅抵押貸款購房合同范本本合同共三部分組成,僅供學(xué)習(xí)使用,第一部分如下:第一條合同依據(jù)1.1依據(jù)《中華人民共和國合同法》、《中華人民共和國物權(quán)法》、《中華人民共和國貸款通則》等法律法規(guī),本合同雙方本著平等、自愿、公平、誠實(shí)信用的原則,就___________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________第二部分:第三方介入后的修正一、第三方概念界定1.1本合同中所述的第三方,指在甲乙雙方簽訂本合同時,因交易需要或法律法規(guī)規(guī)定,介入本合同相關(guān)交易活動的自然人、法人或其他組織。二、第三方介入原因及范圍2.1第三方介入原因:(1)根據(jù)甲乙雙方協(xié)商一致,為提高交易效率或降低交易風(fēng)險;(2)法律法規(guī)規(guī)定必須由第三方介入的交易活動;(3)甲乙雙方認(rèn)為有必要引入第三方介入的其他情況。2.2第三方介入范圍:(1)提供金融服務(wù),如貸款、擔(dān)保、保險等;(2)提供法律、審計、評估等服務(wù);(3)提供交易信息、交易平臺或交易工具;(4)提供其他有助于本合同履行的服務(wù)。三、第三方責(zé)任限額3.1第三方在本合同項下的責(zé)任,僅限于其在本合同項下提供的服務(wù)范圍內(nèi),且不承擔(dān)超出其專業(yè)范圍或能力之外的責(zé)任。3.2第三方在履行本合同項下義務(wù)過程中,如因自身過錯導(dǎo)致甲乙雙方損失,應(yīng)承擔(dān)相應(yīng)的賠償責(zé)任。但第三方賠償金額不超過因其過錯導(dǎo)致甲乙雙方實(shí)際損失的部分。四、甲乙雙方權(quán)利義務(wù)調(diào)整4.1第三方介入后,甲乙雙方的權(quán)利義務(wù)應(yīng)作如下調(diào)整:(1)甲乙雙方應(yīng)與第三方簽訂相應(yīng)服務(wù)協(xié)議,明確各自的權(quán)利義務(wù);(2)甲乙雙方應(yīng)保證第三方在本合同項下提供的服務(wù)符合法律法規(guī)及本合同約定;(3)甲乙雙方應(yīng)按照本合同約定,及時向第三方支付相關(guān)費(fèi)用;(4)甲乙雙方應(yīng)積極配合第三方履行其在本合同項下的義務(wù)。五、第三方與其他各方的劃分說明5.1第三方在本合同項下與其他各方的關(guān)系如下:(1)第三方與甲乙雙方:第三方為甲乙雙方提供相關(guān)服務(wù),甲乙雙方為第三方支付相關(guān)費(fèi)用;(2)第三方與抵押權(quán)人:第三方作為抵押權(quán)人,在甲乙雙方履行本合同時,對抵押物享有優(yōu)先受償權(quán);(3)第三方與債務(wù)人:第三方作為債務(wù)人,在甲乙雙方履行本合同時,應(yīng)履行還款義務(wù);(4)第三方與擔(dān)保人:第三方作為擔(dān)保人,在債務(wù)人無法履行還款義務(wù)時,應(yīng)承擔(dān)相應(yīng)的擔(dān)保責(zé)任。六、第三方變更及退出6.1如因第三方自身原因,需變更或退出本合同,應(yīng)提前________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________________
