NoMemberStatemayprohibittheplacingonthemarketofreflexreflectorsongroundsrelatingtotheirconstructionormethodoffunctioningiftheybeartheEECcomponenttype-approvalmark.2. IftheMemberStatewhichhasgrantedEECcomponenttype-approvalfindsthatanumberofreflexreflectorsbearingthesameEECcomponenttype-approvalmarkdonotconformtothetypewhichithasapproved,itshalltakethenecessarymeasurestoensurethatproductionmodelsconformtotheapprovedtype.ThecompetentauthoritiesofthatStateshalladvisethoseoftheotherMemberStatesofthemeasurestakenwhichmay,wherethereisconsistentfailuretoconform,extendtowithdrawalofEECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMemberStateofsuchfailuretoconform.2. ThecompetentauthoritiesoftheMemberStatesshallwithinonemonthinformeachotherofanywithdrawalofEECcomponenttype-approvalandofthereasonsforsuchameasure▼BArticle6AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirective,torefuseorwithdrawtype-approvalforareflexreflectororprohibititsplacingonthemarketoruseshallsetoutindetailthereasonsonwhichitisbased.Suchdecisionshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.Article7NoMemberStatemayrefusetograntEECtype-approvalornationaltype-approvalofavehicleongroundsrelatingtoitsreflexreflectorsifthesebeartheEECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.共42頁第9頁1976L0760—中文—2004年5月1日—006.001—5▼M2第五條1. 如果準予歐共體零部件型式認證的成員國發現很多帶有歐共體零部件型式認證標記的反光器與認證過的型式不符，則該成員國可以采取必要措施保證生產模型與得到認證的型式相符。該成員國的主管當局應該告知其它成員國的主管當局所采取的措施，如果這些反光器始終不能與經過認證的型式相符，可以撤銷這些反光器的歐共體型式認證。上述成員國的主管當局，在接到發生此類情況的成員國主管當局的通知后，應采取同樣的措施。2. 各成員國的主管當局應在撤銷歐共體零部件型式認證之后一個月之內通知其它成員國主管當局，同時告知采取此類措施的理由。▼B第六條凡是依據本指令執行過程中采用的規定條款而采取的拒絕、撤消反光器的歐共體零部件型式認證決定，或者禁止這些反光器上市銷售或使用的決定，均應詳細列明其依據的理由。應將上述決定通知有關方面，同時應通知后者按照成員國正在實施中的法律其可以采取的補救措施，以及實施上述補救措施的時間期限。第七條如果反光器附著有歐共體零部件型式認證標記，并且其安裝符合《指令76/756/EEC》中的規定要求，則各成員國不得以與反光器有關的理由，拒絕給相關車輛發予歐共體型式認證或國家型式認證。共42頁第10頁1976L0757—EN—01.05.2004—006.001—6▼BArticle8NoMemberStatemayrefuseorprohibitthesale,registration,entryintoserviceoruseofanyvehicleongroundsrelatingtoitsreflexreflectorsifthesebeartheEECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.▼M2Article9ForthepurposesofthisDirective,‘vehicle’meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,anditstrailers,withtheexceptionofvehicleswhichrunonrailsandofagriculturalandforestrytractorsandallmobilemachinery.▼BArticle10AnyamendmentsnecessarytoadjusttherequirementsoftheAnnexestotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article111.MemberStatesshalladoptandpublishtheprovisionsnecessaryinordertocomplywiththisDirectivebefore1July1977andshallforthwithinformtheCommissionthereof.Theyshallapplytheseprovisionsfrom1October1977atthelatest.2. WhereECcomponenttype-approvalisrequestedforatypeoflightingandlight-signallingdevicecomprisingaretro-reflectorandotherlamps,asingleECcomponenttype-approvalnumbermaybeassignedprovidedthattheretro-reflectorcomplieswiththerequirementsofthisDirectiveandthateachoftheotherlampsformingpartofthelightingandlight-signallingdeviceforwhichECcomponenttype-approvalisrequestedcomplieswiththeseparateDirectiveapplyingtoit.共42頁第15頁1976L0760—中文—2004年5月1日—006.001—8▼M22. 標記2.1. 提交用于歐共體零部件型式認證的裝置上必須標附有：2.1.1. 制造商商品名稱或者標記；2.1.2. 標記“頂端（TOP）”，如果需要明確判定制造商規定的旋轉角度或者角度時，應在照明表面頂端呈水平狀標出此標記。2.2. 這些標記應該附著在裝置的照明表面上或者某個照明表面上，并且清晰易讀，不易擦除。裝置裝配到車輛上之后，這些標記應從外部可以看到。2.3. 各裝置上應有足夠的空間來附著這些零部件認證標記。應在附錄I中提及的圖紙上注明該空間。3. 歐共體零部件型式認證的發放3.1. 如果滿足有關要求，應依據《指令70/156/EEC》第四條第（3）款以及第四條第（4）款（如果適用）之規定發予歐共體型式認證。3.2. 附錄2給出了歐共體型式認證證書式樣。3.3. 應給各種反光器型式指定一個認證編號，該編號與《70/156/EEC指令》附錄VII之要求一致。同一個成員國，不得給另一反光器型式指定同一個認證編號。3.4. 需要對某型包含反光器及其它車燈的照明和光信號裝置進行歐共體零部件型式認證時，倘若其中的反光器符合本指令要求，并且作為照明和光信號裝置組成部分的其它各車燈（這些車燈也需要進行歐共體型式認證）符合可適用的獨立指令，則可以單獨指定一個歐共體零部件認證編號。共42頁第16頁1976L0757—EN—01.05.2004—006.001—9▼M24. InthecaseofmodificationsofthetypeapprovedpursuanttothisDirective,theprovisionsofArticle5ofDirective70/156/EECshallapply.5.2. CONFORMITYOFPRODUCTION6.1. Asageneralrule,measurestoensuretheconformityofproductionshallbetakeninaccordancewiththeprovisionslaiddowninArticle10ofDirective70/156/EEC.6.2. Inmechanicalandgeometricalterms,conformityshallbeconsideredsatisfactoryifthedifferencesdonotexceedthevariationsinherentinindustrialproduction.6.3. Conformityofproductionshallnotbeinvalidatedifallthephotometricmeasurementsperformedonaspecimenselectedatrandommeetatleast80%ofthespecification.6.4.
